RESOLUTION NO. 4236
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
ORDERING THE VACATION OF AN EASEMENT FOR EMBANKMENTS
(EAST MEADOW CIRCLE)
WHEREAS, it is the intention of the Council of the City
of Palo Alto to vacate an embankment easement in the City of
Palo Alto, County of Santa Clara, State of California, said
easement being ten (10) feet in width originally acquired for
the purpose of constructing embankments necessary for the con-
struction of street improvements, acquired in conjunction with
the Deed of Dedication granted to the City of Palo Alto by
Colin M. Peters and Carol Peters, his wife, in Book 4003,
page 401, on February 11, 1958; and
WHEREAS, the Council of the City of Palo Alto does hereby
find that the aforesaid easement has not been used for the
purpose for which it was dedicated or acquired for five con-
secutive years next preceding the date of this resolution; and
WHEREAS, from all the evidence submitted to the Council
of the City of Palo Alto, it is found that said easement as
described herein is unnecessary for present or prospective em-
bankment purposes; and
WHEREAS, the Council of the City of Palo Alto reserves
and retains any and all other easements and/or any other right
or rights, license or licenses, over, under and across said
land.
NOW, THEREFORE, the Council of the City of Palo Alto
does RESOLVE as follows:
SECTION 1. That pursuant to the provisions of Section
50443 of the Government Code of the State of California, the
Council of the City of Palo Alto does hereby order that said
embankment easement as described herein be, and hereby is
vacated.
