Roll call as follows: Pres_ente `• Bishop, Byxbee, .Cashel, Corcoran, Cummings, Drysdale, Hanley, Huston, Marshall, Mitchell, Porter, Rodgers, S1.mpson. Absent: Ruppenthal, Pickett. The,minutes'of the meeting of January 25, 1954 Requests , of Robert J. Brister for Fence in Peers Park and..Ordinance a ntroilin& Dogs Mr. Robert.. J. Brister, 278 Oxford Avenue, addressed the Council: „equ.stjng that a. fence be;::built around the spray pool and ,;sand pit;":in Peers Park' to:keep dogs out. This was referred to :`the'City;:Manager: were Mr. Brister=also asked the. Council to put to a vote o.f.: the :people an ordinance requiring dogs to be kept on leash. This ouestiozi was referred to Committee No. 3. Hospital Committee Report A` report was received from the General Hcsp:.ta1 Committee transmitting to�;. the' Council for their information a brief of sub-' committee reports; regarding the hospital problem. The General;Hospita:l Committee also reported that it -has- adopted a report of Its Procedures Sub -committee recommending that the Council take immediate, action as follows: 1. Determine. to build ana addition to the present hospital on leased Stanford. property. 2. Contact and emp7.oy suitable professional consultants to determine', necessary size, and to:carry planning sufficiently far to.: call for a bond election at the earliest. possible time 3. Determine the- possibilities of getting Federal and State financial assistance. This money is to be - additiona:l:toany raised locally. 4: Set up necessary facilities to solicit and accept gifts or ,donations. 5 Set up a.`eommittee to: give necessary publicity to convince; the residentsof the necessity of an addition. to . the; hospital 6. Ca11 necessary public meetings in advance of the bond issue. 7.: Proceed:expediti,ously and promptly to take all steps possible to accelerate the construction of an addition to"the hospital, as this is, in our opinion, the -most important problem before the city government at the present time. of Mitchell and Drysdale, the. above report .The'`Generai Hospjta1 Committee further recommended to the Counoil that' it proceed -immediately to submit to:. the voters'.a bond issue of $4,000,000.00 for enlargement of the Palo ,A1to' Hospital: ,On'motion of Mitchell and Simpson, this was referred to Committee No. 5, the Council Hospital Committee and the City Attorney. Mr. Warren Cook, chairman of the Procedures. Committee of. the Hospital. Committee, Dr. Russel V. Lee and Dr. Herbert T. Browne; addressed the .Council concerning the urgent :need for expansion of the hospital,facilities. Dr. Lee advised that it maybe possible to.obtain additional funds from State or. Federal: grants. Request for Street Name Changes A letter -was, receivedfrom the Postmaster suggesting the renamint of:Florence, Gilman and Scott Streets to "Court Street:" or South Court:". A letter was also received --from Pau].--Kegley ly Gilman Street, requesting that the four streets',.•Florence; Gilman, Scott and South Court, be given the same name. The matter was referred to the Planning Commission. :Contract with Humane Society The City -Manager reported that the contract entered into between the. City:, and the Palo Alto Humane Society in 1928 should have been cancelled some time ago; that it serves no: - useful purpose At present and has been superseded by the present charter'. - On motion of Mitchell and Bishop, the City Manager was authorized to notify the. Humane Society that the agreement will be terminated in thirty' days . Transfer of Funds A re ort:was received from the City Manager requesting a transfer:of $1,050,.00'from Account 123-98B, Special Projects Fund, to Account 175-99, for the purchase of an air compressor, to be used,at:the-Corporation Yard. On motion of Porter and Drysdale, the transfer ' of funds was authorized by unanimous vote on roll call. Fire Zone Map The. City Manager presented a recommendation from the Planning Officer, Fire Chief and Building Inspector, recommending amendmentsLto,the fire zone map to bring it up to' --date with the inclusion of ::ally :'recent changes from residential to commercial and industrial zoning. A<proposed ordinance amending the Fire Zone Map was aocepted for" first reading. Gas TaxSupplemental Agreement The, City.Manager recommended approval of the:First- SupPlemental. Amendment :to -, Subdiviaiori Ordinance Ordinance No. 1520, f amending Ordinance No. 1316, ; the • Subdivision Ordinance of , the City of;, PaloAlto, regulating the • subdivi:sivn, of ,land into ;lean than 'f'ive lots, was presented for •second reading. A reportw was received froth the 'Planning Commission recommending -adoption -of'_ the ordinance with: the addition of a paragraph to;.,read as ;follows "The 'Planning Officer shall make a monthly ;report. to the City Manager of action taken on all applications ,made. _:under .this section. A copy of such report shall also be forwarded to the City Council and :to the Planning Commission." On motion of Mitchell ,,and'Drysdale, the amendment as recommended by 'the Planning Commission was accepted and the ordinance. as: •thus anernded:; was adopted by unanimous vote on roll call.. Amendment to Zoning Ordinance . Ordinance: No. 1521 amending Articles 23 and 24 of Ordin- ance.. No. 1324, the'Zoning Ordinance; establishing the procedure for the granting`, of variances and use permits and for the 'hearing : .of appeals, .was. given. second reading:. A -report was'' received from the Planning Commission recommending adoption of'theordinance with an amendment to the secozld sentence of Section` 2405 by. ,inserting the words "shall hear evidence,' make: findings, and" ...between the worda "Commission'? the'.first. part "of . this sentence would read "Upon :the `hearing of such.: appeaa the Commission shall hear. evidence, `make findingS-, and may recommend to. the City Council....7' .A .mo.ti .was made by. ;Mitchell, seconded by Cummings, that the ordinance as ,amended by ; the Planning Commission be adopted. It was moved. by Byxbee, seconded by Rodgers, that a further amendment be•made-to the ordinance to provide that the $10.00 fee for filing of an appeal be waived when such appeal is'; made by the applicant. The City Attorney advised that the waiving of the fee In Such cases could be considered discriminatory, and pointed out that the fee is to cover the additional posting and mailing of notices. The amendment was declared lost. Ordinance No. 1521 -was ` then adopted, as amended by the Planning Commission, by the; following, vote on roll call: Ayes Biahop,; Corcoran, Cvarmmings, Drysdale, Hanley, Huston, Marshall, Mitchell, Porter, Simpson. The proposed ordinance, amending Article 5: of Codified Ordinance No "5 regulating closing -out; sales was presented for second reading. Mr 'H ''V. Roberts,' who operates Jack=s Furniture Mart at 2360 El.. Camino Real, handling second -land goods, objected to - the provisions :ofthe . ordinance which he.felt were' too restrictive for ,his business; which deals in fire sale goods and similar merchandise. After-disets:s on, it was moved by Drysdale.,: seconded by Rodge.rs,` acid tarried. `that the ordinance be deferred til the next Meeting and`that;an amendment be prepared to except`secord- he nd stores The City Managerreported that a letter had been received from the` -Chamber of Commerce advising that if -'the -. fee of -$25.00 proposed in the ordinance is not adequate to cover the costs of issuing'the permits and making the necessary inventory checks as required, they felt that the fee should be increased or a'provision`included to require payment of the actual costs of';administering•the:ordinance. It was directed that this questionbe also,corsidered::.by the City Attorney in preparing. amendmenta to, the proposed ordinance. Ordinance Amendments (Commercial Amusements) Ordinance No. 1522 amending Section 5.14 of,Codified Ordinance.:No. 5 relative to. theatre and amusement permits was given: second reading, and on motion of Cashel and Rodgers, was adopted.by' unanimous vote on roll call. The monthly report of the Controller for January,. 1954, was received :and . placed On file. A, request was.received from the Controller for authorization' to- refund. a: duplicate payment of the ' first, install- `men'tof . Tax Bill' No. 59.7$ •in the amount of. $13.17 to -Margaret. Shi;-llacher, 2100 Oberlin Street. It was explained that these taxes' h'ad' been paid by the Kohler Realty Company on Deceiber 30, 1953, a'nd::a .duplicate: payment was .made by Miss Shil'lacher on January ;29, ;1954.
