The Council' of the City of Palo Alto met on this, date at 7:30Y P.M., pursuant to adjournment of September 22 952:, with Mayor M?thell presiding. Roll call as follows: - Present r` Bishop, Blois, Cashel, Drysdale, Hill, Marsha:l,-1,. M1tchell., Montrouil, Simpson, Wells, Wickett. Absent: Mra.« Bailer, Cathcart, Gaspar, Miller., The minutes of the meeting of September 22, ' 1952, were Project 48-1z ; Oregon. Avenue et al This was the time for a hearing on amended assessment of Assesssment No' 676, ' Project 48-1. The hearing , was . declared open. There being no ;one present who wished to speak, on the matter,'the hearing was closed. Resolution No.' 2375, confirming amended assessment, was read, and on motion of. Blois and Montrouil, was adopted by unanimous vote on roll call. ' Project k9 -10 -,'Amarillo Avenue et al This was -also the time assessment of Assessment No . 99, was declared open. There being the hearing was closed.` Resolution No. 2376, was read and on motion of Blois unanimous vote;on roll call. for a hearing on amended Project 49-10. The hearing no one to speak on the matter, confirming amended assessment, and Montrouil, was adopted by Proposal of Lawn Bowling Club A letter was received from the Palo Alto Lawn Bowling Club concerning a proposal to build a more adequate clubhouse and give it to the'City,:and asking permission to discuss questions in regard, to location, construction, and leasing of the building with the Council or a committee. The letter was referred to the City Manager and Committee No. (Councilman Cathcart came at this time, 7:35 2.M., and was present for the rest of the meeting. Sales Tax: A letter was received from the Mayor and City Council of Santa Rosa asking"the City of Palo Alto to join a united effort to obtain t1e active support of the League of California Cities on proposed legislation for equalization and centralized collection of the sales tax. This was referred to Committee --No. 5 Petition for Alley in Block 48, College Terrace A letter: was received from Lorenz Costello, attorney`, submitting a petition for the construction of an alley in Block 48, College Terrace, paraliel.ing College Avenue, between Staunton Court and Yale. Street.. This was referred to the City Manager and. Committee 280 1 Signals, AZra Street and California Avenue A letter was,received:from Mr. Frank A. Crampton criticising the operation of the traffic signals at Alma Street and California Avenue, and pointing out the hazard involved in the stopping of cars on the railroad tracks while waiting for the signals to change. The City Manager and -City Engineer explained the operation _of the signals at this intersection, advising that representatives Of the Pacific Company and the State Highway Department had cooperated with city officials in working out the signal system and had been observing the situation and that minor changes and corrections were being made which should make the operation satisfactory. Bids or. Ground Improvement Plans, City Hall A report was made by the City Manager on the bids received on October 7, 1952, ors; the ground improvement plans for the new City Hall, including landscaping items, plant material, irrigation system, lawns, and other items in accordance with Improvement Plans No. 52-11. :He, recommended that the bid of the low bidder, Huettig, Schramm & Bennett, Inc. of Palo Alto, be accepted, explaining that' items can be accepted under Alternate A and Alternate3'as the 'work proceeds. The total under Alternate A is $28,749,54 and the total under Alternate B is $30,133.51+. On motion of Montrouil and Blois, and by unanimous vote on roll call, the bid of-Huettig„ Schromm & Bennett, Inc. was accepted in accordance With the .recommendation of the City Manager.: Amendments to Health Ordinances The City Managerp:resented`a proposed ordinance amending certain sections of Codified Ordinance No. 5 to provide for changes in the terminology necessitated by the abolition of the city health department. He explained that the words "health officer" and"sanitarian" in these'sections should be changed to `Building Inspector". The proposed ordinance was accepted for first reading. Proposition No., 10 on November Ballot The City Manager presented a bulletin from the League of California Cities concerning the provisions of Proposition No 10 on the general election ballot of November 4, 1952, with the recommendation that the' Council adopt a resolution as suggested b the League opposing the proposition. 'Ori motion` of dickett and Wells, Resolution No. 2377 expressing'' opposition. to Proposition No. 20 was adopted by unanimous vote on roll call., The City Manager was requested to. inform the League of this action. Use Permit A report -was received from the Planning Commission recommending that the application of the Lowrie Paving Company for, a use permit involving their: property on the southwesterly corner. of San Antonio and `Charle'ston Roads, Comprising approximately three acres, be' granted for,use as.a public utility yard for the storage of poles .and other equipment for a period of six months from the date the permit is granted, provided that no permanent structures shall bp erected:and:that upon the expiration of this: permit all equipment and any structures will be removed from the` premises. CC CA `)Q1 Committee No, 1 reported that it concurred in the recommendation of the Planning Commission for granting of this use permit. On motion of Blois and Cashel, the recommendation'was adopted and thepermit granted by unanimous vote on roil call. Final Map:., Resubdivi,sioa of Block 34) Stanford City A report was received from the Planning Commission recommending approval of the tentative map of the resdbdivsion. of.Block. 34, Stanford City. Committee No. 1 also recommended approval provided a utility easement is granted as recommended by'the City gineer. The Council was informed that since the above recommendations were made, the final map of the resubdivision of Block 3k', Stanford City, Tract No. 1075, has been Submitted; that the:final map conforms to the tentative map and provides for dedication of the public utiiity easement as recommended. The planning'Coamission recommended approval of the final .map and further recommended that street trees be planted by the.subdivider'in accordance with the Subdivision Ordinance Committee No. -1 recommended that this final map be approved as submitted. On. motion. of %dontrouil and Hill, the recommendation of, Committee No:., 1 was adopted and Resolution No. 2378 approving the map of Tract No..1075 was passed by unanimous vote on;roll call Tentative Map, Resubdivision of Lot 77, Wooster Sub. A report:was received from the Planning Commission' recommending approval of the tentative neap of the resubdivision af Lot 77, C. M. wooster;Company's Subdivision, located on the southwesterly side of Ross Road 445 feet northwesterly' of Lora Verde Avenue. Committee No. 1 recommended approval of this tentative map, subject to ,the granting of public, utility easements and: a one -foot reserve as noted on the map. On motion of N'ells and Simpson, the recommendation of the committee -was adopted. Redivision of.Lot , Approved A report was received from the Planning Commission recommending approval of the following redivision of lots, subject to the recommendations of the City Engineer as set forth in bulletins accompanying the maps: a. Portion ,of Lot 36, Mayvlew Hornesites. Committee No. 1 concurred in recommending approval. b. Lot 5 and part of Lot 4, Block 113, Crescent Park. ' Committee No. 1 concurred in recommending approval. c. Lots 41 and 42, Block 125, Clara Vista Subdivision. Committee No., 1 recommended 'approval on condition that Assessment Nos. 7..76 and 177 of Series "FF" bonds, Project 46-2, be either paid orsegregated. Part ;of. Block 6, Seale Subdivision No. 5. approval of this redivision on con - No. 99, Series "TT", Project 49-10, be e. Lots 18 and'lg Mayview.Homesites. Committee No. 1 recommended approval' of the .redivision of these lots to provide for the creation of Lot,1 asshown on the plan submitted, provided that the,remajning portion oz the existing Lot 18 is added to:,and made a part of the existing Lot 19, and sub.ect,to the granting of utility easements -and the paring or segregating of Bond Assessment Nos. 919 and 920, Series "RR", Project 51-5. f. Portion of Lot 153, C. M. Wooster Company's Subdivision, Committee No. 1:recommended approval subject to segregation of the bond'asses-sments and the granting of a new 5 -foot utility easement and abandonment of old easement as shown on the map . On motion of Cathcart and Montrouil the above re - divisions were approved in accordance with the recommendations of the Planning Commission and Committee No. 1. Redivision of Lots, Denied A report was submitted by the Planning Commission recommending denial of the application of Chester E. and Anne Maksirn for redivision ofLot 6, Block 2, Seale Subdivision No. located at 981 N. California Avenue. The Commission advised that the proposal is not in conformance with the stated policy of the Planning Commission for the creation of rear lots; the rear lot proposed would have a depth of less than 100 feet and provide an undesirable, building site. The Commission advised that a solution that would meet with their approval appears to possible if the applicants will move the existing garage and slightly reduce the size of the front lot. Committee No. 1 concurred in recommending denial of this application. On motion of Wells and Drysdale, the recommendations were adopted and the application denied. Amendment to Zoning Ordinance '(Home Occupations) A report was received from the Planning Commission recommending the adoption of a'proposed ordinance amending Section 4.36 of the Zoning Ordinance relating to "Home Occupations". Committee No. 1 referred this proposed ordinance to the Council without recommendation,. The proposed ordinance was accepted for first reading and referred back to Committee NO.H1 for further study. Amendment to Bui 3 ding Code (Drivewe s ) 5, would be A report was submitted by Committee No. 1 recommending:. the adoption of an ordinance amending Section 4509 of the Building, Code relating to Width of driveways, to make the regulations for the construction of driveways applicable to residential as well as commercial areas. The proposed ordinance was accepted for first reading. 1 283 Amendment to Zoning Ordinance (Zoninf of San Antonio Area) A report was received from Committee No. l recommending adoption of an ordinance amending Section 3.02 of the Zoning Ordinance to provide for permanent zoning of the San Antonio annexation.area, excepting; from the ordinance and the. Zone Map the property of the BeallGreenhouse Company, leaving this particular area in interim zoning for the present. The proposed ordinance was received for first reading. Design Control A report was received from Committee No. 1 advising that it has reconsidered the application of Howard Ruth,. Jr. for design control.approval of plans for apartment buildings to be built on Alma Street on Lots 2, 3, 4, 5, 6 and 7,Block 2, Stanford City. The committee recommended approval of Mr.°Ruth's application in accordance with the revised plans for -the drive Ways which he has submitted. On motion of Mon,trouil and Simpson, the recommendation of Committee No. 1 was adopted. Purchase .of Well from T.C.Bink1e? A report was received from Committee No. 1 recommending that the City exercise its option to purchase the Suzanne Well and facilities from T. C. Binkley in accordance with agreement of January 224 1951., Committee Na. 4 recornaended that a transfer offunds` in the sump“15,700.,00, ;$,15,700..00, plus overhead expenses of $785.00,' - be made from<the unappropriated balance of the Water Fund to- make the ,purchase of this well, the transfer to be made ;to the capital aceounts.of the Water Division as follows: $ 2,782.50 1,417.50 1,785.00 5,880.00 4,620.00 . $16,485.00 to Account 2324, Land to Account 2325, Buildings to Account 2326, Wells to. Account 2327, Pumping E uipmtnt,,, to Account 2329, Collecting Reservoirs Total It was pointed out that the City will save approximately $12,800.00 annually through ownership and operation of, this well. On motionof Wickett and Drysdale, the recommendations of the committees were adopted and, the transfers authorized; by unanimous vote on roll call. CourtClerk A report was received from Committee No. 4 recommending that the classification of court clerk be established at salar range of $292-365.00.' It was explained that this is a temporary position until January 1, 1953. • On motion of Wickett and Cashel, the recommendation was adopted.
