Home My WebLink AboutRESO 4512... lows: RESOLUTION NO. 4512 ------ RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO FINDING AND DETERMINING THAT THE PUBLIC INTFREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN LA..~D (REGIONAL WASTEWATER TREATMENT WORKS, PROJECT 69-77) The Council of the City of Palo Alto does RESOLVE as fol- SECTION l. The Council of the City of Palo Alto has found and determined, and hereby does find, determine, and declare, that the public interest and necessity require the acquisition by the City of Palo Alto of the real property described in Section 2 hereof for a metering station site, for sanitary sewers and public utility purposes, and for work auxiliary thereto. SECTION 2. The proposed acquisitions are the taking of the fee interest of Parcel II for the metering station site and the taking of an easement in, over, across, and upon Parcel I for sanitar~' sewers and public utilities purposes; both of said ~~ccels of land are more particularly described in Exhibit."A", which is attached hereto and by reference made a part hereof; and said acquisitions are necessary for said purposes. SECTION 3. Said proposed acquisitions and improvements are planned and located in a manner which will be most compatible with the greatest public good and the least private injury, and all of said acquisitions are situate within the boundaries of the County of Santa Clara, State of California. SECTION 4. The Council of the City of Palo Alto hereby declares its intention to acquire said ~arcels of land, as described in said Exhibit "A". -1 - SECTION s. The City Manager is hereby authorized and directed to purchase said parcels of land for such reasonable sums as he may deem appropriate and to cause to be drafted, executed, and delivered on behalf of the City all documents necessary or convenient to accomplish this purpose. SECTION 6. The City Manager is further authorized to spend from general funds of the City heretofore appropriated for such purposes such monies as are necessary and as in his opinion may constitute the fair market value of said parcels of land, based upon appraisals by duly qualified and competent real estate appraisers.
