Palo ;Alto to.` tie; Yield at tl'e hour of 9:00 A .M. on Tuesday, August 19, 1952, in the council chamber at the„City"; Hall, for the purpose of receiving a report from;,Corrmittee No 5 relative to the Police Coot, aCtoun Mayor Mitchell presided and roll call was as follow:':. Present: Bower, Cathcar.t,-Drydale, Gaspar, P 11, Marshall Mitchell,=Montrouii.,, Sltnpson, Wells, Wickett. Cashea, Miller. The Mayor read the fo,l3owing statement to the Council: "In makingT the annual audit, of city accounts, the auditors ;reported; a" ,disc_repancy: in the account of the Police Court.,'Trust Fund, :which required a detailed investigation'. This account:. is -for bail money only and is -the account in'which'bail money is deposited subject to action, by they PoliceCourt .'Tie auditors_ brought this discrepancy to the attention.of the Council -on August 11, 1952. It was disc.ussed:.with'' the: Committee of the Whole that evening and Committee No 5 was asked, to investigate. "It appears, that nr. May 8th 'Judge Doyle drew a counter check against the:Police CourtTrust Fund for which there; was o:: supporting; voucher:., Later two checks drawn by Judge Doyle `on :the Anglo Bank, one on July 17th ;and ;one On: J1.1y 2kth, :were. 'cashed , at the Bank of America and:. charged against this account, after payment had been ,refused, `at the -Anglo; Bank for lack of funds. The total of these three checks amounted to $525.00. "On to cover "The and. Judge July 30th Judge Doyle deposited personal funds the .discrepancy. committee has:;,chocked with the Bank of America, Doyle has -admitted the accuracy of these facts." The:following letter was received from Judge Doyle and"was read by the Mayor: "To the: Honorable:, City Council: "Certain personal "matters have made it necessary for me to make".a change. I therefore tender my resignation as Poliae.:Judge to take effect .immediately. I have greatly enjoyed my service to the people of Palo Alto and hope that I may sometime serve them again." On motion of. Simpson and Wells, the resignation was accepted, 1 The Council then proceeded to of a Police Judge`, to fill the vacancy. and Gaspar :were;; appointed tellers. On the first ballot Edward E. and was declared elected Police Judge ballot for ;the election Councilmen Drysdale _- Hardy received -11 votes 1t was moved,;-, seconded. and carried by unanimous vote on roll Call that, the Controller be, Made responsible for. the operation; and supervision ;of the. Traffic Fines Bureau, -..and that: Judge Hardy t s appointment as Police Judge be on a ` part time basis and hia compensation`be fixed at $500.00 per month. On motion of.
