RESOLUTION NO. 4494
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
DETERMINING, DECLARING AND REQUESTING THAT WITH
RESPECT TO PHASE ONE OF THE PROJECT DESCRIBED IN
THE JOINT APPLICATION OF THE CITIES OF SAN JOSE AND
_ PALO ALTO FOR A MASS TRANSPORTATION DEMONSTRATION
PROGRAM, THE SAN JOSE-PALO ALTO TRANSIT AUTHORITY
BE SUBSTITUTED AS APPLICANT IN PLACE OF THE CITIES
OF SAN JOSE AND PALO ALTO AND THAT SAID AUTHORITY
(SUBJECT TO THE JOINT POWERS AGREEMENT CREATING THE
SAME) ENTER INTO A GRANT AGREEMENT WITH THE FEDERAL
GOVERNMENT WITH RESPECT TO SAID PHASE ONE A..~O RE-
CEIVE THEREUNDER A FEDERAL GRANT FOR SUCH PURPOSE
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PALO ALTO:
WHEREAS, under and pursuant to the Urban Mass Transportation
Act of 1964 (as amended) the City of San Jose and the City of
Palo Alto have filed with the United States Government a joint
application entitled "Application; City of San Jose, California;
City of Palo Alto, California; for Mass Tr'1llsportation Demon-
stration Program Under Urban Mass Transportation Act of 1964"
dated February 22, 1971, revised June 2, 1971, for a grant of
Federal funds with which to carry out a mass transportation
demonstration program described in said application (hereinafter
"Project"); and
WHEREAS, for the purpose of carrying out the Project, the
Cities of San Jose and Palo Alto, acting under and pursuant to
Chapter 5 cf Oivieion 7 of Title l of the Government Code· of
the State of California, have entered into a joint exercise of
powers agreement entitled, "Joint Exercise of Powers Agreement
Between City of San Jose and City of Palo Alto for Mass Trans-
portation Demonstration Program" (hereinafter "Joint Powers
Agreement") whereby a public entity, known as "San Jose-Palo Alto
Transit Authority", separate from both of said cities, has been
created which, subject to the provisions of said joint powers
agreement, has been empowered to apply for an.d receive moneys
from the Federal government for the purpose of carrying out
Phase One of the Project; and

WHEREAS, said cities desire that the federal grant for
Phase one of the Project be 9aid directly to the San Jose-Palo Alto
Transit Authority and that said authority enter into a qrant
agreement with the United States Government for such purposes;
NOW, THEREFORE, this Council determines, declares and
requests that the San Jose--Palo Alto Transit Authority, insofar
as Phase One of the Project is concerned, be substituted in the
place and stead of the cities of San Jose and Palo Alto as the
applicant-in the above-mentioned application, and that said
authority, subject to the provisions of said joint powers agree-
ment, enter into a grant agreement with the United States
Government respecting Phase One of the Project and receive
thereunder a grant of federal moneys for said Phase One.
