RESOLUTION NO. 4453
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
OPPOSING THE INCLUSION OF PALO ALTO WITHIN THE WATER
CHARGE ZONE W2 AND SERVICE AREA ZONE Wl OF THE SANTA
CLARA COUNTY FLOOD CONTROL AND WATER DISTRICT
WHEREAS, the Santa Clara County Flood Control and Water
District proposes to expand Water Charge Zone W2 and Water Service
Area Zone Wl to include portions of the City of Palo Alto for the
purpose of levying ground water charges and service area charges;
and
WHEREAS, the City of Palo Alto has long pumped water by
prescriptive rights from the San Francisquito Creek Cone which
originates principally in San Mateo County with an estimated safe
annual yield of 11,000 acre feet of water; and
WHEREAS, Palo Alto made substantial quantities of San
Francisquito Creek watershed waters available to replenish the
depleted waters of the Santa Clara Valley when it discontinued
major pumping of the underground basin; and
WHEIU::AS, the City of Palo Alto has since 1938 imported San
Francisco water into Santa Clara County to serve residents of the
county: and
WHEREAS, the City of. Palo Alto will not receive benefits
commensurate with the estimated incremental annual cost in excess
of $50,000 to the taxpayers of Palo Alto; and
WHEREAS, the proposed plan does not make provision for
future use of water which may be available from wastewater
renovation and reuse processes.
NOW, THEREFORE BE IT RESOLVED that:
SECTION 1. The Council of the City of Palo Alto requests
that the City be excluded from the proposed expansion of Water

Chart Zone W2 and Water Service Area Zone Wl in order to reflect
the City's unique relationship to the Santa Clara County Flood
Control and Water Diatrict.
SECTION 2. The water management plan for Santa Clara County
make full use of the South Bay Dischargers' Study with ·respect
to wastewater renovation and reuse to replenish depleted under-
ground supplies.
