A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUANT TO THE PALO ALTO MUNICIPAL CODE FOR
THE ACQUISITION AND CONSTRUCTION OF IMPROVEMENTS
WITHOUT PROCEEDINGS UNDER DIVISION 4 OF THE
STREETS AND HIGHWAYS CODE
EMBARCADERO WAY EXTENSION
ASSESSMENT DISTRICT
RESOLVED, by the Council of the City of Palo Alto, California,
WHEREAS, all of the owners of more than 6°' in area of the
property subject to assessment therefor have signed and filed with
the City Clerk of this City a written petition tor undertaking pro-
ceedings pursuant to the Palo Alto Municipal Code and to assess
the costs thereof upon the properties benefited by said improve-
ments, and waiving proceedings under Division 4 or the Streets and
Highways Code for the following acquisitions and improvements,
to wit:
a) The improving of Embarcadero Way from the south-
easterly terminus or the existing improvements
southeasterly about 213 feet by grading and the
construction therein of pavement, curbs, gutter•~
sanitary sewer mains, storm sewers, underground
power system, and street lighting, together with
the acquisition o:t all lands and easements neces-
sary therefor;
b) The aequ1a1tion of all lands and easements and
the construction of all work auxiliary to any of
the above and necessary to complete the same;
WHEREAS, the coats and e.xpenaea of said contemplated acquisi-
tions and improvements are to be chargeable upon an assessment
district, the exterior boundaries of which are the coterminous
exterior boundaries of the composite and consolidated area shown
on the map thereof on file in the office of the City Clerk, to
which reference is hereby made for t'urther particulars;
WHEREAS, the public interest and cor1venience will be served
by the taking of said proceedings;
NOW, THEREFORE, rr IS HEREBY FOUND, DETERMINED and ORDERED,_
that all of the owner• ot more than ~ in area of the property

with the Clerk of this City a written petition for the acquisition
and construction of improvements pursuant to the Palo Alto Muni-
cipal Code without further compliance with the provisions ot Divi-
sion 4 of the Streets and Highways Code •.
IT IS FURTHER FOUNn, DETERMINED and ORDERED,, that said proceed-
ings for the acquisition and construction of ~~!d impr~vements
shall be had pursuant to section 13.12.040 of Chapter 13.12 of
Title 13 of said Municipal Code (analogous to the Municipal Improve-
ment Act of 1913), and the bonds upon the unpaid assessments thereof
shall be issued pursuant to Bond Plan B of said Municipal Code
(analogous to the Improvement Bond Act of 1915).
IT IS FURTHER FOUND, DETERMINED and ORDERED, that the provi-
sions of Division 4 of the Streets and Highways Code be, and they
are hereby dispensed with.
Said project is hereby referred to Wilson, Jones, Morton &
Lynch, Bond Counsel,, pursuant to their letter agreement dated
June 24, 1970.

I hereby certify that the foregoing is a full, true and cor-
rect copy of a resolution duly passed and adopted by the Council
of the City of Palo Alto, California, at a meeting thereof held
on tne 19th day of April , 1971, by the following vote of
the members thereof:
