RESOLUTION NO. 4436
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING ORDINANCE 2585 FOR PROPERTY KNOWN AS 1128 -
1138 OREGON AVENUE AND 2450 WEST BAYSHORE ROAD TO
EXTEND FOR SIXTY DAYS THE TIME FOR BEGINNI~G OF
CONSTRUCTION
WHER'&AS, on November 2, 1970, the Council passed Ordinance
2585 approving the Development Plan and Ti.me Schedule for the
above property and zoned the same P-C (Planned community); and
WHEREAS, the developer desires additional time to seek
federal financing for said development;
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION l. Subsection 1 of Section 3 of Ordinance 2585 is
amended to read:
11 1. Start of construction on or before May 31,
1971."
SECT!~. In all other respects, Ordinance 2585 remains
in full force and effect.

Dear Mr. Glanville:

As provided in your PC ordinance, we hereby respectfully
request a 50-day extension on our proposed commencement· date fo~
construction at Oregon Green. _-
Although we feel the City of _?ala Alto c!id everything in
~ts power to expedite the r~~~oning of the prcpcrty, there have
been con$iderable delays at the FHA level. 'lbe feasibili~y letter
has been received ·and our entire proposal is pow before the FHA
for firm commi~ments. 'lbe ea~liest we oould expect these cornmit-
1qents would be some time in April, at which tj.i!ie we would be ready
to break ground. But, because of the tremendous paperwork delays
at FHA, we would better be on the safe side and request the full
60-day extension. ·

SUBJECT: The Request of the Alpha Land Company for an Extension
of the Time Limit Imposed by the P-C District Develop-
ment Schedule Applying to 2450 West Bayshore Frontage
Road.
Paragraph 1 of Section 3 of Ordinance 2585, being the Develop-
ment Schedule for the starr. of construction of the approved
m1.1lti-family r.esidential development at 2450 West Bayshore
Frontage Road, reads as follows:·
"Start of construction on or before March 31,
1971."
Attached is a copy of a request of Alpha Land Company for a
60-day extension of the required date of start of ~onstruction.
Section 18.68.080 D of the Zoning Ordinance specifies that:
''For good cause shown by the property owner in
writing, prior to the· ~iration of the original
time schedule for the development the planning
commission ~y, without a public hearing~ recom-
mend a change or extension of the time limits
imposed by ·the development schedule."
It is recoumended that the Planning Conmission recommend to the
City Council that paragraph 1 'of Section 3 :of Ordinance 2585,
being the Development Schedule for the start of construction
of the subject development, be changed to read:
"Start of construction on ~r before .May ·30, 1971."

Dear Sir:
It is my understanding that at the Planning Commission me~ting
last night, there was some question raised as to our application
to the Federal Housing Administration for the proposed 235 project
at our Oregon Green development. At the present time, the project
is at the FHA awaiting firm commitments •. 'Ibey are many weeks behi..'1d,

You -should also be aware of the fact that at the present time;
there is no federal funding for FHA 235 projects. Mr. Parenti at
the FHA informed me that they are ~ot even accepting applications
for 235 projects; however, at-such time as f~ds beco~e available,
they will be accepted on a merit basis.
This is.to inform you that prior to our coamencing constriiction
·on the project, we will formally apply to the FHA for the 235 -
units as prescribed in the ord~ce ·permitting our projf;?ct. We
will send a copy of this letter to you along With a copy of any
responses we receive.from the Federal Housing~Adndnistration.
