December 23, 19.57" -The -Council of the'City of Palo Alto met in regular session'on this date at;;7:,30 P.R.; with Mayor Porter presiding: Roll call as - follows Present:`.: Bishop, :Byxbee, Cresap, Davis, Evans Giffin, Marshall, Na:via, Porter, Rodgers. Corcoran,', Mitchell, Ruppenthal, Stephens,, Woodward. The'Minutes of the meeting of December 9, 1957, were approved. Abatement ;of,`Nulsance (48o Cambridge Avenue) This wa.s the `time and place set for a hearing at: which Franklin, E. and Beatrice Clark should show cause why the building at k80 Cambridge Avenue'should not be declared a'public nuisance. On advice:of the City Attorney, the hearing was post- poned to the 'next regular meeting of the Council on January 13,1950. Cancellation of:.Taxes (State .Property) A letter was received from the State Division of High- ways requestingcancellation of taxes on certain property acquired. by the State for freeway purposes, being portion of Lot 5, Block 7, Seale Tract No. 5. It was moved, seconded and carried by unanimous vote. on roll: call, that said ;taxes be cancelled and that this property be removed from the assessment ' rolls. Cancellation of Taxes (Count Flood Control Property) T,he request of -the Santa Clara County Flood Control and Water Conservation District for the cancellation of taxes ''n certain properties acquired for flood control purposes was Aleld over, at request of the City Attorney, for consideration at the next regular Council meeting: on January 13, 1958. Cancellation of Taxes (Church Propertzl A letter was received from the College Avenue Metho- dist Church requesting cancellation of Tax Bill No. 6618 in the amount of $39.20 on 'a lot acquired by the Church in August, 1956 which has been used as parking area for the Church. They advised that the County had granted tax exemption on the lot. A report was submitted by the City Attorney advising that a state law provides that a church is entitled to tax exemp- tion for property usedfor automobile parking if such property was notused for commercial Purposes during the 12 months preceding. application for tax exemption; that, since this property was used for commercial ° purposes prior to August, 1956 and, within the one-year period px'eceding the first, Monday of; March, 1957, it does not qualify for tax exemption, and the City Attorney recommended the applica- tion ;be denied. A motion was -::made by Cresap, seconded by Navis, that the application be denied:.. In answer to questions by council mem- bers,, the City Attorney explained the:provisions of the law and.: stated that he did not know on what basis the County granted the ;exemption, that -the 'law is specific and the property does not qualify for -tax exemption for: the current'` year. 'Baer until. the December 23rd :Council meeting, at which time Mr.:Baer or his =repres-entative was to present any further plans for development of -the. property, A request was .received `from Mr. Baer that the matter be held over as he eras unable` to attend this meeting. on motion of Byxbee and Giffin, the . matter was deferred to some latter date to ' give Mr. Baer an opportunity to confer with. the Planning 'Officer and review: t ie':entire question. Claims for Damages';, A report was received from the City Attorney on the claim filed by Mrs :Margaret ` D., Bryskl in the suer of $2750.00 for injuries sustained when:she•alipped sand fell on the floor et the entrance. to the Building Departmentin the City Hall. The CityAttorney reporte ' ; Id that. -,he .had investigated the matter and in his opinion there is a possibility of. liability on the part of the City; that he'.had`nego- tiated'a settlement'with Mrs. Bryski's attorney' in thesum of $500.O�b . whichhe considered- reasonable, and he therefore recommended that this sum be'paid to Nrz Bryski in full settlement of all claims against the City' arising from this accident. Qn motion of:Creaap--and Navis, the City Attorney's recom- mendation was`adopted and settlement of the case in -the sum of $500.00,xas' authorized,. by unanimous vote on: roll cull. A report' was also received from. the City Attorney on the claim filed `by Fred F. Sutter in the sum of $3,000.00 fora damages auffered,/by. reason of alleged false arrest. The City Attorney ad-. • viaed`;that the. law. iswell established that a municipality is immune from liability for;dauages for malicious prosecution and false arrest; an'd.herecommended the claim be denied. On motionof-.Byxbee and Cresap, the City Attorney's report was accepted and the claim. denied . ' Hospital Rates for Recovery Room -A, letter was received from the Director of the Palo Alto Hospital'tranemitting a recommendation of the Board of Hospital Directors of.':the.•Palo'Alto-Stanford Hospital that a rate of $2.50 per hour, or fraction" -thereof, be charged for use of the post-anes- thet.ic recovery room noon to be placed in service at the Palo Alto Hospital.. On motion -of Byxbee:and Ruppentha.l, the rate of $2:50 per. hour or ;fraction thereof for` us'e of the recovery room was approved. Meeting with Planning Commission Councilman Byxbee stated that he has noted with a great deal�of interest that the Planning Commission proposes to hold some meetings after the first of.the year to consider land use patterns ; and <make planning studies of subjects and projects desirable for the future development of the City. He suggested that it might be ad- visable for the Council, at the outset of these studies,. to invite -- the Planning Corssmiasion to a meeting with the Council, perhaps a dinner meeting, 'to" diecuas plans and review in general the object- ives_for land use in this city and give the Commission some guidance? in' their Studies ; The lgaigor said he :would make arrangements for such a meeting.
