The Council of :the City of Palo Alto met in regular
session on this date. at 7:30 ;P.M., with Mayor Porter presiding.
,Roll call as follows:
Present: Bishop, Byxbee, Cresap, DAvis, Evans, Giffin,.

The minutes of the meeting of October 28, 1957, were
This was the time And place set for hearingof objections
to the proposed destruction or removal of weeds. The hearing was
declared open.: ; There, being, noone present who wished to ‘ speak on.
the matter, the hearing was closed.
Resolution. -No. 2922;, ordering weed nuisance; abated, was
introduced, and on motion of Ruppenthal and Bishop, was adopted by
unanimous vote on roll call'.
The ::City Attorney advised that the contract with John C.
Throckmorton,:Jr., doing business A3 the Nu. -Lawn Chemical Company,
for the Abatement of weeds provides that billing shall be on the
basis of gallonsg a of chemicals used, and it has been recommended
that an amendment:, be made to the contract to provide- for billing to
be on the basisof the square foot area of the lots that are sprayed.
It was moved' by Mitchell, seconded And carried by unainimous
vote on roll call, that. the Mayor be authorized to execute an amend-
ment to Mr. > Throckmorton's contract as recommended.
(Councilwoman Corcoran came at this time, 7:35 Y.M.
and was present for part of the meeting.}
Cancellation` of.'Taxes
Communications were -received requesting cancellation of
taxes on the -following. properties acquired for public use:

A report was made by the City Manager on the bids received
on November 8, ;1957, for Project 56-24 for the construction of a
concrete bridge : over Drys -Creek at Park Boulevard and:. adjoining street;
improvements, with therecommendation that the low bid of Howard R.
Bru in the amount "of $14,500.00 be accepted.

Audit
A report -was • received from Committee No. 3-, recommending
aacceptance of;the report of Skinner & Hammond on their audit of the
city accounts —and records for the fiscal year ending 'June 30, 1957•
On •;motion: of Bishop and' Byxbee, this audit report was` accepted by
unanimous vote- "on roll call
A report was also received from Committee No. 3 recommend-
ing acceptance ofthe proposal of Skinner & Hammond for the Audit
for the year ending June 30, 1958, for a total fee of $3,600.00,
which is the same;: fee as paid for last year's audit;, '.On motion of
Bishop andMitchell, the recommendation was adopted and the proposal,
of Skinner & :Hammond was accepted
Plans for Newell Road Frontage Improvement
A report -was submitted by Committee No. 3 recommending that
the plans prepared by Eckbo, Royston and Williams for the improve-
ment- of "the Newell Road frontage opposite the City Hall be Accepted„
And that the City Manager be, authorized to call for bids for this
work.
After a review of the plans, it was moved by Bishop,
seconded by Byxbee,:And carried that the recommendation of the
committee be adopted and .that bids on the work be taken.
Civic- Center= Sete'. Plan
A report was received from Committee No. 3 recommending
that the Civic Center site plan as submitted by Eckbo, Royston and
Williams be be accepted in -principle. It was explained that the plan
as submitted includes the landscaping for the new main library now
under construction, and schematic drawings for landscaping, parking
Areas and other features of a suggested development tom: provide a
coordinated program for the entire city hall area. The City Manager
advised ` that Committee. No 3 liked the plans and had recommended
that they be accepted ,in principle, with the understanding' that the
architect would .consider ideas and suggestions discussed at the
meetings -and work further with the staff on details of the plan which
would' be -submitted' for final approval later.
It was ' also reporte'd to the Council that the committee felt
that :`landscaping plans: for the Library should be acted on; separately,
and":that the proposed peripheral road should be constructed in con-'
nection with the Libr,.arysite development. The City Manager -'advised
that the detailed Library site plans are not yet complete: and it
was intended to bring`them up at a later meeting for approval.
Mrs., Corcoran: Asked why the plans had been referred to
Committee No 3;. stating she. felt it would have been logical to
have them considered by; Committee No..2 which normally. reviews
library matters, Councilman Ruppent-a1 suggested that,the wording
of, the committee's recommenda=tion be changed to read that the plans
be 'accepted for'=turther'_'study.
Mr. Allan :Reid, a landscape architect, addressed the
Council at this tiiieArging that the Council not adopt at..this
meeting the recdsaMandmtion of Committee No. 3 for acceptance of the
plan in .principle . He said, he 'felt that such actiorn,at this= time
would be without:: due __considera=tion of- all the factors involved ' that
the : plan wou Ld ;bps ' expensive ' to accomplish and would not provide
future, needs :for -"a Livia .Center site; that a' better. solution is
possible, -end: he urged ' the- Council ; toreject the: proposal, to adhere
to a procedure- recently-�adonted` .in .principle by Committee No.. 3 for
hiring professional help, and,"'further urged .that no large expends-
tux a ;, be made -or policy be determined,, that will . jeopardize the use

second reading, and after discussion and. on motion of Mitchell and
Iiahop, was adopted:by unanimous vote_of all council members present.

Pronerty. Acquisition

.tanford City, located °on .the 'northerlyside of Loma Verde Avenue at
he corner of Emerson ,Street, in. 'an amount not in excess of 10% over

It was moved by Bi.shop, seconded by Mitchell, that the

The Assistant City Manager advised that the property is
being considered as a slte;_on which to relocate apartment buildings
which have to be: moved frol the right of way of the _grade separa
tion project; that it would accommodate ten units, i nd .is now zoned
R -3-G, that: a rezoning to' R-3 or.>R-3 .D which is the zoning,. of ad-
jacent property. would be necessary in order to relocate the' build-
ings on the -site. The Council was informed that the bidding will::
take place on November 21,-1957 instead of.November '15th;' gs: pre
v'iously stated in the meeting of Committee No 3.
The Planning --Officer was asked to comment .on.the matterof
rezoning:the'property in ,question, and stated that it seemed logi-
cal to :ave_;:R-3 zoning at that particular location

Zone. Change Anplic'>a-tion (Lasing)
A report-was.received from the Planning Commission unani-
mously recornmendi.ng the'.denial of the ,application for a zone change
submitted 'oy Paul La-ning-for the property located on the southwest
- corner of : Sin ;Antonio :and Middlefield Roads from L-M:S :D to . C-2- :5,
the Commission.recommendi:ng that the present zoning pattern be
retained..
Mr. Arthur: Cathcart`, attorney representing the applicant,
asked that the matter be deferred to the regular meeting of Decem-
ber 23,_ 1957, so that . P -C zoning may be considered. Or, motion of
Rodgers: and ' Ma.rsha]:1, the matter was continued to the Council
meeting 0±' December 23, 1957, and the question was referred back to
the Planning Commisaion,;.with the suggestion that if necessary it be
studied by Committee -No. 1.;:
Zone Change Application (De Franco)
A report was received from the Planning Commission recom-
mending denial of the application of S. J. and Elise De Franco and
John B. and Wilma K.'De Franco, as submitted, for change of district;
of the property located,on the southerly corner of High Street and .
Hawthorne Avenue, from -R-4 to C -3-:S, with the information that this;
action: was taken by,a vote of 4 Ayes and 2 Noes.
It was moved by :Mitchell and seconded that the recommenda-
tion of the Planning Commission be adopted and the zone change
application be denied`.-.-`
Mr.. John De Franco. addressed the Council in support of the
application, showing picturesof the property and presenting a.
petition from property owners in the area approving the change of
zone as requested:. He pointed out that half the property is in the
C-3 district: and half in the R-4 zone,• that the portion: of the
:-building in the R-4 district is:occupied by a non-conforming,uae at
the. -present time, And. if the building should be destroyed it could
not be. replaced.
The Planning Officer explained the views .af the Planning
Commission on the. matter, stating that the applicant can continue
the non=conforminguse and the" Commissiole felt no hardship''is: in
- v.olved at :. the -;;present time; that if, the building were destroyed it
wouldbe possible �td, use:the property in a reasonable manner, end_:
e 'variance could be `considered = if necessary for the proper use of
the property,

A report was received:from the Planning Commission recome
mending: approval of the application' for design control as sub-
matted by Neal Lindstrom; Architect, for Dr. Nathanie3 Handy, for
a medical building 'to be Iodated at`k50 San Antonio Road.
On motion of" Mitchell and Byxbee, the appiicetio:i WAS
Approved as recommended "by the Plenni.ng Commission.
Lot Diviiior (Paul Hardy)
A report -:was submitted by the Planning Commission recommend-
ing -that -the denial by _ the Planning "Officer of the application of
Paul H, Hardy fore a- division:. of portion of Rancho Rincon de S,en.
Francisquito,:located on: El Camino Way north of James Avenue, other-
wise known as k,29 EI Camino' Way,` be upheld.
Tar Hardy spoke in support'of,his application, advising that
he :has an opportunity to sell the;30-foot parcel facing on. El Camino
-Way, and that he hasees'sements providing: adequate access to the rear
parcel on;which his. office buiiding ee located.
The PThnning Officer reviewed ;the matter, showing a map; of
the .property involved, and advised that the Planning Commission felt
that there should be :ac'cess to the rear parcel from El Cemino,:Way. -
He ,cA11ed attention`: to the. -fact ..that at one time consideration..hed
been:_. given to :the:; dedication of a; street, to beknown as Ve lmonte
Wey, adjacent -to .Mr' Hardy's property but that the street was never
-dedicated
Mr. `'Hardy stated that he feels the Planning Commission did
not realize that he has adequate access to the rear portion of his
property when they recommended denial of his application.
A motion was made byByxbee, seconded by Rodgers, that the
lot division :be granted as requested by .Mr. Hardy, subject to tie
,Engineering Bulletin. Other .council `'members felt that if there 1s:
a misunderstanding on the part of the Plannlng Commission, the
matter should be sent back to the Commission for reconsideration.
It was moved; by Mitchell;' seconded by Marshall, and carried:
that the question be -referred -back to the Planning Commission.

A report was received -from the Planning Commission recommend=-
ing that the, approval by the Planning: Officer of the application. -of

division,:, on.'R oss Road near. Mat.adero Creek, be upheld, subject to
the following conditions as set forth by the Fire Chief and Planning
