The. =minute's of the meeting of September 23: Abatement of .Nuisance (Building at 620 Lincoln Ave. ) This, was the time and place set for Mr. and Mrs Join M. Dower to show cause,, -if:any:they have,. why the building; a“,20 Lincoln Avenue,should:not be -condemned as a public nuisance and said nuisance abated •by _ reconstructing or properly . repairing; s aid . building or by razing 'or removing it. The Council wasp informed, that proper. notices have been posted on the property And mailed to the I owner of the property as;,required by law. A report: was made.:: -by the Building Inspector:on the, condi-i tion :of the bulldixg He.advised that the building has been vacant since ..1955; that it .is 55:years old and is in violation. of the Bui)d1ngCode, that'• it is considered to. be a hazard to safety and health:, "and. is1n:euch`a state of disrepair that the Building Departt ment:recommends complete, rehabilitation or demolition.' The hearing was declared open. As neither the. owners nor their representatives were'present the hearing was declared closed., The:C.ouncilwas informed that it may either -adopt a j resolution declaring the:: property. to be a nuisance and. directing the°=-own:er toy.abate: the same within thirty days after the date of postinga notice on the premises, or adopt a zesolution ghat said property is not a nuisance: .The CityAttorney advised that representatives of the Building Department ha'd discussed the matter with Firs-. Dower in May, and' -She indicated at: that time that she would be, willing:' for the City'to demolish thebuilding and she would pay the cost; that she no14 -lives in' New :York, 'a:nd that a notice of this hearing was sent to her : but ,she rigs "not 'replied . Abandonment of: -Easement, This was.�the time and place fora hearing on the proposed: abandonment,of a public utilities easement over portions of.Biock.3,; Trpet No:.: 1556, Royal Manor. An affidavit of the publication --o; the: .notice of this -hearing .has been filed. The:. City Manager: explained that the easement had. been dedicated in a`subdivisi:on which was never completed, that the property has been. acquired by another developer, and his plans for the development -of ,:theproperty do not conform to the original plans, so. that: this particular easement 1s no longer needed for the purposei for =whl ch i:t was dedicated ., Tne:hearing.wasdeclared open. There being; no one present who wished to speak on tre matter, the hearing was closed. Resolution No-. 2913, ordering the abandonment of said easement, was introduced, and on motion of Bishop and DAvis, was Adopted by unanimous vote on roll Gail. Library-Prograr - Downtown Library Facilities. - - A'report was submittedbythe City Manager on Library facilities in the downtown' Palo Alto area. The City Manager advised that the purpose Hof his:'report. was to supply factual infortation regarding library facilities 1n the downtown area in order to assist;.. the". -City Council in establishing a policy to be: followed in providing these facilities, and _that every effort has been made to insure that only„information: factual in .nature is' -included in the report; that other issues suchas conversion of the existing main library build- ing to:a senior citizens' facility and other suggested uses for the building, which have been brought.to-the Council's attention since the preparation -of this -report Was started have not been evaluated in .the study.::.:', "The,City',:Manager pointed' out that the staff has been instructed by Committee'No. 2 to prepare and submit a detailed re- port. on parks And.recreaation,.and this report will cover senior citizens' needs The_.report presented by the:City Manager included a= - summary;of`an'i'nvestigation and inspection of the existing main library building=;to determine what modifications and improvements would be required to permit the continued use of the building as A public library in compliance with the Building Code; cost estimates - to correct building:code deficiencies; a report on the structural condition of the :building;, and.figures on the amount of floor area available for: public;: purposes, showing that only approximately 8,000 square feet could -be, utilized.:` In the summary of conclusions, the City Ma ger 'advised that : in order_ to- sake the present building` ser - v-iceable in oonforma-nce'with code regulations, it would cost an'- sstimated-'$52-,000. to $71,000; that it has been concluded that the benefits to Abe gained donot justify,_the substantial expenditures required, and to continue to-, maintain e present main, library build-::- ing- as a public facility would_ be incompatible with the high _standards sand objectives which have been established and pursued by the City - Counc-il in recent yeA,rs .' The report included..�alternatives for downtown branch iibrary,service when the new main library is completed, with the - recommendation that a .-new 4,000',sauare :foot branch library be con structed-on the city -owned property', opposite Cogswell Plaza,, at the corner of Bryant $treet and Lytton Avenue, and with a suggested plan for financing. the program as outlined in Alternative No. 5., _Attached to the report; were exhibits and data used in -the .study :.and submitted for the Counci:l'sreview. There was also pre:- sented by' the' City `Nalnager information_ on comparative library statis- tics of California cities in the; -population range of 25,000 to 100;,000. Sketches were shown o.f_,,the city -owned site at Bryant and Lytton on which" it was recommended",a, branch. library And parking area of 20 spaces be:;,constructed-,. and= of ,suggested developments for the city-ownedblock in_ which. the existing main library is located. Mr.- Frederic J. `Perry, .Chairman of the Committee for;a Downtown, Cau?tural: Center, .addressed- the Council at this time, . pre:- seating petitions which he stated contained 2306, signatures, urging preservation of- the- present main library building when the nevi; maim library -is complete - -- ---- -,y the _ .for filing - 'Mr. Perry stated that the petitioners Teel the building. can be remodeled for library purposes and for a cultural and.senior recreation center, and presented"a copypt a report on a structural. survey of_the building by John B. -:Rutherford,, structural engineer,; and: _a report by" Robert M.; Kennedy, engineer, on estimated cost • of : ` making_ certain: repairs to correct major defects in the building. Mrs. Marion M. Thomas, President of the Woman's Club of _Palo Alto; presented a letter urging the retention ;of:the library building. Mr. Edward B. Gregg, President of the Civic League of P•»,lo .Alto,.: also spoke in support of ;retaining the present main library building as.`_.a branch; library and a cultural center. He commendeC the City Manager and'stafS for their report. Mr. ;Robert E,. H�ick.ley, Speaking for the Palo Alto Citizerrs' Association, suggested that,: -in view of the information,erd facts. presented by theCity Manager in his report, this.misterial be made 1 s�vail:able for, study before any action is taken,.and`.asked-that the Council's decision be deferred to a later ,meeting after peddle have had an opportunity to consider the material presented, by the City ,Manager. A motion was made by Cresap, seconded by -Mitchell, that action be deferred and that the matter be referred to Committee The Mayor _pointed out that it will be some time before the new main library is completed and ready for operation, so< that there'is'plenty of timeto make a study and decision on the. existing; bui lding . (CounciimanRuppenthal came at this time,,3.:.35 ?.M., and: was present for the- rest of the meeting.) After -more discussion and comments, the motion to defer action and refer; the entire tatter to Committee No. -2NATO carried. Cancellation of Taxes on State Property A letter was._. received from the State Division of High- ways re9uesting:eancellatiot of taxes on property acquired by the, Stage forhi hway purpos,es,,being portion of Lot 38, Biock 361, Tract`No. 596, Sierra ,Tract, On motion of Rodgers and Byxbee, it was directed that taxes on said:property b:e cancelled and that the property be re- moved'fromthe assessment rolls. Fence at. Faireeurt .No >4(Royal Manor, Tract 1556) A letter was received from Eichler Homes, Inc..,.reques:t-- ing permissiont:o substitute a. wood screen fence along-; Sterling Canal end Dry 'C..reek `in place : of the chain link fence required. as a Bond ;tion of app'roval o_ 1' the final map of Tract No. 1556, Royal Manor; in July, 1955. (Thia'tract has recently been acquired by Eichler Homes,:Inc. and renamed Fwircourt No. 4). Request of School Board for Amendment to Ordinances re height of Fences and Shrubs A. °letter was received from the Board of Education of the Palo Alto Unified -School District requesting modification of Section 32.13 of Codified Ordinance'No. 5 pertaining to-the'height of shrubs near street corners and Section 1506 of the Building Code regarding height of fences, to include situations such a.s exist at the entrance to -the Wilbur Junior High School on East Meadow Drive ' opposlte the' -end :of Waverley- Street, t,ocorrect a traffic hazard: ptaused by a. six-foot fence along Bast_ Meadow Drive and the school entrance on the property line of a lot'-adiacent to the school ,property. .. ThiS matter wasp referred, to the City Attorney. n'all Boat Launching Facilities .A: communication was received from Mr. John V. Gardner concerning the.need-:for launching facilities for small outboard . motor; boats at the Palo Alto Yacht. Harbor. The City Manager reported that he had sent a letter ,to`. Mr. G^rdner .advising.,:h1m tr_at::the City has.been'interested for some time in providing such faacili.tis and that the staff has been author- ized.to submit a report:on recoinended improvements st the Yacht Harbor, and that :one. of the `fea.i:ures to be included in the plan will be •;launching facilities. It was directed that ---Mr. Gardner's letter be filed. Ca 15Lrornia ' C:it1'es Employee Safety Contest A letter was received from the State Compensation Insurance Fund congratulati'ng•the City'-on:the excellent record for accident prevention which:,Palo Alto has established in the first California Cities Employee' Safety Contest, Palo Alto having been awarded second plaaee among cities in Group IV (300 to 600 employees). Annexations to Mountain View and Los Altos Notices_werre received from the County Boundary Commission of the following proposed- annexations: NSan Antonio No. 8 to the. City of Mountain View Stierlin No. 9 to the City of Mountain View 3) Terra BelIag No. 2 to the City of Mountain View k) Magdeleni Annexation No. 2 to the City of Los Altos The notices were placed`an file. Utilities Agreement with Division of Highways Relocation of -Water Main on tayshore Hi7hwa The: City Managerpresented a, Utilities Agreement with the State Division of Highways"covering cost of relocating a 6 -inch water .main,' estimated to cost 0,000.for which the State has assumed 50% liability. It was explained that the relocation of this water: I main' which provides service: --to' the Bayshore-Embarcadero annexation areawas necessary. in connection with construction of the Bayshore : Freewa y . On Motion of Mitchell and Byxbee, and by unanimous vote or. roll -call, a resolution approving the agreement and authorizing: its execution by the Mayor, Was adopted Leases with Stanford University Fire Station Site .and. Sub -station Site 'Leases -with Stanford University covering a fire station site and a sub -station site:on`Stanford lands were presented. The City Manager called a"tten,ti.on.to the previous decision of the Council to lease parcels for these purposes,instead of acquiring them On motion of .Byxbee. and; - Marshall, the Mayor was authorized to -`sign these leases in behalf of the City by unanimous vote on roll Ca l l . Agreement with'Southern Pacific Co. -Storm. Sewer ;Easement 0000site Chestnut Street A 4 The City dana..$er presented an agreement with the Southern Pacific Comprny-covering a storm sewer easement under the railroad opposite Chestnut Street, to permit the City to install -n Z2=Snchpipe in the open ditch to eliminate the need for ditch maintenance: It was moved.by Byxbee, seconded and carried by. unanimous: vote : on 'rOil gall that a resolution authorizing the Mayor to sign this -agreement in behalf of the City be adopted. Lease Of,,'Girl Scout louse The City Manager submitted a proposed lease with the Palo Alto Girl. Scout Council, Inc. covering the premises occupied by the . Girl Scout House, in` Rinconada Park, for a. ten-year period commencing September - 1, 1.957. A;resolution-approving the lease and authorizing its execution by the. Mayor in,.behRlf of the City was introduced,and on motion of Bishop and-Byxbee, was adopted by unanimous vote on roll cal.l..p Pro'lectt52aa Fablan Way et al, Engireering Services The'C"ity Manager advised that it is in order for the Council to enter into a contract for the engineering services for Project 57-11,` Fabian Way et:al; that George S. Nolte had done preliminary work for t -he owners when the project WRS started on a vol:untarit basis, and' that' it; would be appropriate to continue hir services:-014that en asaess,ment district has been set up to expedite the ' pro.;j'eot .On motion of Rodgers and Byxbee, and by unanimous vote on roll,c.all, the 'Council approved a contract with George S. Nolte for engineering services' for Project 57-11 and Ruthorized' the Mayor to sign the contract _in` behalf of the City. Speed Limit ;on willow Road A ement to See-..19a51.7 •A recommendation was made by the City Manager for an` amendment to. Section 19.1"51'of Codified Ordinance No. 5,to establish a prima. facie. speed.limit._on,willow Road of 35 miles per hour from j Arboretum Road: to* point 300' feet west of Pasteur Drive, and, a 'limit _of 45 ,miles per hour from that point to the westerly city°,1'im1ts. A proposed,,ordinance amending Section 19.1.51 of Codified Ordinance No. 5;affecting speed limits on Willow Road was accepted for first reading: Parking Regulations in Block 19 -The City` Manager presented a recommendation from the staff: for the establishment ,of parking regulations in the parking lot -in Block 19 (the block bounded by Lytton, Everett, Bryant and Waverley);to.provide for'tenhour meters, at rate of 5 cents for twa hours or;25 cents -for ten hours. Elite Tree Service of Oakland in the amount of $5,640.37 be accepted, He pointed out that $4,000.00 was budgeted for this purpose and re- commended that $1640.37 be transferred .:from the Special Projects Fund to :provide the , additional funds needed for this tree removal :. program. He recommended that a. refund - 0f -approximately $6,000.00, which is:. S� f' the cost of an equivalent overhead system, be made to Stan-- ford .University in accordarce with the rules and regulations just adopted.
