on this date at 7.:30 Pali,: with: Mayor Porter presiding. Roll call ash

The minutes of the meeting of June 24, 1957, were approved':.
Election of Mayor'
The Council proceeded toba,l:lot for the election of a
Mayor for the fiscal yeer 1957 58. Tire .Mayor announced that it has •
been customary for the Council tovote for mayors and vice mayors
by secret.baliot, 8 votes :being regUiyed for election. Councilmen
Byxbee and Rodgers were appointed't'ellers.
On, the first ballot;: Mr.:Porter received 13 votes and Mr.
Keithley one .vote Mr. Porter:; -having received a majority of the
votes was declared re -e ected`layor for 1957-58.
Election of Vice Mayor_.
The Council then proceeded to cast ballots for the office
of. Vice Mayor for the fiscal year 1957-58'•
- On the first ballot Mr. Bishop received 7 votes, Mr.
Marshall 6 votes,. and Mr. Byxbee one vote.
(Councilman Davis arrived at this time, 7:40 P.M.
and was present for part of the meeting.)
The second ballot resulted;:in 9 votes for Mr. Marshall:
and 6 votes for Mr. Bishop, and Mr.: Marshall was declared re-elected;.

Zone Change Application .(Eichler .Hotnesl
A report was received from ,the 'P? anning Commission recom-
mending denial of the: application Of:Eichler Homes, Inc. fora change
of district for property." located on Charleston Road between Middle--
field.,and Louis Roads, being a portion of Rancho Rincon de San
Francisquito,' :approximately 8.50 acres, from R -1:B-8 to P -C, Planned
Community District. The,Commissionpo.inted out in its report that
it' was requested by, the >Council, sometime ago to set up larger lot.
sizes for residential -development, ands:this is an 8,000 sq. ft. lot
. minimum area,,; "that;;2t 3,s: one _of the few large areas left for -home
development ' in Palo -Alto that some months ago the Commission made
- a;polic,y statement regarding -the land on Middlefield Road, in which
the Commission went, on record:as upholding the .General Plan and.
keeping the .area R"-1; `a.nd tha"t there is_ still, vacant land available
and zoned for apartments: elsewhere in : the City,
A petit .on wars" fi)ed, from property owners and residents of
Meadow Park -and Charleston Gardens protesting any zone change and
asking the Council to upholdthe recommendation of the Planning
Commission_ ';for denial of ,the application. A letter was received
from'Joseph L. Eichler concerning_ the;:need for apartments and the,'
plans for the proposed. development, and: requesting that the utter
be referred to a committee for"further study before Council action -`
is taken..
On motion. Of. Byxbee and Navis, the matter was referred t.o
Committee No. '1. By a show of hands there were 8 Ayes on to motion
and.5 Noes.

.that the committee would meet for an informal hearing on this zone
change application -on Monday, July 15, 1957, at 7:30 P.M.

This was the:time set fora hearing on the Resolution of
,Intention for acquisitions a:nd improvements, and on changes and
modifications to provide for ten --year bonds instead" of 15 -year bonds
Before the hearing' was opened, the City Engineer:reviewed
the project and explained the proposed work and improvements. He `
;advised that 'each property:owner in'tre assessment district was
notified by -letter of the.p.roposed improvements affecting` his prop-
'f'erty grid t_he estimate o4' Z.is assessrent. He stated ` that he and. the
attorney on the proceedings,; met with property ownerg;- last week at
the,>Ventura:School and:explained the project to them'in detail and
answer•ed,questions. it was'; noted that there ar•e 825 parcels in the
' tota 1, assessment district

bounded by Charleston: Road, Adobe Creek, Wilkie Way and Francisco
Way be excluded from the assessment district. Reference was also
made to a letter received from John H. Rickey in March°, 1957,:askin
that sidewglks be eliminated;, along hia property on the south side o

Mrs.""George Kohler, 27-0Wc Meadow ;give, corner of Second
Street, expressed concern over the fact that when West Meadow:: Drive
is improved, -children and other pedestrians w111 be forced to walk
in the t:raf. fit:lanes:, when crossing -the railroad as the railroad
crossing will. be narrower. than the street. -She was informed that.s soon aswthe street is' improved- the'rallroad company will beasked
to widen the crossing.
Mrs. Kohler also called attention -to the traffic hazards
at :the intersection of Alma Street and :East'. Meadow Drive. The, :City
Manager advised' that traffic- signals a. re. to ; be installed at that
intersection,." probably within the next few months. Mrs. Kohler asked
if four-way stop signs could. be Installed in the meantime. The Mayor
asked the Staff.•Traffic Committee to consider the mater.
Wayne Ka:nemoto, attorney representing. Hideo and Kiyomi
Yamashita, :owners of:a 5 -acre parcel of land southerly of West Meadow
Drive, spoke in protest to the assessment on the basis that they
could see no immediate benefits to their property from the improve--
mentS
W.i1liam-E Anderson, attorney for John H. Rickey, told. the
Council that'Rickey's do net protest -the improvements but offered the
suggestion that;".sidewalks be eliminated on Wilkie Way which would
reduce:,the assessments He advised that Rickey's could see no neces-
sity for sidewalks,." along their property"as there is no access on that
side Of the street.
Mr. Anderson also suggested that the cost of Wilkie Way
improvements be spread to.include a parcel of land at the end of
Wilkie. Way which would. receive some, benefit from the improvement..
Kenneth Tones, attorney on":these"proceedings, advised that the parcel
in" question was not assessed for the reason that it has no frontage
on WilkieWay; however it is possible to use Wilkie ;lay as an access
road when the: property is developed and there is sound argument for
ineluding the' property in the assessment district.
Mrs. C, F. S?.eeha.n, 385Whitcl'em Drive, stated that the'
majority of the people in the :area bounded by Charleston Road, Adcbe
Creek, Wilkie Wa,y and Francisco Way,..do not want any of the improve
ments proposed;- they prefer the rural atmosphere and are particularly
opposed to sidewalks.
.7errold Englespoke in favor of the project and the importance
of maintaining the same standards throughout the city.
Lewis D ha ll," 451 ,Carolina Lane, speaking in behalf of the
harleston .Meadows Hone, Owners Association, reported that a vote was
taken -of their membership at a recent meeting and amajority voted'in;
favor of eliminating sidewalks in the hole area. Mrs. L. P. Bonander,
291 Wilkie Way,.obJected to sidewalks.for the reason that trees would"w
aye to be removed :if walks are put in.

f the people are,in favor of sidewalks.l they feel it is safer far -
he children to have sidewalks Mr. Anderson remarked that Mr. Rickey
as no objection tothe'sidewalks if people' in the area want them:

At. this time the,Cty Manager.- reported on the bids received

gineer's estimate.

Resolution•No.. 2872,_ordering redistribution of assessmen
to: include the parcel of property' situated at the southeasterly end
of Wilkie Way on, the basis of 135. feet of frontage, was introduced,:
and on ' motion of Rodgers and Davis,was adopted on roll ca11,, with.
13 Ayes, r,vans en&Stephens not voting on the motion.
A motion was made by Mrs Corcoran, seconded by Ruppenth,o
that all s :dewalks :be eliminated' from the area bounded by: the
Southern Pacific F.ailroad, .West Meadow, Drive, AdobeCreek,: and El
C^mino,_ :wi-th_ the -deception of West. Meadow Drive, Charleston Road,
El Cam,inoWay and Francisco Way. The City Manager advised that no
improvement, is Contemplated at this time on West Charleston Road
and ElCamino Way,• :that'El> Camino Way would be handled as a separat
project later in connection with El Camino Real.
After discussion', the vote by roll call on the motion to
eliminate sidewalks from the area described was as follows.,.:
Ayes; Corcoran, Giffin, Ruppentha 1 , Stephens
-Noes: Bishop, Byxbee, Cresol', Davis, Marshall, Mitchell,
Navis, Porter, Rodgers, Woodward.

The motion was declared lost.
Resolution'No.`2873 overruling protests on,Resolution of
Intention ,No. 2853 was introduced, and on motion of ; Byxbee and
Mitchell; was adopted by unanimous vote on roll call:.
::After disc.tssing.a proposed resolution to modify the
project to provide fo•`ten-year bonds instead of 13 -year bonds,
it was ;moved by Mitchell, seconded and carried that no action be
taken,on the resolution..
On advice of -the attorney, action on a Resol:;ztion:orderi
reduction `cif assessments was deferred to the next meeting, -since it
was impossible to determine the exact amount at this, time:,

Confirming: the , Assessment, and Ordering the Work and, Acquisitions,
was introduced; and on motion of Mitchell and Bishop, was adopted

Resolution No. 2875 awarding contract for the work. to

Resolution --No, 2876, designating the Commercial Officer
of the City of Palo Alto as the Collection Officer for the project
was introduced:, and on .motion of Mitchell and Bishop, was- adopted

Resolution No: 2877, determining that the public interest
and necessity_"reo:uire the acquisition of easements for>;s;treets :and
the -taxing of -immediate possession thereof, and. directing, the filing

Councilman.Bishop referred to the problem of-safety:at
Alma Street and East Meadow Drive, as mentioned during the hearing
just ,held,:and moved that the oUeation be referred to Ccrnmi:ttee_
No; 2::for consideration.. The City Manager advised that the. Staff.
recommends that four way,stop signs be installed at this intersection
immediately; pending . the installation of traffic signals:.
Resolution NO -,2878, amending Resolution No. 2788 regula
parking and- th;e, use. of ertain' streets, designating A1ma,.Street: at
East Meadow :Drive as a; four-way stop intersection, was introduced,
and on motion of Bishop and,Byxbee, was adopted by unanimous 'vote

This woos the 'time set for hearing; protests relative to the
modification of Prn;ect 56 7:to'provide that bonds to be issued on;
the unpaid assessments. shall' be 15- year, bonds under Bond Plan C,, and:
shall bear interest at.rate of -5%,. The hearing was declared open..

A-report,was received from the Planning Commission requesting
the. Council to defer its.' decision on this proposed annexation. and"
continue the matter, in order to give the Commission an opportunity,
to give further study to` he.proposed zoning for the area and develop
an amendment, to the.::Zoning= Ordinance *'; iich :might more nearly satisfy
the -requirements of the property ;owners concerned and provide accept-

the Council in -behalf of�s residents, of`Barron Park, and presented', a
petition from approximately, 200 _residents of the area conc.erning'.,the
condition -of the ;water_ pressure in the Barron Park arep which they
s;tatefis "so Tow ._that it is °caus.i:ng a health and fire hazard, pnd`
asking immediaate' actionto correct the situat on.
The, City:Manager and the Chief Engineer of the Water -Gas -
Sewer Division advised 'tthat the .improvement prog"nm for the water
System will provide : r e'.lief to the 'Barron Park area; that a new' line
to increase pressure. in , the'. -area. is>, included; in the first phase of
the program and: should be completed before next summer. They. also
:stated that a new tell in' the :area -will provide temporary relief;
. that the we.11 was drilled some ->time ago but there has been trouble
with:the motor, and .as soon.as this has been corrected and the well
is in operation,- there will. be some relief In the water pressure.
Mr.- Hamilton and other residents of the area asked thaat the
.work -be expedited in an' -effort to improve,the situation as soon as

Annexations to Mountain View
.Notices were received from .the County.Boundary Commission
of proposals for annexation to the: City of MPuntain View of. »reps
'designated as "Terra Be11a.. #Z" and:Thompson #2." These notices
were filed.
Award for Police- Traffic`.SuPervision
A letter `was received,.from the Chamber of Commerce con-
gratulating the Chief of Pol.ice.and the Police Department on the
safety award made by the International Association of Chiefs of.
Police for outstanding achievement in police traffic supervision.

A report was made-by:the.City Manager on bids .received on
-July 33, 1957,E on the: construction of the Main Library -Building,
with -`the recommerdat1on -t,hat ;the low bid of: the. Hub.: Pacific_:Building
Company in, the. sum, of $35,3,800.00 be accepted. He advised that the
bid included :the'. cost of .a basement and other alternates.,
:It was Moved by, Byxbee, seconded ,° and 'carried --.by unanimous
i vote on roll call that the: bid of. Hub Pacific .Building Company be
; accepted `and that the ,mayor be authorized to sign the contract for
this:work.
Ag±eementt"with Southern.-Pacific'(Signals, Alma and Churchill)
The City Manager presented an agreement°between the City
and the Southern Pacific Company for rre-empted traffic- signals at
the intersection of Alma Street and Churchill' Avenue.
A resolution .a:pproving the agreement and authorizing its
execution by her+layor -was introduced, and on motion :of' Bishop and
Cresap, was adopted by unanimous vote on roll call.
.'Counc:ilman. Bishop suggested that the Staff Traffic Committ
look-intothe hazard Created.by shrubs between the railroad and Alma
Street near Churchill Avenue, and take action to correct the situati
Contract with Shearer: to:Purchase Property
The Assistant City Manager presented a contract with
Joseph E. Shearer :and. ,Georgia P. Shearer for the purchase' of a
portion of Lot -39.,; Block 5,`for the purpose of constructing -a
walkway from Emerson. Street. to. the parking lot to be developed on
.the northeasterly- side of -High Street in Block 5.
A resolution authorizing the Mayor to sign this' contract
in behalf .of .the. City was introduced., and on motion of Rodgers and
Byxbee, was adopted- by unani•maus vote on roll call!
Zone Change A plication (McGrath)
A report was received from the Planning Commission recom-
mendingdenial of: the ,application of Bryant G. McGrath fora charge
of district: , ` Lot 3, Block 221, known as 2S90 Webster- Street, cor-.
ner of Webster. Street. and Middlefield Road, from R-1 to R -3-P. The
Commiss5on advisedthat: this ,matter has been carried over' for a period
of many months; that of later no',progress has been made, and it was
the::feeling_ of the: Commission that the application, should be ter-'
minated- and .that when' the)pp:l cant has new plans for presentation,
_ ication for zone change.
On motion of Rodgers and Byxbee, the recommendation of the
Planning Commission, for denial of the a.pol.icltion was adopted, Bishok
not voting on to motion.

A report` was received from, the Planning Commission recom-
mending denial of the tentative map ofportion of Lot 54,` Wooster.

The Commission advised that If the map were approved it would result

.Final Map of Tract No: 1738, Queen's Court
A report, wets received from the Planning Commission recom-
mending approval,of the final map of,'Tract No. 1738, Queen's Court,
being a portion of Lot 101, Wooster Subdivision, located --on Louis
Road opposite Greer Road, subject"to the construction of a solid
board redwood fence along the northwesterly line of the storm: drainage
.Easement and to the shaping and protection, of the channel of Dry
Creek to the sa.tisfaction:of the City Engineer; also subject to:pro
viding a 5' x 1,5' public utilities easement as shown in red on the map,.'
and that thesubdiv,3der be` requested to dedicate to the City the 15-
foot storm drainage easement:
Resolution No. 2880, approving final map of Tract No-. 1738,

North County Building
A report was submitted by the Planning Commission on.pro
posed -a.lternate -sites being considered" by the Board of Supervisors.

County Planning Deps.rtment, was present and told the Council he hid
been reouesred to attend the. meeting --to answer any questions Council
members: might have regarding; the proposed alternate sites under
consideration

Commission and the County report+ favoring the Middlefield -Charleston

the -Council approve -the. recommended site on the Westerly corner_; of

Traffic Stud.y
- The City Manager called attention to his previous proposal
for the hiring .of a traffic :engineer 'on `a. consulting basis, a and too
the decision :to defer action until`the County had employed an 'e:ngl
neerin.g firm to. make: the. county-widetraffic study. He advised that;
the,County has hired the firm of .De: Leuw, Cattier & Company to nuke
the County study
it was moved by Mitchell, seconded by Byxbee, and carried'
that the City Manager be authorized to. negotiate with De Leuw, Cattier
and Company for theiremployment,as consultants on traffic problems.:
Quitclaia Deed to Piers
A resolution) '`approving a` Quitclaim Deed to M. 1. Piers and:
Eleanor B. Piers, and authorizing :the'Mayor to execute this quitclaim
deed in behalf of.. the City, was introduced, and on motion. of Mitchell
and Byxbee, was, adopted by unanimous vote on roll call. The property
involved -is 'a portion of Lot 126,`Wooster Subdivision:
-Tax Deeds
Resolution No. 288x:: accepting tax deeds from the Tax Col-
lector on .tax delinquent property (Portion of Lot 6, Block 6, Seale
Tract No. 5, assessed to Katherine Anderson; and Lot 32, Block 45,

A report was received from, the Clty Attorney on claim

;automobile when it; was struck by a city vehicle. The.City Attorney
;advised that_-he:has Investigated the matter with the assistance of
the Police Department and the' Fire Department, and it his-. opinion
-i there.,;wa.s contrlbutory:negligence on, the part of the clainza.nt. ' He
.recommended the claim be denied.
The CityAttorney also submitted a report on the claim
filed by.M,rs. Frances F..'Monson in the sum of $1,000 for injuries
sustained; when she fell: on the sidewalk in front of; the President
Hotel,, The City Attorney advised that he has Investigated -the
matters wit'h the, assistance of the Police Department, and finds there
is no measurable' defect in the' sidewalk. where Mrs. Manson fell, and
in his opinion -there 3s no pliability on the part of. the City. He
recomMerrded the Claim be -denied.
On .motion -.of Byxbee and Navis, the reports of the City
Attorney_were,accepted'and these claims were denied.
Monthly Reports
The:monthly report of the Planning Officer:, an action taken
in June on applications; -for redivision of lots, and the monthly
.report of the Zoning _Administrator on action, take- inJune on applic
tions for variances=and use permits, were, received andfiled:

Planning Commission Membership:;.
The Mayor announced that `47r_. Ray K. Linsley has submitted
his resignation;, from the Planning Commission as he will be away from;
the city for the next year. The Mayor nominated Mr. L. Farrell:
:McGhie :Assistant Dean of -;Engineering at Stanford University to fill
Mr L xis ley' s unexpired -term which, runs to June 30, 1958.
On motion of Byxbee and Mitchell, the appointment
McGhle;was approved.; to be effective as of August 1, 1957.
