RESOLUTION NO. 4685
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING A Ml:SCELLANEOUS DIVISION OF LAND FOR
PROPERTY LOCATED uN MANCHESTER COURT AND GRANTING
EXCEPTIONS FOR LOT WIDTH AND DEPTH, SUBJECT TO
CONDITIONS
WHEREAS, the owners of two parcels of l&nd located at the end
of Manchester Court, a cul-de-sac street, wish to redivide said
parcels of land as shown on the attached map entitled "Preliminary
Map, Morin-Weltzin Properties" dated September 2, 1972, and being
a portion of Lot 109 of the c. M. Wooster Subdivision as shown in
Book "O" of Maps at paqe 16 thereof; and
WHEREAS, there is more than enough land herein to permit at
least five (5) lots therein, which would meet city requirements
for lot size: however, due to the configuration of the land and
ita location at the end of a cul-de-sac street, development of
only three lots substantially in excess of minimum lot size wou14
be preferable and is desired by owners; and
WHEREAS, three lots as proposed would be similar to development
at the end of other cul-de-sacs in the City and the exceptions
requested herein would facilitate the orderly development of this
property:
NOW, THEREFORE, the Council does RESOLVE as follows:
SECTION l. The Council finds that development of lots at the
end of a cul-de-sac street frequently creates difficulties in
meetinq city requirements for lot size, and the same is a special
circlMilBtance or condition af fee ting the prop~rty. An exception
therefor is specifically authorized under Section 21.20.110 of the
Palo Alto Municipal Code. The exceptions granted herein are necessary
for the preservation and enjoyment of a substantial property right
of the owners and will not be detrimental to the public welfare
or injurious to other prope~ty in the territory in which the property

is situated, inasmuch as the total acreage of lota craated herein
is far in excess of that required by the existing zoning. No sub-
stantial effect on the environment will be caused by this division
of land.
SECTION 2. The· map entitled "Preliminary Map, Morin-Weltzin
Properties, Portion of Lot 109, c. M. Wooster Subdivision, Book 1 0 1 ,
Page 16 11 dat~d September 2, 1972 is hereby approved with exceptions
showo thereon for lot depth of Parcels l and 2 and lot width of
Parcel 1, subject to the following conditions:
a. compliance with each of the conditions contained in City of
Palo Alto Engineering Bulletin No. 72-17.
b. Removal of all structures designated for removal upon said
map prior to the issuance of a building permit for construction
on any of the parcels shown upon said map.
