HomeMy WebLinkAboutRESO 4684• • RESOLUTION NO. 4684 ORIGINAL RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING A TENTATIVE SUBDIVISION OF APPkOXIMATELY 2.7 ACRES OF PROPERTY LOCATED AT THE SOUTHWESTERLY CORNER OF HARRIE1l' AVENtlE AND HARKER AVENUE IN THE CITY OF PALO ALTO (PALO ALTO ACADEMY) AND GRANTING AN EXCEPTION TO PERMIT FOUR REAR LOTS, SUBJECT TO CONDITIONS WHEREAS, substantially all of an entire block in the City of Palo Alto,consistinq of approximately 2.7 acres, located at the southwesterly corner of Harriet Avenue and Harker Avenue (the former Palo Alto .-Academy) contains more than enouqh land for sixteen (16) single family dwellings; and ~, said property is bounded on three sides by existing fully improved city streets and on the remaining side by developed property) and WHEREAS, development of this land without the use of rear ' -lots would result in unusual lot configurations and a loss of housing in the City; NOW, THEREFORE, the Council does RESOLVE as follows: SECTION l. The council finds that subdivision of substantially all of an existing city block is a special.circumstance or condition affecting the property, the exceptioa-ceqUeated herein is necessary for the preservation and enjoyment of a aubstantial property right of the owner, and that the granting of this exception will not be detrimental to the public welfare nor injurious to other property in the territory in which the preperty i$ situated. Based on information provided by the State of california Office of Intergovernmental Management and analysis by the city staff, no significant effect on the environment will be caused by this subdivision or the exceptions granted herein. • • SECTION 2. The teLtative subdivision map attached hereto entitled •Glenwood II• dated Rev. 10-24-72, is hereby approved with an exceptio~ to permit four (4) rear lots, shown on the attached m&p as Lots 9 through 12, subject to the following conditions: a. b.-- c. d. e. f. h. i. j. 'the 15-foot access to each rear lot shall have a 10-foot paved surface with a 13-foot overhead clearance with no parking permitted at any time. There shall be no fence separating the adjacent access so as to provide 20 feet of contiguous paved driveway. Two additional on~site fire hydrants shall be installed to comply with the 300-foot maximum working distance for fire protection. 'l'he awner shall grant the two-10-foot public utility easements as required by the Engineering Department. All. broken sidewalk shall be repaired. Abandoned· driveways shall be removed and properly reconst~~cted at the street with curb and gutter. All new electric,-telephone and utility lines shall be installed underground. All work shall be done in accordance with City of Palo Alto.specifications. All utility c0nnection costs shall be paid prior to recording the final map_. OWner shall provide evidence of payment of all due city and county taxes. A final subd.i vision map shall be submitted in accordan.ce with Section 21.16 of the Palo Alto Municipal Code and Article 5 of the Subdivision_ Map Act.
