HomeMy WebLinkAboutRESO 4674---------------------------·-----------------·----·- • • • ORIGINAL RESOLUTION NO. 4674 RESOLUTION OF THE COUNCIL OF THE ClTY OF PALO ALTO ACCEPTING A GRANT OF SCENIC RESTRICTION CONTAINED IN A CORPORATION SCENIC-RESTRICTION GRANT DEED FROM THE BOARD OF TRUSTEES OF THE LELAND STANFORD JUNIOR UNIVERSITY ro THE CITY OF PALO ALTO, COVERING CERTAIN LANDS IN THE AREA OF COYOTE HILL WHEREAS,· a;; part of a proposed settlement The Committee for Green Foothi1ls v. The Board of Trustees of The LeJand Stanford Ju~tlor University,. et al., presently pending on appeal in the First Appellate District, Divis.ion JI of the District Court of Appeals of the State of California, 1 Civil Nos. 29055 and 30651, (the "litigation") The Board of Trnstees of The Leland Star.ford Junior University (the "Univ..irsity") wishes to grant to the City of Palo Alto pursuant to Section 6950 et seq. of the California Governm<;-r.t Code scenic restrictions covering certain property located adjacent to Coyote Hill; and, WHEREAS, the University submitted to the City by letter dated October 25, 1972, a proposed Corporation Scenic Restriction Grant Deed (the "Deed") setting forth such scenic restrictions; and, WHEREAS, the University has requested that the City accept the Deed prospectively, effective upon the filing of a dismissal of the litigation and upon the execution and delive '-Y of the Deed to the City; and WHEREAS, the property which is the subject to the Deed is characterized by great natural scenic beauty and is a natural resource well deserving of preservation for the public welfare; and, WHEREAS, the acceptance of the Deed by the City will effectively preserve the character of such property for the public enjoyment and is in the best interest of the City; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. That the City of Palo Alto hereby accepts the Deed and the scenic restrictions contained therein, in the form heretofore subctitted to the City, effective upon the filing of a dismissal of the litigation and upon the execution and delivery by The Board of Trustees of The Leland Stanford Junior University of such Deed to the City Clerk of the City of Palo Alto. \ .• • • • SECTION 2.
