RBSOLUTION NO. 4669
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
ORDERING THE VACATION OF TWO EASE~.ENTS LOCATED WITHIN
TRACT NO. 5153 -MOCKINGBIRD HILL
WHEREAS, the cowicil of· the City of Palo Al to· did on the 11th day
of September, 1972, pass Resolution No. 4652 declarinq its intention
to vacate two easements located within Tract No. 5153 -Mockinqbird
Hill • as describ~d and shown in EXHIBITS A and B attached hereto
and on file with the oriqinal of said Resolution No. 4652 in the
Office of the City Clerk; and
~REAS, the Council has.received and considered the action of
the Planninq Commi11aion of Septembe'r 27, 1972, concerning said
easements; and
WHEREAS, pursuant to said Resolution No. 4652 a public hearinq
was duly noticed and held on October 10, 1972; an~
WHEREAS, from all the evidence submitted, the City Council of
~ i the City of~Palo Alto finds that the· requirements of Title S,_.~!.--.··,1, ·-.~-

Part l, Chapter 2, Article 5, of .the California Government Code
(commencing with Section 50430 thereof) have been fulfilled sub-
stantially and that_said easements are unnecessary for present or
prospective public purposes or use.

as follows:

and B attached hereto are henby ordered· vacated.

EASEMENT NO. l
BEGINNING at a point in the southeasterly boundary line of
Arastradero Road, distance thereon 264.00 feet northwesterly
from the point of.intersection thereof with the westerly boundary
line of that certain S.3037 acre parcel of land, situated in
Rancho La Purissima Concepcion, conveyed by Marian H. Walker to
Ernest J. Kump, et ux, by-deed dated August l, 1947 and recorded
in Volume 1492, Official Records at Page 433, Records of the ·
county of Santa Clara and running thence s. i2•1s•o• E., a
distance of 2?2.8 feet; thence s. 6°27 1 00-E., 128.l feetf thence s. 29°51'0" w., 145.9 feet, more or less, as granted by Ernest
J. Kump and Josephine M. Kuinp, husband and wife to Pacific Gas
and El•ctric company by instrument dated September 14, 1951,
recorded October 9, 1951 in Book 2297 of Official Records, Paqe
15. -
By instrument dated March 31, 1964, recorded December 8, 1964 in
Book.677!l of Official Records, Page 618, Pacific Gas and Electric
Company, a California corporation, assigns all of its right, title
and interest in, to and under the foregoing right of way to the
City of Palo Alto, a m•uiicipal corporation.
EASEMENT NO. 2
An easement dated September 30, 1964, recorded October 28, 1964
in Book 6719 of Official Records, Page 398~ granted by Windsor c.
cutting and Mary w. cutting, to the City of Palo Alto, a municipal
corporation, for public utilities purpose, in, over, across and
upon ~portion of the· herein described as follows:
A strip of land 10 feet in width, the centerline of said strip
being more particularly described as follows:
BEGINNING at a point in the northwesterly line of Parcel l, said
point being also a point in the southeasterly line of Arutradero
Road, as said Par~_,l. 1, arid Arast.radero Road are shown upon that
certain-Map e~titlea,"Recorc3of·Survey of a portion of Rancho La
Purissima Concepcion for Mrs. c\ttting1i a map of which was
recorded AuCJUSt 3, 1964 in Boot.·183 of Mapa at Page 16 in the
Office of the-Recorder of Santa·c1ara County, California, distance
along said line N. 59°29'3'• s., 6.39 feet froa the northwesterly
corner of said Parcel 1, running thence frcn said point of begin-
nings. 14° 03•13• B .. , 580 feet to-a terminal point.
