RESOLUTION NO. 4602
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
OPPOSING AB 2005 PROHIBITING LOCAL GOVERNMENTS FP.OM
FINANCING PROJECTS BY LEASE CERTAIN ARRANGEMENTS
WHEREAS, Assembly Bill 2005 has been introduced in the State
Legislature which amends certain section of the Government Code
commencing with Section 53789: and
WHEREAS, -Assembly Bill 2005 prohibits cities and counties
from entering into lease-purchase agreements or long term leases
with nonprofit corporations under certain circumstances: and
WHEREAS, such prohibition would seriously hamper local
governments and prevent flexibility in financing certain projects
particularly those providing for open space and low and moderate
income housing.
NOW, TriERE~ORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. On behalf of the citizens of this community the
City Council of the City of Palo Alto vigorously opposes AB 2005
and urges the legislature to defeat this bill.
SECTION 2. The City Clerk is directed to transmit a copy of
this resolution to Assemblyman Newton R. Russell, author of the
bill7 Assemblyman John T. Kno~ Chairman of the Committee on Local
Government: Assemblyman John Vasconcellos, and_Assemblyman Richard
D. Hayden.
