RESOLUTION NO. 4598
RESOLUTION OF THE COUNCIL OF THE r:rrv OF PALO ALTO
SUPPORTING AB 2135, AB 2136, AB 2137, AB 2138, AB 2139
AND AB 2140 PRESENTLY PENDING IN THE ASSEMBLY OF THE
CALIFORNIA STATE LEGISLATURE
WHEREAS, the City of Palo Alto has for some time recognized the extreme importance
of open space as a valuable natural resource, and
WHEREAS, the City of Palo Alto recognizes that the preservation of open space within
the community is vital to the public health, safety and welfare, and
WHEREAS, the City of Palo Alto has adopted the Open Space Element of its General Plan
and is adopting an Open Space Zoning District to implement the Open Space Element of the
General Plan, and
WHEREAS, it is vital that the State Legislature recognize the importance of open space
presarvation and aid all cities, cities and counties and counties in the preseriation of this valuable
natural resource, and
WHEREAS, the Joint Committee on Open Space Lands of the California State Legislature
has proposed a series of six bills, AB 2135, AB 2136, AB 2137, AB 2138, AB 2139 and AB
2140, which will aid the State and its political subdivisions in the preservation of '.'!!)en space,
and
WHEREAS, said pending legislation provides as follows:
(a) AB 2135 provides for a State open space policy and a comprehensive pla.'1 for
the preservation, conservation ·and management of open space lands and resources of statewide
significance and for a unique statewide "S}·stem of open space." It further provides th~ pr~
for financial implementation of the "open space ptan."
(b) AB 2136 provides for immediate state action to preserve key lands and waters
of statewide significance in proximity to population centers.
(c) AB 2137 provides for a 1% tax on the value of the transferred real estate with
an exemption on the first $20,000 of an owner-occupied single family, multiple family or

condominium dwelling unit, eliminating the burden on the average homeowner in California, which
revenue will be allocated annually with 40% of the total for regional and local open space prcjects,
40% for State open space projects and 20% for open space contingency i':-Ojects.
(d) AB 2138 provides that in ordtir that lands be placed under the "Williamson Act"
it must be designated in the Open Space Element of a local or regional plan and be within
three miles of the boundaries of an incorporated city. However, if the land is threatened by
urban expansion as declared by a Board of Supervisors with the approval of LAFCO, such land
ll!_ay be placed under the uWilliamson Act.''
(e) AB 213'.J provides that a Board of Supervisors may condition lands to be placed
under the Williamson Act to allow for compatible muiti-purpose use of lands particularly for
public outdoor recreation purposes.
(0 AB 2140 authorizes and simplifies the procedures for public acquisition of various
interests in open space areas, including eminent domain, for such purposes as natural and human
resources, managed resource production, outdoor recreation, shaping of urban growth and open
space for the health, welfare and well being of the public. It further provides for "lease back"
provisions to be established by State and local government.
NOW, THEREFORE, be it RESOLVED that the Council of the City of Palo Alto hereby
endorses AB 2135, AB 2136, AB 2137, AB 2138, AB 2139 and AB 2140 and urges adoption
thereof by the Legislature of the State of California.
BE IT FURTHER RESOLVED that the Clerk of the City of Palo Alto is directed to transmit
copies of this resolution to Assemblyman John J. DunJap, Chairman, the Joint Committee on
Open Space Lands of . the California Legislature; Assemblyman Paul Priolo, Chairman of the
Assembly Committee on Planning and Land Use; Assemblyman Willie Brown, Jr., ChaL'Tilan of
the Assembly Ways and Means Committee; Assemblyman Joe A. Gonsalves, Chairma.11 of the
Revenue and Taxation Committee; Assemblyman Bob Moretti, Speaker of the Assembly;
Assemblyman Walter Karabian, M~ority Leader of the Assembly; Assemblyman Bob Monagan,
Minority Leader of the ASk!mbly; Assemblyman John Vasconcellos, and Assemblyman Richard
D. Hayden.

Enclosed is a copy of the Open Space Element to the Palo Alto
General Plan. As part of that report is Resolution No. 4598
supporting the above listed Assembly Bills re preservation of
open space.
The Resolution was passed by unanimous vote by the Palo Alto
City Council at its May 22, 1972 Council meeting.
