HomeMy WebLinkAboutRESO 4581that • • WJML:KJmh 3-31-72-45 ORIGINAL RESOLUTION NO. 4581 A RESOLUTION FINDING AND DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE -~ --- PROPOSED ACQUISITIONS AND IMPROV~S GREEN ACRES I UNDERGROUND UTILITIES CONVERSION PROJECT NO. 71-85 RESOLVED, by the Council of the City of Palo Alto, California, WHEREAS, on the 28th day of February, 1972, said Council, in accordance with and pursuant to the Palo Alto Municipal Code and Sec- tion 17 of Article XIII of the State Constitution, adopted its Reso- lution No. 4566 of Preliminary Determination and of Intention, ~herein it did preliminarily determine that the public convenience and neces- sity require certain acquisitions and improvements therein described in general terms; WHEREAS, said Council thereupon appointed Monday, the 10th day of April, 1972 at the hour of 7:30 o'clock P.M. ot said day, in the Council Chambers, Civic Center, Palo Alto, California, as the time and place when and whei·e any and all persons interested could appear and show cause why the Council should not find and determine that the public convenience and necessity require the proposed acquisitions and improvements without complying with Section 2800 and following of the Streets and Highways Code of the State of California; WHEREAS, it appears that notices of said hearing were duly and regularly posted, mailed and published in the time, form and manner required by said Code, as evidenced by the affidavits on £ile with the City Clerk; WHEREAS, said hearing was duly and regularly held at the time and place advertised in said notices, ~~-o_n_e~~~-·personk interested appeared and showed cause why the Council should not make the findings and determinations hereinafter set forth, documentary and oral testi- mony on the question of public convenience and necessity was duly • • introduced and fully heard and considered by the Council, and all persons interested desiring to be heard were given an opportunity to .be heard, and all matters and things perta::ning to said question of public convenience and necessity were submitted and fully heard and considered by said Council; NOW, THEREFORE, said Council does hereby FIND, DETERMINE and ORDER, that the public convenience and necessity require the proposed acquisitions and improvements as generally described in said Resolu~ tion No. 4566, and Section 2800 and following of the Streets and Highways Code of the State of California shall not apply. * * * * * * I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the Council of the City of Palo Alto, California, at a meeting thereof held on the 10th day of April , 1972, by the following vote of the members thereof: AYF.S, and in favor thereof, Councilmen: NOES, ABSENT, UNANIMOUS Councilmen: NONE Councilmen: NONE Ciw.aoJ~ APPROVED: l1~~ MaYor1 Approved: ~-~~I 2 city or Palo Alto / d. tZ. ! f,µ .. ,_t,:_ / / .. ; .-'( :L< . ./ , • .I' .. !~-{.. ·\."(: ; , . ..._.' / .. :·' ;"( ~ .-'
