RESOLUTION OF THE COUNCIL OF THE CITY OF PALO Al.TO
FINDL'\ZG AND DETERMINING THAT THE PUBLIC L~TEREST AND
NECESSITY OF SAID ClTY REQll lRE, FOR PUBLIC USE, CERTAIN
LAND LOCATED 1N THE CITY OF PALO ALTO, COUNTY OF SANTA
CLARA ST A TE OF CALIFORNIA
TOPICS PROJECT 70--59 INTERSECTION IMPROVEMENTS
The Council of the City of Palo Alto does RESOLVE as follows:
SECTION 1. The Council of the Clly d[ Palo Alto has found and determined,
and h"'r1,by d0es find, d~tt:'rmint-ancl dedan.-, that ~he public inter.est and nec.essity
requir~ the acquisition. constr11ction and <.ompletion by the City o{ Palo Alto of the
followrng p•lblic improvement. to wit-pubhc roadways and appurtenances and for
public uti lily purposes, including but not limited to, underground public utilities.
SECTION 2. The tak1ng of the fee simple title in and to Parcels 2 and 3,
as more p~rticulorly described in Exhibit 11 A 1 ', attoched hereto and by this refer-
ence made a part hereof, for roadways and appurtenances, together with an
easement for roadways and appurtenances and public utility purposes including,
but not limitt>d to, underground public u.tilit1es, in, over, under, across and upon
Parcel I. as more particularly described in said Exhibit "Ai 1, are necessary for
said improvements.
SECTION 3, Said propos~d acquisitions and improvements are planned
and located in a manner which will be most compatible with the greatest public
good and the least private injury, and all of said acquisitions are situate within
the territorial limits of the CHy of Palo Alto.
SECTION 4. The Council of the City of Palo Alto hereby declares its
intention of acquiring the estates and interests aforesaid in and to said Parcels
1, 2 and 3, as more particularly de scribed in said Exhibit 11 A 0 under eminent
don1ain proceedings, and the Office of the City AttorI'\ey and the law firm or
Wilson, Jones, Morton & Lynch, employed for that purpose, are hereby directed
to institute and conduct to conc.lusion an action in em1nent domain for the a<. qui-
sition of said property and to take suc:h ac.ticn as is necessary therein.
SECTION 5. The City Manager is hereby authorized and directed as an
alternative to trial of any action in eminent domain initiated hereunder, to purchase
for such reasonable sums as he may deem appropriate or exchange for other
lands, as previously authoriz.ed by the City Council, the real property des<..dbed
in said Exhibit 11 A 11 and to cause to be drafted, e;{~cuted and delivered on behalf
of the City all doc,Jments, either to be used withir. or without the condemnation
proceedings aforesaid, ncces.;ary or convenient to ac<.:omplish this purpose.

SECTION 6. The City Manager is further authoriz.ed to spend from
general funds of the City appropriated for such purposes such monies as are
necessary or exlh..inge such lands_ which in his opinion may constitute the
fair market value of said parcels based upon appraisals of duly qualified and
compett>nt real est.ate appraisers.
SECTION 7, The C1ty Clerk shall certify to the adoption of this reso-
lution by a vottc' of two-·thi rds o( all of the membl" rs of the City Council.
I hearby ct:>rtify that the whole nu1nb~r of members of the Council or the
City 0£ Palo Alto is nine and that the foregoing resolut10n was adopted by a
vote of two-thirds or more of all of the members of said Coun<.il at 1ts meeting
held on the .. ~7th day of March, 1972, by the following vote:
