AND A SECOND REAR LOT / SUBJECT TO CO~DI·rIONS
Pursuant to Title 21 of the Palo Alto Municipal Code, the
Council herepy approves a miscellaneous division of land of 32,629
square feet of property in the City of Palo Alto described as a
portion of Lot 10, Block 4, Seale Subdivision No. 5 and generally
known as 2314 Louis Road, as shown on the map attached hereto
and incorporated herein by reference, subject to the conditions
hereinafter set forth.
The Council finds:
1. Said property's configuration in relation to other ownerships
is unusual and does not lend itself to the creation of as
many lots as the total square footage and the zoning would
permit.
2. No reasonable solution has been found to create three standard
lots, although total acreage and zoning would permit more
than three lots. It is reasonable to peimi t the creation of
three lots upon said property.
3. The exceptions granted herein are necessary for enjoyment
and preservation of a subl=l._antial property right of the
applicant, and will not be detrimental to the public welfare
or injurious to other property in the area.
The Council hereby grants ar. exception to Section 21.32.050
of the Palo Alto Municipal Code to permit a second rear lot and
exceptio~s to per-Jit lot depths for Parcels A, B and C to be
less than required by Section 21.20.110 of the Palo Alto
Municipal Code, but not less than 96.34 feet.
The exceptions granted above are subject to the following
conditions:

1. That the applicant shall grant a S foot public utilities
easement as required by the Utilities Department.
2. That the applicant shall supply separate utility services
for each parcel.
3. Th~t the first 100 feet of the access roads be a mutual
easement for all three lots.
4. That there be payment of all payable city and county taxes.
5. That all electricity, telephone and all other utility
facilities shall be installed underground.
6. That a final parcel map be filed in accordance with Chapter
21.32 of the Palo Alto Municipal Code and Article 5 of the
State Map Act, which complies with each of the conlitions
of this resolution.
7. That the property line fronting on Louis Road be moved to
5 feet from the back of the sidewalk anp the applicant
provide the City with an appropriate deed of dedication of
a five foot strip of property along Louis Road.
8. That the property line between the front lot and the first
rear lot be 97 feet from the front property line.
9. That the first rear lot have a depth of 98 feet and the
second rear lot a depth of 96.34 feet.
10. That the access road to the second rear lot be flared for
the last fifty feet to a total width of forty-two feet.

SUBJECT: Division of Lot 10, Block 4, Seal Subdivision No. 5
This tentative parcel map proposes to divide one lot of 32, 629 square
feet into three parcels and is being submitted by the owner for the third
time. The previous two submittals were denied.
This map was before the City Council on February 7, l 97Z, and was
continued for three weeks to resolve some problems. The following
c01nments are offered:
1. Parcel A is substandard in depth. The existing house on
Parcel A shows a 6. 34 feet rear yard set back. This is in
viola ti or~ vf the Palo Alto Municipal Code, which calls for a
ZO feet rear yard set back.
z. This tentative map shows two rear lots fronting on a
public street. This is in violation of Section Zl. 3Z. 050 of the
Palo Alto Municipal Code, which states that the Pla.nning
Director may grant, for oingle family use only, one rear
lot on a public street.
Incase approval is granted, it should be subject to the following conditions:
l. The applicant shall dedicate a five foot strip of property
along Louis Road.
z. The developer shall grant a 5-foot P. u.E. as shown on the
map.
3. The developer shall supply separate services for each parcel.
4. The combined driveway for Parcels B and C shall have a 15 foot
paved section.
5. Payment of all payable City and County taxes.

7. A final parcel map must be filed in accordance with
Section 21.16 of the Palo Alto Municipal Code, and Article 5
of the State Map Act.
