RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING A TENTATIVE SUBDIVISION MAP FOR APPROXI-
MATELY 10.2 ACRES OF PROPERTY LOCATED AT THE CORNER
OF OLD TRACE ROAD ANO ARASTRADERO ROAD, GRANTING AN
EXCEPTION FOR THE WIDTH OF A CUL-DE-SAC, SUBJECT TO
CON DX TI OKS
Pursu&l1t to Title 21 of the Palo Alto Municipal Code, the
Council hereby approves a tentative subdivision map for approxi-
mately 10.2 acres of property located at the corner of Old Trace
Road and Arastradero Road, generally known as Mockingbird Hill,
consisting of eight lots. Said property is shown on the map
attached hereto and incorporated herein by reference.
The Council finds as follows:
1. Said lands have an irregular shape and unusual top-
ography and slopes.
2. Said lands contain substantially more area than would
normally be required for creation of eight lots. No
reasonable or practical necessity exists to require
Mockingbird Lane to be 60 feet wide.
3. The exceptions granted herein are necessary for enjoy-
ment of a substantial property right of the applicant
and will not be detrimental to the public welfare or
injurious to the property in the area.
The Council hereby grants an exception to width requirements
for the street currently known as M~ckingbird l.a.ne, which being
in excess of 350 feet in length is req~ired to be riot less than
60 feet wide. The Council approves a right-of-way of 40 feet in
width for Mockingbird Lane and approves the subdivi~ion of the
proper~y describ~d herein subject to the following conditions:

The shaded area shown which extends into Arastradero
Road for roadway purposes, as shown on the attached map,
as well as "Mockingbird Lane" is to be dedicated to
th~ City by separate grant deed~
2. The subdivider shall provide a five foot wide compacted
red rock walkway for Mockingbird Lane on the northerly
side, extending around t~.e bulb and to the point where
it becomes straight, at the rear of and adjacent to
t.11e curbing.
3. All cut and fill slopes shall be protected with native
plants. No cut or fill shall have a slope which exceeds
1.5 foot horizontal to 1.0 foot vertical.
4. The developer shall construct a complete drainage system
subject to the requirements of the City Engineer.
5. Due to the undesirability in terms ot traffic safety of
permitting direct vehicular access to~Arastradero Road,
a non-access strip shall be provided on the northerly
side of Lots 4, 5, 6, 7 and 8 in the location specified
in condition No. 11. The subdivision shall be redesigned
to allow access from Lot 4 to Mockingbird Lane.
6. The subdivider shall submit proposed improvement plans
and supporting calculations for review prior to the
approval of the final map by City Council.
7. The subdivider shall execute an agreement for performance
of all required public improvements and a surety bond to
guarantee completion of said public improvements prior
to the approval of the final map as required by Sections
21.24.liO and 21.24. 180 of the Palo Alto Municipal Code.
8. The recommendations proposed in the !?reli,ru,nary soils
report by Terrotech, Inc., as well as~those which appear
in the final soils report, are to be followed in con-
struction of this subdivision, and therefore are in-
corporated into this report by reference as a condition
subsequent to tentative approval.
9. The name of "Mockingbird Lane" proposed for the cul-de-sac
street shall be subject to the approval of the "Public
Facilities Naming Committee."
10. The entrance to Lot 3 is intended to be made by the use
of a 15 foot wide drive. Ten feet of this drive are
required to be paved.
11~ The subdivider shall grant a 10 foot wide public utility
easement along the northerly sioe of the entrance to
Lot 3 which will connect to an existing public utilities
easement along the westerly side of Lot 2. He shall
also provide a 10 foot wide ea~ement along Arastrade~o
Road on Lots 4, 5, 6, 7 and 8 beginning at the top of
the cut slope, to be used for future trails, road, and/or
path purposes. In addition, a one (1) foot non-access
easement shall be provided along the northerly portion
of this easement covering all lots.

12. The water line running from Lot 2 to a well on Lot 6
shall either be rerouted so that it does not encroach
upon the City's right-of-way or an a~;reement shall be
entered into allowing the encroachment, but subject to
the condition that the owner will pay all expenses in
case of repair o~ in case the encroachment permit is
revoked and the pipe is required to be removed.
13. The owner shall pay in full Bond Series "D", the
assessment of Parcels No. 43, 44, 45, 46.b and 47.c of
"Old Trace Road, et al," Project No. 64-4.
14. All new electric, telephone and utility lines are to
be installed underground.
15. The owner is to furnish evidence of payment of all
due city and county taxes.
16. A final subdivision map shall be submitted in accordance
with Section 21.16 of the Palo Alto Municipal Code and
Article 5 of the Subdivision Map Act, incorporating
all changes and in compliance with all conditions
contained in this resolution.
