RESOLUTION OF THE COUNCIL OF 'l'HE. CITY OF PALO ALTO
APPROVING A MISCELLANEOUS DIVISION OF LAND FOR
APPROXIMATELY 3.92: ACRES OF LAND GENERALLY KNOWN
AS 950 OLD TRACE ROAD, GRANTING EXCEPTIONS TO WIDTH
REQUIREMENTS FOR ONE PARCEL AND P..CCESS REQUIREMENTS
FOR ANOTHER, SUBJECT TO CONDITIONS
Pursuant to Title 21 of the Palo Alto Municipal Code, the
Council hereby approves a miscellaneous division of land for
approximately 3.92~ acres of land generally known as 950 Old Trace
Road, located in the vicinity of the terminii of Old Trace Road
and Old Adobe Road in the City of Palo Alto, and as shown on the
map entitled "Preliminary Parcel Map of the Division of Land of
Marjorie Eaton, Portion of Lot 7, Briones Map, Volume I of Maps,
page 144," attachec hereto and incorporated herein by reference.
The Council finds as follows:
. 1. Said lands have unusual parcel configuration and hilly
topography. It is desirable to qvoid more paved public
street surface in the general area.
2. Said lands contain more area than would normally be required
for creation of three {3) lots, but no reasonable or practical

configuration to create three (3) standard lots has been found.
3. The exceptions granted herein are necessary for enjoyment and
preservation of a s~bstantial property right of the applicant,
and will not be detrimental to the public welfare or injurious
to other property in the area, so long as Parcel B is developed
so as not to J.nfringe on the p.d vacy of adjacent lots.
The Council hereby 9rants an exception to width requirements
for Parcel B and an exception to access~requirements for Parcel C
both as shown on the map described above and incorporated herein
by reference, sub)ect to the following conditions; -,.

1. In accordance with applicable section of the Flood Control's
District Ordinance 59-1, any and all proposed bu1ldings,
structures, etc., shall be kept a minimum of 15 feet from the
top of existing creek high banks. Should the developer intend
to direct any site storm drainage into the channel, cross the
creek with utilities or install a road crossing, plans should
be sent to the City Engineer as well as to the Flood Control
District office for review and issuance of a~y necessary permits.
2. In order to provide minimum fire protection, an additional fire
hydrant shall be placed in front of the existin~ Eaton resi-
dence on Parcel A, adjacent to Old Adobe Road.
3. Fifteen feet of width of the access road to Parcel c shall be
paved and designed to support a·· truck loading of 33,000 pounds.
4. The owner shall pay in full or segregate Bond Series MD", the
assessment for "Old Trace Road, et ~l", PrQject No. 64-04.
s. All new electric, telephone, and utility lines shall be
installed underground.
6. The owner is to furnish evidence of payment of all due City
and County taxes.
7. A final parcel map shall be submitted in accordance with
Chapte= 21.32 of the Palo Alto Municipal Code.
8. The building setback line for Parcel B shall be established
on the Parcel Map, such line being an easterly extension of
the southern Weidman property line to intersect with the
Connenberg property.
