RESOLU'rION OF THE COUNCIL OF THE CITY OF PALO ALTO
DELEGATING AUTHORITY TO DETERMINE DISABILITY FOR
RETIREMENT PURPOSES TO THE CITY MANAGER AND DIRECTOR
OF PERSONNE~ SERVICES
WHEREAS, the City of Palo Alto is a contracting agency of
the Public Employ6es' Retirement System; and
WHEREAS, the Public Employees' Retirement Law now requires,
among other things, that the contracting agency determine "·hether
its employees classified as local safety members are disabled,
and if so, whe-=.her such disability is industrially caused, the
effective· date of any retirement therefor, and, further, whether
a local safety member retired for disability may be reinstated
to employment; and
'·rnEREAS, the Council of the City of Palo Alto has recGived
legal advice that the authority to make such determination~ may
be delegated to the City Manager and Director of Personnel
Services, or either of them;
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as· follows:
SECTION 1. The Council hereby delegates to the City Manager
of the City of Palo Alto and the Director of Personnel Services
of the City of Palo Alto, or either of tbem, the authority to
make any and all dP-terminations under Section 21023.6 of the
-Government Code of the State of California, as the same may be
amended £..:om time to time, or successor legislation, on behalf of
the City of Palo Alto, and to certify such determinations and
all other necessary information to the Public Employees' Retire-
ment System.
SECTION 2. The City Manager of ~1e City of Palo Alto and
the Director of Personnel services of the City of Palo Alto,
