PROJECT NO. 71-80 RESOLVED, by the Council of the City ot Palo i\lto, California, WHEREAS, on A:.Jgust 20, 1973, thi.is Council adopted its Resolution ot Intention No. 4812 to order the construction of sidewalk, cross- walks, pavement, street lighting, street signs, landscaping and beautification irnprcv~~ents, relocation of storm drain catch basins and traffic signals and controls, replacement or luminaires, and all auxiliary work in said City, all as more particularly described and set forth in said Resolution ot· Intention; NOW, THEREFORE, the Clerk of this City is hereby directed to publish once a ~eek for two weeks in the Palo Alto Times, a news- paper publishe~ and circulated in said City, a notice inviting sealed proposals or bids for the construction and ins'tallation of said improvements, and referring to the plans and specifications on !"ile in the off"lce of said Clerk, the .first publication of which notice shall be at least fourteen (14) days prior to the time fi~ed for opening bids. All propc:als or bids shall be accompanied by cash, cashier's or certified check payable to the order of the City Clerk amounting to ten percent of the ~ld, or by a bond in aeid amount and payable to said Cle~k signed by the bidder and a corporate surety or by the bidder and two sureties who shall justify before any officer compe- tent to administer an oa~h, in double said amount and over and above all statutory exemptions. The amount so posted shall be forfeited to said City in case the bidder depositing the same does not, within fifteen (15) days after written notice that the contract has been a~arded to him, enter into a contract with the City. • . I. , • .• • It is hereby determined that in the event the contractor, conn tracting owners included, does not complete the work within the time limit specified in the proposed contract or within such further time as this Council shall have authorizad, the contractor or contracting owners, as the case may be, shali pay to t.he City liquidated damages in the amount of two hundred fifty Dollars ( $ 250.CO ) per day for each and every day's delay in finishing the work beyond the completion date specified in said contract. Additional provisions with regard to said time of completion and liquidated damages are set fortt. in the specifications, which provisions are hereby referred to and incorporated herein by reference. Said sealed proposals or bids shall be delivered to the City Clerk on or before 3 •00 o'clock ...f..·M· on the 23rd day of ~ January , 1974, said time being not less than fourteen days from the time of first publication of said notice.
