RESOLUTION OF THE COU~CIL ('tt· THE CITY OF PALO ALTO
AMENDING O:::tDINANCE NO. 2665 TO CHANGE THE DEVELOP-
MENT PLAN APPI.YING TO THE P-C DISTRICT AT 3801 EAST
BAYSHORE ROAD
WHEREAS, on July 24, 1972, the Council passed Ordinanco No.
2665 changing the zoning of certain property known ~~ 3801 East
Rayshore Road from L-M-1-D tc· P-C and approving the Development
F l~m and Deve loprnen t Schedule therefor; and ~
WHEREAS, ti:.e applicant has requested an ar.\E!ndme~t to the
P-c plan to allow the replacement of old kennel facilities
(scheduled to be removed) with an fndoor recreational facility,
to be locatad between tbe new kennel and East Bayshore Road; and
WHEREAS, said change o!" the r-c Development Plan has b;len
fclind to b~ within the public interest, safety, convenLence,
and genera:!. welfare, and the sa:r.e will have no significant en-
vironmental impact;
·~ow, THEREFORE, the Council of the City of Palo Alto does
Rl3SOLVE ea follows:
SECTION 1. Ordinance No. 2~65 ~s nereby amended to add a
n~~ Section 3 thereto to read as follows:
"SECTION 3. The diagram attached hereto entitled
"Exhibit 51 I~ incorporated herein by reference. Said
diagram, being the proposed Development Plan modification
for the portion of the property located between the new
kennel facilities (approved under Section 2 hereof) and
East Ba~shore Road, is approved pursuant to Section
18.68.070 of the Palo Alto Municipal Code, subjec~ to
the following conditions:
1. Use: !ndoor hamdball, racquetbal t, and other indoor
court games and relate& facilities open to ~· general
public.
2. Improve·ments: L....ndscaping, off-street parkin9, drive-
ways, the structure and all other improvements shall
be completed substantially as ahown on the approved
development plans for both the recreational f~cility
and the boardinq kennel prior to use or occup•ncy
of the premises.
3. Siqns and buildinq colors shall be reviewed and approved
by the Plannln9 Commissio~1 pr1..:"1r to start of conatruction.

4. Comelianc~: Compliance with all applicable codes and
ordinances and with the requirements of the City Director
of Public Works and the General Manager of the County
of Santa Clara Flood Control Water District."
SECTION 2. Original Section 3 of Ordinance No. 2665 is
hereby renumbered "Section 4" and amended to rer'ld as follows:
"SECTION 4. The Development Schedule for the subject
property shall be as follows:
1. Start of construction within one (1) year of City
Council approval.
2. Completion of all construction and a~velopment within
two (2) years of start of construction for the new
kennel facilities and within one (1) year for the
indoor recreational facilities."
SECTION 3. Original Section 4 of Ordinance No. 2665 is
hereby renumbered "Section 5."
SECTION 4. All othe= provisions of Ordinance No. 2665 shall
remain in full force and effect as originally adopted.
