RESOLUTION OF THB COUNCIL OF THE CI'!'Y OF PALO ALTO
APPROVING A TENTA.TIVE CONDOMINIUM SUBDIVISION FOR
PROPERTY LOCATED AT TH£ NORTHERLY-CORNER OF SAN ANTONIO
AVENUE AND ALMA STREET AND GRANTIUG EXCEPTIONS FROM
LOT WIDTH, DEPTH, AREA AND FRONTAGE REQUIREMENTS,
SUBJECT ?0 CO~DITIONS
WHEREAS, 3.9 acres of property previously zoned P-C, des-
cribed as a portion of Lot 8, J. J. Morris Real Estate Company's
Subdivision at the northerly corner of San Antonio Avenue and
Alma Street in the City of Palo Alto, more qern~rally known as
4295 Alma Street, i~ proposed to be divided into 27 condominium
lots; and
WHEREAS, each lot will have frontage on a publicly deqicated
street and individual ownershi~ of each lot will include the unit,
the land beneath it, and the yards around it; and
. WHEREAS, 26 of the proposed l~ts will be substandard in
either width, depth c--.:..· area, requirir-.y an exception from the
requirements of Section 21.20.110 of the Palo Alto Municipal
Code; and
WHEREAS, Lots 22 and 23 will have double street frontage,
requiring an exception from the requirements of Section 21.20.140
of the Palo Alto Municipal Code;
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. The Council finds that there are special
conditions affecting the property due to the dimensions and
geometry of the existing parcel; that the exceptions granted
herein are necessary for the preservation and enjoyment of

a substantial property right of the petitioner; and that the
except~ons granted herein will not be detrimental to the public
welfare or injurious to other property in the territory in which
this property is situated. The Council further finds that
granting of the proposed subdivision will have no significant
environmental impact.
SECTION 2. The Council hereby approves the Tentative
Condominium Su0division Map (11 The San Alma") titled "ownership
Plan", shown on the map attached hereto and incorporated herein
by r6ference (granting exceptions to Section 21.20.110 of the
Palo Alto Municipal Code relating to minimum lot size and dimensions
and Section 21.20.140 relating to interior lots having double
frontage), subject to the following conditions:
1. The prc;posed "Hemlock Court" and "San Alma Drive 11 shall
be conveyed to the City for street and public utilities
purposes.
2. The subdivider shall construct a 4-foot concrete sidewalk
along one side of the proposed streets ~s indicated on
the plans, and a concrete curb and gutter on both sides.
3. Abandoned driveways shall be replaced with standard curb,
gutter and sidewalk to match existing.
4. The subdivider shall suppl:'.r· and plant street trees along
Alma Street and San Antonio Wa~l of the type approved by
the Parks Department.
S. The subdivider shall construct a complete drainage system
which will tie into the City's drainage system. No
surface drainage over sidewalk will be permitted.
6. The subdivider shall construct a perimeter sound baffle
fence/wall at the rear and/or sides of those lots which
front on Alma Street and San Antonio Way to provide sight
and sound protection from the high density-traffic on
these two streets. At the intersection of San Alma Drive
and San Antonio Way, the baffle fence/wall shall1 be so de-
signed as to allow adequate visibility to traffic on both
streets.
7. The stopping sight distances at the horizontal curves on
the San Alma Drive are inadequate. The'subdivider shall
install double yellow striping and signs where required
by the City Traffic Engineer.

8. The subdivider shall submit proposed improvement plans
and su~porting calculations to the Enginearing Department
fc~ ~pproval prior to the approval of the final map by
the City Council.
9. A soils report has been submitted by Terratech Company.
The recomroendatior~ in this soils report are to be
followed in the construction of this subdivision an~
therefore are incorporated into this report by reference
as a c0ndition of final approval.
10~-A portion of ~he proposed site was previously a gasoline
station. P£ior to any development on this site, sub-
divider shall rel'TIOve or inert all buried gasoline stor~ge
tanks and appurtenances.
11. The names of Hemlock Court and San Alma Drive are pro-
posed for the streets. It is recommended that these
names be forwarded to the Finance and Pul:-lic Works
Committee for approval. -
12. The recommendations of the Fire-Department ~e as follows:

Street widths are below standard and turning radii
meet the minimum requirement for fire apparatus
provided no cars ~re parked on streets. Because of
this, it is recommended that no parking bA per-
mitted along San Alma Drive and the Hemlock Court
extension, except in specified parking areas which
will be determined by the Fire Departmt.~t a...-1d the
City Traffic Engineer.
Overhead clearance of 13 feet minimum shall be
maintained over all roads.
13. ~ ~mergency access off Al.Ina Street shall be provided
a!-.-:i shall have a clear unobstructed opening of between
15-20 feet in "open" position. This may be a "crash type"
gate, drive over stanchions or other type device which
will prevent a day-to-day use by the residents yet permit
emergency use by fir~ apparatus as needed.
14. The subdivider shall execute an agreement to construct
at his expense all public impro~1eme:.1ts including, but
not limited to, streets, sidewalks, curbs, gutters and
all utilities as der.errnined by the City~ Prior to
approval of the final map, the subdivider shall also-
execute a surety bond to guaran,tee completion of said
improvements as raquired by sections 21. 24 .170 ·and -
21.24.180 of the Palo Alto Municipal Code.
I 15. All new electric, telephone and other utilities shall be
installed underground. _
16. All work shall be done in accordance with City of
Palo Alto Standard Specifications.
17~ The subdivider shall provide evidence of payment of all
due city and county taxes.

18. A final map sha" -_ be filed in conformance with Section
21.16 of the Palo Alto Municipal Code and Article 5 of
the State Subdivision Map Act.
