A RESOLUTION OF DETERMINATIO~:, UNJ)ER DIVIS IO~ 4
OF THE STREETS AND HIGHWAYS CODE, TO PROC&~D
WITH PROCEEDINGS FOR XMPROVEMENTS
DOWNTOWN BEAUTIF::CATION AND LIGHTING.

RF.SOLVED, by the Council of th~ City of Palo Alto, California,
that
WHEREAS, in accordance with ~he order of this c~unc11, e report
has been filed with this Council pursuant ~Q Division 4 of th~_streets
and Highways Code fer the construction .jf the following public im-
provements in and for said City:

The improving of University Avenue from Alma Street to Webster
Street by the planting of trees in tree islands in tne parking
area, together with flowering_ ~hrubs, perennials anl~ annuals,
wit~ adJacent planting areas, and an automatic clock-controlled
1rrigatior1 system; expansion of sidewalk areas at the roar cor-
ners of the cross-street intersections of Emerson Street,
Bryant Street, Waverly Street and Cowper Street,-and th"? con-
struction of walks, ramps:s--benches, trellises with concee.led
lighting, newsracks, t~ash containers, newspaper and bicycle
-racks; the construction of a brick strip next to the curb ·
along the-.street !rontage between intersections; the construc-
tion of concrete crosswalks •1th scored pattern at the inter-
--sections of Emerson Stre~t, Bryant Street, Waverly Street and
Cowper Street, with repaving of the s·treet areas bounded by
the crosdwalks and relocation of storm drain catch basins and
piping; the construction of a ntw street lighting system,
including new poles and luminaires; relocation of traffic
signals and controls; and new street signs.
The improving of Lytton Avenue and Hamilton Avenue from Aliil&.
Street to Tasso Street, High Street, Emerson Street, Ramona
Street, Bryant Street, Waverly Street, and Cowper Street from
Lytton Avenue to Hamilton Avenue, Florence Street, Kipling
Street and Tasso Street from Lyt.ton Aven•ie to University
Avenue, by,the planting of trees within the sidewalk strip
and the r~placement of existing luminaires to increase and
improve the lighting level.
The acquisition of all rights and the construc+.ion and recon-
struction of all improvements auxil:ary to any' of the above
and necessary to coJDplete the same.
WHEREAS, Monday, the 15th day of October, 1973, at the hour of
7:30 o;~lock P.M. in the Council Chambers, Civic Center, Palo Alto,
California, were fixed by this Council as the time and place for
hearing upon said report; and notice of said hearing has been duly

given to all persons interested in the manner and for the time pro-
vided by law, as appears from the affidavits and certificates on file
with the City Clerk;
WHEREAS, this Council determined that said report should be heard
before this Council, it being the legislative body of said City, and
at a~id hearing on the report, the report, except as to the map, plat
or diagram, and the assessed valuations, true valuations and estimated
assessments upon each parcel of land, was read before protests were
considered; and
~FAS, all persons interested desiring to be heard were fully
heard, and all oral protests or objections made at the hearing to the
ordering of the things propo~ed to be done, and all written protests
to th2 ordering or said things or relating to .the regular! ty or suf-
ficiency of the proceedings, setting forth the irregularity or defect
to which objections were made, and which were filed with the Clerk of
this Cit.y at or before the time fixed for the hearing, were fully
heard and considered by this Council;
NOW, THEREFORE, IT IS ORDERED, as follows:
l. That sa.1d improvements con.stitute a single comprehensive
scheme for the construction of said improvements as described in
the Resolution _of Preliminary Determination for these proceedings
heretofore adopted by this Council on August 20, 1973.
2. That the owners of more than one-half of the area of the
property to be assessed for the improvements have not filed with the
Clerk of this City at or before the t~me fixed for said hearing, or
at all, written protests or objections to the ordering of the things
proposed to be done, contained in said report.
3. That the owners of more than one-half of said area to be
assessed have not, either orally or in writing, protested or objecte1
to the ordering of said things proposed to be done, and that each
and all of said protests are hereby ,· ·:'!rru~ed.

4. That said report and proceedings heretofore had thereon or
thereror are valid and fully conform with the provisions of Division
4 of the Streets and Highways Code, and all protests in wri·~ing re-
latir~ to the regularity or sufficiency of the proceedings, filed
with said City Clerk at or before the time fixed for said hearing,
are hereby overruled.
5. That the public interest, convenience and necessity require
the improvements set forth in said report, that said proposed project
is feasible and that the lands to be assessed therefor will be able
to carry the burden of such proposed assessments, and the limitatio~s
on the amounts of the assessments provided for in said Division 4_
may be disregarded, both with respect to limitations on the district
as a whole, and as to the limitations on individual, specified
assessments.
6. That the lands to Qe specially assessed to pay the costs
and expenses of said improvements are all as shown on the diagram of
th~ proposed assessment district, which is a part of the report of
the Director of Public Works of this City.
7. That proceedings for the construction of said improvements
will be had pursuant to the Special Assessment Inv~stigation, Limita-
tion and Majority Protest Act of 1931 and Section 13.l2.04o of
Chapter 13.12 of Title 13 of the Palo Alto Municipal Code, and the
bonds upon the unpc1d assessments will be issued pursuant to Bond
Plan B, Section 13.16.110 of Chapter 13 of Title 13 of said Code.
