" • • ORIGINAL RESOLUTION NO. 4818 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING A MISCELLANEOUS DIVISION OF LAND FOR PROPERTY KNOWN AS 869 LOMA VERDE AVENUE IN THE CITY OF PALO ALTO AND GRANTING EXCEPTIONS FOR LOT WIDTH FOR BOTH PARCELS, SUBJECT TO CONDITIONS WHEREAS, property described as a portion of Lot 110, c. M. Wooster Subdivision of the Clarke Ranch, in the City of Palo Alto and more generally known as 869 Loma Verde Avenue, consisting of 19,018 square feet, is proposed to be divided into two parcels, Parcel A consisting of 9,889 square feet a.&d Parcel B consisting of 9,128 square feet; and WHEREAS, although each proposed parcel would have 60 feet of frontage on Loma Verde Avenue, the width of each parcel at the rear setback line would be approximately 58.58 feet, thereby lacking less than one and one-half feet of width to meet the minimum width requirement of section 21.20.110 of the Palo Alto Municipal CodeJ and WHBREAS, each proposed parcel would exceed the minimum lot area requirement of 6,000 square feet by more than SO percent1 NOW, THEREFORE, the Council of the City of Palo Alto doe• RESOLVE as followss SECTION 1. The Council finds that there i• sufficient land contained in Parcel A and Parcel B to meet all requirements of the Palo Alto Municipal Code for a miscellaneoua division of land and that there are special conditions affecting the pro- perty due to-the shape of the entire parcel, to the fact that the area of each propoaed parcel will be far in exceas of the required minimum, and to the fact that the minimum width requirement i• not met by le•• than one and one~half feet. • • The Council further finds that the exceptions granted herein are necessary for the preservation and enjoyment of a substantial property right of the petitioners and that the exceptions granted herein will not be detrimental to the public welfara or injurious to other property in the territory ih which this property is situated. SECTION 2. The Council hereby approves a miscellaneous division of land into two parcels, designated as Parcel A and Parcel B, for property known as a portion of Lot 110, c. M. Wooster Subdivision of ·the Clarke Ranch, and more commonly known as 869 Loma Verde Avenue in the City of Palo Alto. Said ~properties are shown on the map attached hereto and incorporated by reference herein. SECTION 3. The Council hereby grants exceptions fo~ the width of Parcel A and Parcel B to be approximately 58.58 feet plus or minus at the rear setb~ck line. As the ndnimum sideyard required for R-l zoning is 6 feet from the property line, the existing garage on Parcel A will have only a 4-foot setback with respect to the new lot line. Therefore, the Council also grants an exception to allow the existence of the garage structure at this location as shown on the map. These exceptions are g~~nted subject to, and on condition of compliance with, the eight (8) · conditions set forth as follows: l. Prior to the demolition of the house on Parcel B, the subdivider shall comply with the provisions of Section 16.04.075 and Section 16.04.077 of the Palo ~lto Municipal Code. 2. As the minimum sideyard requirements for R-1 . zoning is 6 feet from the property line, the existing shed on Parcel A will be in violation with respect to the new lot line. Therefore, said shed on Parcel A shall be removed as shown on the map attached hereto. 3. The existing garage on Parcel A shall be removed within a period of five years from effective date of this resolu- tion. 4. The suhdivider shall remove and replace cracked or broken sidewalk, curb, and gutter to the satisfaction· of the Street Superintendent. -2- • • s. If the existing buildinqs on Parcel A are to remain, ~ new water service shall be installed. 6. The existing driveway entrance shall be re- moved and replaced with curbing in accordance with the standard specifications of the City of Palo Alto. A new separate driveway shall be provided for each parcel. 7. The subdivider shall provide evidence of payment of all due city and county taxes. a. A final ~arcel map shall be filed in conforir.~nce with Chapter 21.32 of the Palo Alto Municipal CoCl.e and the Subdivision Map Act of the State of California.
