RESOLUTION NO. 41H
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
ORDERING THE VACATION OF AN EASEMENT IN LOS ARBOLES
ADDITION NO, 2 -TRACT 5371
WHEREAS, the Council of the City of Palo Al~o on June 18,
1973, did pass Resolution No. 4774 declaring its intention ·to
order the vacation of an easement in Los Arboles Addition No. 2,
Tract 5371, as shown on a map entitled EXHIBIT "A" and as described
in EXHIBIT "B," both attached hereto and by reference made a part
hereof and both on file with the original of said Resolution No.
4774 in the Office of the c.ity Clerk; and
WHEREAS, the Council has received and considered the action
of the Planning Commission concerning said easement; and
WHEREAS, pursuant to said Resolution No. 4774, a public
hearing on this matter was duly noticed and held on July 16, 1973:
and
WHEREAS, from all of the evidence submitted, the Council
finds that the re~uirements of Title 5, Division l, Chapter 2,
Article 5 of the GoverllJIJent Code of the State of California (com-
mencin9 with Section 50439 thereof) have been substantially ful-
filled and that said easement is unnecessary for present or
prospective public purposes or use;

SECTION 2. The City Clerk hereby is authorized and directed
to cause a certified copy of this resolution to be recorded in
the office of the County Recorder of the County of Santa Clara,
State of California.

DESCRIPTION OF EASEMENT TO BE VACATED:
All of that certain real property situate in the City of Palo Alto,
County of Santa Clara, State of California, as described in the
Gront Deed from A. T. Cook, also known as Albert Thatcher Cook,
and Margaret E. Cook, his wife, to the City of Palo Alto, date~
July 24, 1959, and recorded on August 5, 1959, in Book 4503 of
the Official :Records at pa9e 395, Santa Clara County Records, and
more particularly described as follows:
An easement 10 feet in width for Storm Drain
purposes, the Southwesterly line of which is.
more particularly described as follows:
Beginninq at the point of intersecticn of the
center line of Loma Verde Avenue with the South-
westerly line of Lot 81 as shown upon that certain
map entitled, "Map of the c. M. Wooster Company's
Subdivision of the Clarke RanchM, which map was
filed for record in the office of the Recorder of
the County of Santa Clara, State.of Californiar
thence running along with said southwesterly line
of Lot 81, South 52°00' East 30.73 feet to a point
in the southeasterly line of s~id Loma Verde Avenue,
said point being the true point of beginning of
this desc~iptioni thence continuing along aaid
Southwesterly line of Lot 81, South 52°00' Bast
306.19 feet to a point which is distant, North
52°00 1 West 121.12 feet from the Southeasterly·
corner of said lot 81.
