' ~ ~ • ... 1 ORIGINAL RESOLUTION NO. 4774 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO DECLARING ITS INTENTION TO ORDER THE VACATION OF AN EASEMENT IN LOS ARBOLES ADDITION NO. 2 -TRACT 5371 AND SETTING A PUBLIC HEARING THEREON The Council of the City of Palo Alto does ~SOLVE as fol- lows: SECTION 1. It is the intention of the Council of the City of Palo Alto, subject to certain conditions set forth hereinafter, to vacate an easement acquired for storm drain purposes under and u~on that certain property situate in the City of Palo Alto, County of Santa Clara, State of California, as set forth''>n a map entitled EXHIBIT "A", and as described in EXHIBI~ "B", both attached hereto and by reference made a part hereof. SECTION 2. Monday, the 16th day of July, 1973, at 7:30 p.m. in the council Chambers, Civic Center, Palo Alto, California, is set as the time and place of hearing where and when any person having an interest in such proceedin~a may appear and be heard either for or against such vacation. SECTION 3. ·It is.further the intention of the Council that - vacation of the preaent easement ia to ~ conditioned on the affected owners' obtaininq and furnishin9 to the City new ease- ments and relocation-of-the storm drain concerned within aaid new easements, at their own expense, subject to the approval of the Public Works Departinent·, and payment of all other cost• related to this vacation~ SECTION 4. All the procee4inga for the vacation of aaid easement shall be cbnducted pursuant to Title S, Division 1, Chapter 2, Article 5 of the Government Code of the State of California (coanencinq with Section 50430 thereof). •, •, .. ,!t •• SECTION s. The City Engineer is directed to post notices of this intention to vacate conspicuously along the easement to be vacated as described in Section l hereof at least ten (10) days before the hearing, postinq them no more than three hundred (300) feet apart, but there shall be at least three (3) notices posted. Such notices shall state the passage of this Resolution of intention and the time and place of he~rinq. -SECTION 6. The City Clerk is directed to publish a copy of this resolution in the Palo Alto Times once each week prior to ----- the date of hearing.
