RESOLUTION NO. 4722
RESOLUTION OF THE COUNCIL OF THE ~ITY OF PALO ALTO
URGING THE GOVERNOR TO DESIGNATE THE BAY AREA SEWAGE
SERVICES AGENCY AS THE AREA~·'1IDE PLANNING AGENCY FOR
THE SAN FRANCISCO BAY AREA
WHEREAS, 1972 amendments to the Federal Water Pollution Oontrol
Act (Public Law 92500} provide tt.at the Gov~rnor of each State shall
identify areas whir.h have substantial w~ter quality control problems
and designate a single representative organization within those areas
to develop an effective areawide waste treatment management plan for
such areas; and
WHEREAS,· the Legislature of the State of California has deter--
mined, as a result of the San Francisco Bay-Delta Study of 1969 that
a serious w3ter quality ::ontrol problem does .;_,xist in the nine-county_
San Francisco Bay Area; and in 1971 created the Bay ~rea Sewage Services
Ag~ncy (BASSA) by adopting Division 9, Sections 16000 to 16832 of the
California Water Code; and
WHEREAS, BASSA is mandated by the Legislature to develo~ and adopt
a regional water quality management plan for the San Franclsco Bay
region by January l, 1974, and such plan must "satisfy the basic con-
cepts of the water quality and water reclamation elements of ally metro-
politan or regional plan adopted by the areaswide agency designated
by the federal or state government to prepare s11ch a plan": and,
WHEREAS, BA.JSA has been given the authority to implement its
r~9ional water quality managment plan by exercising veto power over
the plans of local and subregional agencies which do not con~orm with
the. regional plan, and also by acquiring, constiucting and operating
water quality control facilities when a local agency or group of such
agencies eith~r requests such action or is unable or unwilling to
implement the regional plal'I; ;:md
WHEREAS, BASSA is governed by a 21-member board of trustees com-
posed of elected officials fr~ counties, cities and s~ecial di~tricts
operat~.tLg water quality control facilities, with the trustees being
appointed on a proportional basis from the nine Bay Area counties;
and

WHEIU!:AS, !ASSA is now an operating entity, has recently aµ-
pointed a gen~ral manager, and is proceeding with the Dreparation of
a regional water quality management plan; and
WHEREAS, designatinn cf BASSA as the waste treatment ma~.:;.geme.lt
planning agency for the Bay Area will reinforce the legislative man-
date, prevent wasteful duplication of planning in this field, stimu-
late and make possible maximum input into regional water quality
management planning by local agencies in the water pollution control
field, and provide for the optimum in continuity between planning and
implementation1
NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE
dB follows:
SECTION l. That it urges the Governor of the state of California
to take immediate action under th~ 1972 amendments to the Federal Water
Pollution Control Act and name the Bay Area Sewage Services Agency as
the a~eawide planning agency in the water quality control field for the
San Fra~cisco Bay region; and
SECTION 2. That the City Clerk is directed to send copies of this
resolution to the Governor of the State of California, the State Water
Resources Control Board, to the Bay Are.a Sewage Services Agency and to
the State legislators from San Clara Cou.~ty.
