HomeMy WebLinkAboutRESO 4703>f .. ·-• RESOLUTION NO. 4703 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING A TENTATIVE SUBDIVISION FOR PROPERTY LOCATED AT THE INTERSECTION OF MIDDLEFIELD AND LOMA VERDE, GRANTING AN EXCEPTION 'l'O PERMIT A REAR LOT, AND ESTABLISHING SIDE AND REAR YARDS THEREFOR, SUBJECT TO CONDITIONS WHEREAS, land located in the City of Palo Alto at the corner of Loma Verde Avenue and Middlefield Road, consisting of approximately 6.14 acres, contains more than eno1 1gh land for 30 single family dwellings' and WHEREAS, it is necessary and desirable to restrict vehicular access to Middlefield Road, thus necessitating the creation of a . , ._cul,""'.'de;-sac s_treet., in order to permit full development of said proper'by; and wHEREAS, development of this property without the creation of a rear lot would result in unusual lot configurations or a loss of housing in the City; NOW, THEREFORE, the r.ouncil does RESOLVE as follows: SECTION 1. The Council hereby approves the subdivision as shown on the "Tentative Map, Being a Resubdivision of Portion of the. c. M. Wooster Company's Subdivision of the Clark Ranch, Palo Alto, California," dated January 1973, and finds that development of this property with a long curved cul-de-sac is a special circumstance or condition affecting the property, that the granting of exceptions in connection therewith is expressly author::.z:ed by Section 21·. 20 .110 of the Palo Alto Municipal Code, that the exception requested herein is necessary for the pre- servatio~ and enjoyment of a substantial property right of the owner, and that the grantinq of this exception will not be detrimental to the public welfare nor injurious to other property in the ~erritory in which the property is situated. -1 - .. , ., .. • • SECTION 2. The Council hereby approves the creation of Lot No. 10, as shown on the map described in Section 1 above, as a rear lot and establishes the setback from the northeasterly boundary (closest to the lands of Fukui) to be 30 feet, and the setback from the southeasterly boundary (nearest Lot No. 23 of Tract 2J96) to be 13 feet. SECTION 3. The Council hereby ~rants a variance for the sideyard setback from Middlefield Road for Lots No. l and No. 22 to be 20 feet, whereas 24 feet are otherwise required. SECTION 4. Approval of this subdivision, the exception, and the variances granted herein is subject to the following conditions: l. The 15 ft. access to Lot No. 10 shall have a 12 ft. paved surface and a 13 ft. overhead clearance. 2. The proposed new street shall be dedicated to the City by a se~~~ate grant· deed. 3. The developer shall deed a one foot non-access strip along the side of Lots 1, 22, and 24 along Middlefield Road. 4. The developer shall construct all public improvements subject to the requirements of the City Engineering Department. 5. The developer shall submit proposed improvement plans and supporting calculations for review prior to approval of the final map by the City Council. 6. The recommendations prop~sed in the preliminary soils report by United Soil Engineering of Santa Clara, as well as those which appear in the final soils report, are to be followed in construction of this subdivision and therefore are incorporated into this resolution by reference as a condition subsequent to tentative approval. 7. The developer shall execute an agreement for performance of all required public improvements and a surety bond to guarantee completion of said improvements prior to approval of the final map as required by Sectiom 21.24.170 and 21.24.180 of the Palo Alto Municipal Code. a. All broken sidewalk shall be repaired. Abandoned drive- ways shall be properly removed, and curbs and gutter reconstructed. 9. All new electric, telephone, and utility lines shall be installed underground. -2 - I I. •• • 10. All work shall be done in accordance with City of Palo Alto standard specifications. 11. All utility connection costs shall be paid prior to recording of the final map. 12. The name of the proposed street shall be subject to the approval of the Public Facilities Naming Conunittee. 13. Owners shall provide evidence of payment of all due city and county taxes. 14. A final subdivision map shall be ~ubmitted in accordance with Chapter 21.16 of the Palo Alto Municipal Code and Article V of the California Subdivision Map Act.
