The Cou ncil of the City of Palo Alto does RESOLVE as follows:

are plan ned and loc ated in a manner which will be m ost co mp atibl e
with th gr eatest public good a nd the le ast private injury, and
all of such acquisiti ons are located within the te rritorial limits
of the City of Palo Alto.
Secti on 4. That the Co uncil of the City of Palo Alt o hereby
declares its intention to acq ui re title in f ee simple to P arcels
1 and 2 desc ribed in Sectio n 2 of this resolution under eminent
domain proceedings, and the City Atto rney of the City of P alo Alto
and the law firm of Messrs . Wilson, Herzfeld, Jones and Mo rt on,
employed far that purpose, are hereby directed to institute a nd
conduct to conclusion an action in eminent domain for the acquisi-
tion of said pro perty in fee simple, and to take such action as is
necessary therein.
Section 5 The City Ma nager is h ereby authorized and di re cted,
as an a ltern ative to trial of any action in eminent d om ain initiat ed
her eun def; to purchase for such reasonable sum as he m ay deem
appro pria te, an option on the real pr operty described ab ov e, said
optio n to gra nt to the City the exclusive r ight and option to
purchase sa id parcels.
Se ctio n 6. The City Mana ger is further authorized to spend
from general funds of the City heretofore appropriated for such
purpo ses su ch monies as are necessary and in his opinion may
co nstitute the fair ma rket va lue of said pa rcels ba sed upon
appr aisa ls of duly qu alified and competent rea l estate appra isers.
