RESOLUTION OF THE COUNCIL OP THE CITY OF PALO ALTO FINDING
AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY OF
SAID CITY,RMIU/KE, FOR PUBLIC USE FOR PUBLIC BUILDINGS AND
MOUNDS, CERTAIN LAND LCCATRD IN THE CITY OF PALO ALTO,
COUNTY OF SANTA CLARA, STATE 02 CALITQ!K A, :IN . DIE VIC/N TY

The Cou ncil of the City of Palo Alt o does RESOLVE as f ollows:

found and, determined, and he reby does find, determine and declare,
tha t the public interest and nec essity requir e the acquisiti on,
construction and completio n by the City of Palo Alto of the fol.-

lowing public impr ovement, to wit:, public buildings and gro unds
including but not 'Limited to the civic center enlargement.
Sec iol 2 That the taking in fee simple of the p roperty

described as follows is necessary for such improvement:
BEGINNING at rrhte point of interse ction of the N ortherly

line of Newell Roa d (as widened) ; thence northerly along

of Palo Alto and the law firm of Messrs, Wils on, H erzfeld, J ones
a nd Mort on, empl oyed f or that purp ose, are hereby direct ed to
institute and co nduct to confusion an action in eminent domain
for the acquisition of s aid property in fee simple, and to t ake
such acti on as is necessary the rei n.
Section 5 The City Manager is hereby a utho rized and directed
as an alternative to trial of any actio n in eminent dom ain initiated
hereunder, to purchase for such reasonabl e sum as he may deem
a ppro priate, an option on the real property described abov e, s aid
option to gra nt to the City the ex clusive right and option to pur-
chase said pa rcel.

from gen er al funds of the City heretofore appropriated for such
purpo ses such mon ie s as are necessary and in his opinion m ay,
constitute the fair market value of said parcel based upon. appraisals
of duly qualified a nd competent real estate appraisers .
Section 7 The City Clerk shall certify to th e adoption of this
r esolution by a vote of two-thir ds of a ll of the members of th e City
Council.

of the City of Pa lo Alto is fifte en and that the fo rego ing resoluti on
was adopted by a vo te of more tha n two-thirds of a ll of the members
of said Council at its mee ting held on the 12th da y of August, 1963,
