RESOLUTION NO. 3658
A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST
AND NECESSITY REQUIRE THE ACQUISITION OF BASEMENTS
FOR SEWER AND WATEP FACILITI ES AND THE TAKING OF
IMMEDIATE POSSESSION THEREOF
PORTIONS OF FOOTE:ILLS ANNEXATION NO . 3
SANITARY TRUNK SEWE RS AND WATER SUPPLY SYSTEM
PROJECT NO. 62-8
RESOLVED, by the Council of the City of Palo Alto, C alifor nia,
that
WHEREAS, pu rsuant to Resolution of I nte ntion N o. 3633 adopted by

this Council on May 28, 1963, this Cou ncil did, on Augu st12
1963 a dopt its Resolutio n No. 3657 ordering acquisitions a nd
improvements;
WHEREAS, said Resol ution of Intention, and said proce edi ngs were
ha d an d taken pu rsuant to Article 4 of Chapter 5 of O rdi nance No. 1928,
of said City, com mon ly designated the Palo Alto Imp ro vement Procedu re
Code, a dopted April 11, 1960, as amended;
NOW, THEREFORE, IT IS FOUND, DETERMINED a nd ORDERED, as follows:
1. The public inter est and necessity req uire the acquisition,
constru ction and completion, by sa id City, of the p ublic impr ov ements.,
described in said Resolution of In ten tion and in the p roceedi ngs re-
lating thereto, and the easements an d property proposed to be acquired
described therein, an d her ein after described in Exhibit "A" hereto
attached and in corporated herein by r eferen ce, ar e n ecessary the refor .
2. The pu blic in terest a nd necessity require the taking of
immediate possession in con nection_. with the emin ent domain proceedings .
3. The public necessity r equ ir es said acquisitions and improve-
ments; said proposed a cquisitions and improv ements a re plann ed and
located in the manner which will be most compatible with the greatest
public good and the least pr ivate injur y; an d a ll of said acqu isition s
are located within the territorial limits of the City of Palo Alto.
4. The City Attorney a nd the law :fir m of Me ssrs. Wilson, Her zfeld,
Jon es & Morton, employed for that pu rpose, a re hereby dir ected to in sti-
tute an d conduct to conclusion an action in eminent domain for the

acquisition of said e asements a nd p roperty, to undertake the necessary
actio n t ocbtai n immediate possession thereof, and to t ake such action
as is necessary therein.
5. That the taking of p roperty fo r p ump statio n and water
rese rvoir sites in fee is necess ary.
6. That th e City Man ager is hereby authorized and directed, as
an alter nati ve to t rial of any action in eminent domain initiated here-
u nder, to expend f rom the proceeds of assessments and sale of ass essme nt
bon ds to be issued in said proceedi ngs, such moneys as are necessary
and in his opinion may co nstitute the fair market value of said p arcels,
ba se d upon appraisals of duly q ualifi ed a nd c ompete nt real est at e
appraisers
7. Reference is hereby made to s aid Resolution of I nte ntio n and
related proceedin gs for a particular description of said proposed acqui
sitions and improvements, on file in the office of the City Clerk of
said City.
I hereby certify the foregoing to be a true copy of a resolution
adopted by the Council of the City of Palo Alto, California, at a
meeting thereof held on the 1z day of g„1guAti 1963, by the
