A RESOLUTION DETERMINING UNPAID ASSESSMENTS
AND PROVIDING FOR ISSUANCE OF BONDS
SHERMAN AVENUE RI' AL
PROJECT NO. 62-3
RESOLVED, by the Council of tho City of P alo Alto, Californi a,
that
WHEREAS, said Cou ncil did on May 28, 1962, pass a nd adopt its
Resolution No. 3505 of Prelimi nary Dete rmi nation a nd of I nt ention
relating to the acquisition and co nst ruction of p ublic imp rovements
in said City under and pursuant to the provisions of Article 4, Ch apter
5 of the Palo Alto Improv ement Procedure Code, a nd did therein p rovid e
that serial bonds wou ld be issued thereu nder pursua nt to the p rovisio ns
of Bond Plan B of Article 3, Chapter 6 of said Code, refere nce to said
Resolu tion of Preliminar y Determination and of Intention he reby being
exprssly made for fu rther particulars;
WHEREAS, n otice of the recordation of the assessme nt and of the
time within which assessm ents ma y be paid in cash has been duly p ublish-
ed and mailed in the m ann er provided by said Code, and the time so pro-
vided for r eceiving the pa ymen t of assessments in cash has expi red, a nd
on April 19, 1963, the Su perin ten dent of Streets ha s filed with the
City Treasurer a list of a ll assessmen ts which now remain unpaid; and
WHEREAS, the Coun cil has duly con sidered said list and has deter-
mined that the same is an accura te statement ther eof;
NOW, THEREFORE, IT IS HEREBY ORDERED, as follows:
1. That the assessmen ts in said unpaid list which now remain
unpaid and the aggregate thereof, a re as shown on Exhibit " A" her eto
attached and by referen ce ma de a part her eof.
2. Tha t for a particu lar description of the lots bearing, the
respective assessmen t numbers set for th in said un paid list an d upon
which assessmen ts r emain un paid, sev er ally and respectively, reference
is her eby made to the assessment and to the diagr am recorded in the
office of the Super in tenden t of Stree ts of said City afte r confir mation
s

by said Council, the several lots represented by said assessment
n umbers being so numbe red and designated upon said di agram a nd assess-
ment as so co nfirmed and recorded, severally a nd respectively .
3. The u npaid list is in the amou nt of $72,823 .69 and bonds
shall be issued upon the sec urity of said unpaid assessme nts in the
amoun t of $72,823 .69 in acco rdance with the p ro visions of Bond Pian 33
of Article 3 of Ch apte r 6 of said Code, and unde r and pursuant to the
provisions of said Resolution of Preliminary Determination a nd of In-
tention and the proceedings the reunder duly had and taken; that said
bon ds shall be seven ty-three (73) in numbe r, shall be dated May 24,
1963, an d bear inter est from thei r d ate at the rate of not to e xceed
six per cen t (6%) per annum, and the de nomination of said bonds with
their respective n umbers and dates of mat urity are as shown on Exhibit
" B" her eto a ttached and made a par t hereof by reference .
4:. Said bonds shall be issued in series, and the unpaid assess-
men ts as shown on said list filed with the City T re asure r of said City
and determined by said Cou ncil, together with the interest thereon,
shall remain and constitu te a tru st fu nd for the redemptio n a nd pay-
ment of sa id bon ds an d of the interest which may be due thereon, which
unpa id assessments shall be taxable in annual series corresponding in
nu mber to the nu mber of series of bon ds issued, an d an ann ual prop ortio n
of ea ch assessment shall be payable in each year preceding the date of
the. maturity for each of the several bonds issued, a nd su ch proportion
of each assessment coming du e in an y yea r, together with the annual
interest ther eon, shall in turn be pa yable in in stallmen ts as the
gen er al taxes of said City on real pr operty a re payable, an d shall
be co me delinquent at the same time a nd in the same pro por tiona te
amo un ts and bear the same pr oportionate pen alties for delin qu en cy.
5. Said bon ds shall be signed by the City Cler k and City
Treasur er. The signatur e of the City Clerk ma y be engrav ed, pr in ted
or lithographed and the offlcla l seal of said City shall be affix ed
thereto. The in terest cou pons affixed thereto sha ll be signed by

said T reas ure r by his engraved, printed or lithographed signat ure; and
such signi ng and sealing of said bonds by said officers and signing of
said coupons by said Treasurer sh all constitute and be a sufficie nt and
binding execution of each and every one of said bonds and all of the
cou pon s thereof respectively. Said bonds shall be s ubsta ntially in
the form set forth in the Imp rovement Bond Act of 1915 . Said Cle rk a nd
Treasur er of said City are authorized and directed to sign s aid bonds.
6. The interest co upo ns attached to each of said bo nds and
evidencing the interest to accr ue the reo n shall be numbered consecu-
tively an d be su bstantially in the followi ng form, to -wit:
