A RESOLUTION OP PRRLININARY DWARMINATION
AND OP INTENTION TO CONSTRUCT IMPROVEMENTS
ENCINA AVENUE - PROJECT N0. 63-4
RESOLVED, by the Council of the City of Palo Alt o, Califo rnia,
that
1. Said Cou ncil does he reby prelimi narily det ermine that the
public in terest, oonvenience a nd necessity require, and that it
intends to or der the following work to be do ne and improvements to be
made, to -w it:
The remov al of existing curb gutter and sidewalk improve-
m ents along the southerly side of E ncina Ave nue f rom El
Camino Real to the easterly termi nus of Encina A venue, and
the reconstruction of new Po rtland cement conc rete curbs
and gutters along the southerly right-of-way line togethe r
w ith the con struction of base paveme nt and wearing a urfaoe
fr om the edge of the ex isting pavement to the proposed new
curbs and gu tters, and the construction of all work auxiliary
to any of the abov e an d necessary to ca rry out the same, all
for the purpose of prov idin g a wider paved street 'motion
for addition al on -street parking.
2. All of the blocks, streets an d alleys herei n me ntioned are
shown on maps of records in the office of the Coun ty Recorde r of the
County of Sa nta Clar a, State of California, a nd shall be shown on the
plans her ein r efer red to and to be filed w ith the City Clerk of this
City.
3. Whene ver any pu blic way is herein refer re d to as r unn ing,
betw een two public ways, or from or to a ny public way, the in te rsec-
tions of the public ways referred to are included to the exten t that
work shall be shown on the plan s to be don e her ein.
4. A11 of said wor k an d improv emen ts are to be con str ucted at
the places and in the particula r locations, of the for ms, sizes,
dimension s an d m aterials, and at the lines, grades an d elevations as
sho wn a nd delineated upon the plans, pr ofiles and specificatio ns to be
made therefo r, as hereinafter provided.
5. There is to be excepted from the work a bove descr ibed any of
auch work already done to line and grade and marked exce pted or shown
n ot to be done on said plan s, pr ofile s and specifica tions.

ence to which is hereby made for furtLer particulars.
10. Notice is hereby given that serial bon ds to represent unpaid
assessmen ts, and bear interest at the rate of. n ot to exceed six per cent
(6%) per annum, will be issued hereunder in the manner pr ov ided in
Bond Plan B, Article 3, Chapter 6, of Ordinance No. 192$, the Palo Alto
Impr ovement Procedur e Code, adopted by this Cou nc il on April 11, 1960,
the last insta llment of which bonds sha ll ma tur e n ot to excee d four tee n
(14) year s from the seoond day of Ju ly nex t succeedin g ten months from
their date.
6. S aid Cou ncil does hereby adopt and establish as the offi-
cial g rades for said wo rk the g rades and elevations to be shown upon
said plans, profiles and specific ations. All such grades and eleva-
tions are to be in feet and decimals thereof with reference to the
datum pla ne of the City of P alo Alto.
7. Notice is he reby gi ven of the fact that in many o ases said
wor k and improvement will bring the finished wo rk to a grade different
fro m that formerly existing, and that to said extent said grades are
hereby changed and that said work will be done to said ch anged grades.
8. The descriptions of the improvements and the termi ni of the
wor k contained in this Resolution are general in nature. All items
of work do not n eceesarily extend for the full length of the descrip-
tion thereo f. The plans and profiles of the wo rk as contained in th e
Engineer's report, shall be controlling as to the oo rreot and detailed
leeoription thereof.

11. Except as herei n othe rwise provided for the issuance of
bonds, all of said work shall be done as provided in Articles 1 and
4 of Chapte r 5 of said Code.
12. Said improvements are hereby referred to the City Engineer
of said City as the officer having charge and co ntrol of the c onstruc-
tion of public improve ments in and for said City of the kind desc ribed
here in , and being a compete nt person employed by said City for that
purpose; and said City Enginee r is hereby di rect ed to make and fil e
w ith tine City Clerk of this City a report in writing, presenting the
fo llowings
a) Plans and speciflo atio ns of the p rop osed impro vements
to be made pursuant to this Resolution;
b) En gin eer's estimate of the total c osts and e xper;e es of
sa id improvements and of the in cidental expenses in connection there with;
c) Diagr am show ing the assessment district above referred
to, and also the boundar ies and dimensions of the respective subdivi-
sions of lan d within said district as the same existed at the time of
the passa ge of this Resolution , each of which subdivisions shall be
giv en a sepa rate number u pon said dia gram
d) A proposed assessmen t of the total amou nt of the costs
a nd expen ses of the proposed improvements u pon the several subdivisions
of land within said district in pr oportion to the estimated benefits to
be r eceived by such subdiv isions, respeotively, from said im prov ements,
an d of the expenses incidenta l thereto.
13. 1r any excess shall be realised from the a ssessment it sha ll
be spent for the main tenance of said improv ements un less the Council,
shall hereafter determine that said amoun t, or any par t thereof, shall
be applied as a credit to each assessment herein.
