A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUANT TO THE PALO ALTO IMPROVEMENT PROCEDURE
CODE FOR THE ACQUISITION AND CONSTRUCTION OF
IMPROVEMENTS WITHOUT PROCEEDINGS UNDER'DIVISION
4 OF THE STREETS AND HIGHWAYS CODE
SANITARY TRUNK SEWERS AND WATER SUPPLY SYSTEM
PROJECT NO. 62-8
RESOLVED, by the Co uncil of the City of Palo Alto, .C alifor ni a,
that
WHEREAS, a written petitio n for unde rtaking proc eedi ngs pu rsuant
to appropr iate provisions of the Palo Alta Improvement Proced ure Cod e,
an d to assess the costs thereof upon the properties benefited by said
acquisition s an d improv ements, and w aiving proceedings under Division
4 of the Streets an d Highways Code, has bee n filed with the City Clerk
c'.' this City, for the acquisition and co nst ructio n of the improvements
here inafter descr ibed;
WHEREAS, the City will contr ibu te that portio n of the cost of th e
san itary sewer ma ins an d wa ter distribution mains and pump stations
which represents the cost of enlarging said facilities to provide pos-
sible serv ice to properties ou tside of the assessment district, and
the balan ce of the costs and expenses of said con templated acq uisitio ns
and impr ov emen ts are to be chargea ble upon an a ssessment district,
w hich district said Council declares to be the district benefited by
sa id a cqu isition s and improv ements, an d which is describe d as the
ex terior boundar ies of the composite and consolidate d are a of a ll par
gels of prope rty frontin g on and capable of serv ice into or from said
proposed impr ovemen ta, as shown on the map of the assessmen t district
en titled "Utilities Exten sions to Por tions of Foothills An nexatio n
No. 3", dated March 8, 1963, filed in the office of the City Cle rk,
to which reference is hereby made. Said map indicates by a bou ndary
ling the ex tent of the terr itory in clu ded in the proposed district
an d shall govern for a ll detai ls as to the exten t of the assessmen t
distr ict;
WHEREAS, said acquisitions and improvemen ts are descr ibed as follows:

(a) Sa nitary Tru nk Sewe rs
The construction of a syst em of main t runk sanitary
sewe rs, i ncluding ma nholes , wye bra nches a nd
appurtenances, to ser ve portio ns of Foothills
A nnex atio n No. 3, from the southerly termi nus of
the sanitary sewerage facilities co nst ruct ed in
Project No. 59-1 in an existing easeme nt on th e
lands of M arthens, thence conti nui ng southeeate rly,
so uthe rly a nd easterly in said existi ng ease ment
ac ross th e lands of Ma rthene a nd the lands of Lee
to the so uthe rly terminus of the existing wate r
facilities co nstr ucted in s aid P roject No. 59-1,
thence contin ui ng southe rly in easements to be
acquired .he rein across the la nds of Lee to the
lands of the City of Palo Alto, thence contin ui ng
southerly, easterly and southe rly across the la nds
of the City of Palo Alto to the la nds of Crocker,
thence meandering in a ge nerally so utherly direc-
tion across the lands of Crock er to the lands of
Da hl, thence generally westerly ac ross a corne r of
the lan ds of Dahl to the la nds of Lee, thence
con tinu in g westerly a nd southerly alo ng the la nds
of Lee to the lands of Dahl, thence easterly and
souther ly across the lands of Dahl to Page Mill
Road, then ce continuing so uthe rly along Page Mill
Road, thence con tinuing southerly in easements to
be acqu ired a cr oss the lands of Weddle and D ahl
to the lan ds of Burn s, includi ng a sewage lift
station on lands of the City of Palo Alt o, and tw o
sip ho ns an d a dosing station on the property of
Dahl, together w ith the acqu isition of the neces-
sary lands and easements therefor.
(b) Water Su pply System
The con stru ction of a water tran smission, st orage
a nd ma jor distribution system a nd appur tenances
in ea sements to be a cquired her ein from the southerly
termin us of the existin g water fa cilities constructed
in Pro ject No.. 59-1, generally sou ther ly in e asements
a lon g the la nds of Lee, then ce co ntin uing so utherly
an d easterly an d sou therly over the la nds of the
City of Palo Alto to the lan ds of Lee, thence con -
tinu in g southerly across the lands of Lee to the
lands of Da hl, then ce meanderin g gener ally ea sterly
and southerly in easements across the lands of Da hl
to Page Mill Roa d, then ce continuin g sou therly in
Page Mill Road to the lan ds of Weddle, then ce
souther ly across the la nds of Weddle to the lands
of Dahl, thence sou theasterly acr oss the lan ds of
Dahl, Ligda and Beyer to a proposed reservoir site
on the lands of Bu rns, together with the constr uction
of a booster pump sta tion a nd a 1,000,000 ga llon
reser voir an d booster station on the lands of the
City of Palo Alto, a 1,000,000 gallon reservo ir an d
bo oster station on the la nds of Dahl, an d a 1,500,000
ga llon reservoir on the lan ds of Burns, inclu ding the
.gqu isition of all lands an d easemen ts therefor.
Genera l
The ac qu isition of a ll la nds, easeme nts an d rights
auxilia ry to an y of the above and the constru ction
of a ll work a uxiliary thereto n ecessary to co mplete
the same. Easemen ts will be acquired only where
the fa cilities above described are outside of exist-
ing easemen ts and road r ights -of -way.

WHEREAS, the public int erest and con venience will be
nerved by the taking of said proceedings .
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED + .
that all of the owners of mo re than sixty pe r cent (60$) in area
of the privately -o wned p roperty subject to assessment for said
pr oposed aoquisltions and improvements who appear to be such
on the Assessor's roll on the day that said petition was filed,
or in the case of tra nsfers of la nd or p arts the reof s ubseq uent
to the date upon which the last Assessor's roll was prep ared,
appear to be such on the reco rds in the Cou nty Ass essor's office
which the Coun ty Assessor will use to prepare the next ensuing

Assessor's roll, have signed and filed with the City Cle rk a
written petition for the acquisition and oo nstruction of improve-
ments pur su an t to appr opriate pro visions of the Palo Alto Improve-
men t Procedure Code, withou t further compliance with the p ro-
vision s of Division 4 of the Str eets and Highways Code.
IT IS FURTHER FOUND, DETERMINED and ORDERED that la nds
of the City of Pa lo Alto included within the boundaries of s aid
a ssessm ent district shall not be subject to assessment.
IT IS FURTHER FOUND, DETERMINED an d ORDERED that said
proceedings for the acqu isition an d co nstr uction of said
im provem ents shall be had pu rsua nt to Ar ticle 4 of Chapter 5
of said Code, and the bonds u pon the un paid assessmen ts thereof
sha ll be issued pursuant to Bond Plan B, Article 3, Cha pter 6
of said Code.
IT I3 FURTHER FOUND, DETERMINED and ORDERED that the
pr ovisions of Division 4 of the Streets and Highw ays Code be,
an d they are hereby, dispensed with.
