ABSOLVID, by the Council of the City of Palo Alto California,
that
1. Said Council does hereby preliminarily determine that:the
pubiio in ter est, convenie nce and necessity require, and that it intends
to order the following work to:bs done, acquisitions and i mprovements
to be made, to -wit:
A) The acquiring of the following paroels of property and
the improv ing thereof by grading and the removal of existing
structur es, an d the con struction therein of pa ving, curbs, drains,
lights, fences, striping, and any buildings or structures neces-
sary for the proper operation thereof, and the making of all
aoquisitions and the contracting of a11.i prove ments and the
performance of all work auxiliary thereto and naeessary to com-
plete the same aa:off-strr 1, motor vehicle parking facilities:
a) A parcel of';.and lo cated in the block bounded by
Hamilton Avenue, Co wper St:root, Forest Avenue and Waverly Street
with about 200 feet of frontage on Hamilton Avenue and a depth
of a bout 200 feet.
b) A parcel ofAland with *bout 70 lest of frontage
on Waverly Street in the muuhe block as that referred to in sub
paragraph ' ,(a) above, with 1 depth of about 190 feet.
o) A parcel of land with about 145 feet of frontage
on Cowper Street in the blook bounded by Cow per Street, Hamilton
Avenu e, Waverly Str eet and; .niversity Avenue, loca ted northwest-
erly of and adjacen t to the! City parking lot in that block, with
a depth of 200 feet.
d) A parcel of land in the sane block as that referred
to in subparagraph (o) above, with appr oximate ly 115 fe et of
frontage on Waver ly Str eet:a,nd a depth of 140 feet.
e) A parcel of land bounded sou theasterly by Hamilton
Avenue, southwesterly by i arson Street, northwesterly by the
existing City parking lot 4►nd northeasterly, by a public alley.
f) A parcel of lan d bounded n ortheasterly by Kipling
Street, northwesterly by Z tton Avenue., southwesterly by Wav erly
Street and southeasterly by a public alley.
g) Al parcel of lan d w ith approximately 100 feet of
frontage on Lytton Avenue flying southeasterly of and bounded on
all sides exeept the northeast by the existthg,eity parking lot,
in approximately the easterly 1/4 of the block bounded by WaverlyStr eet, Lytton Av enue, Bryant Street and lv orett :Av enue.
h) A parcel of land with approxi mately 45 test of
f rontage on Bryant Street and 100 tit of depth, lying north-
westerly of and im mediately adjacentto the eXtsting City p ark -
lot in about the southerly 1/4 of the block refe rred to s;n
sn 'sgr.ph (g) above.
i) A parcel of );and bo unded- southeaste rly by I ctt on
Avenue, so uth wesbply by Ramona St re et, northeasterly by Bryant
Street and northereeterly by a line drawn parallel to and distant
about 220 feet northwesterly of the northwesterly line of Lytto n
Avenue.
;All of the foregoing parcels are pore partioulariy shown on
the map entitled "Urdivsrsit3r Avenue District Parking and Beauti-
fication Projects", dated February 11, 1963, oil file In the
offioa of the City Cle rk of !the City or Palo Alto.
B) The acquisition of all lands, e aseme nts and rights
au xiliary to an y of the above and necessary to carry out the same.
2. All of the blocks, stmt. a nd alleys herei n me ntioned are
shown on maps of reoord in the office of the County R eco rder of Santa
Cla ra County, State of California, and shall be shown on the plans
herein referred to and to be filed with the City Clerk of said City. `
3. •Whenever any public yak is herein! refe rred to as ru nning
betwee n two public ways, or froreor to any Publio w ay, the intersections
of the public ways referreG to are included to the extent that work
shall be shown on the plans to be► done heroin.
4. All of said. work and irprovements',a re to be constructed at
the places;and in the par tioular loca tions,,of the forms, sine, dimen-
sions and Materials, and at the Lines, grades an d elev ations as shown
and delineated upon the plans, profiles andlspeoifioa tlon s to be made
ther efor , as hereinafter pro vided.
5. Them is to be excepted from the wor k above desor ibed a ny of
" itch work already done to line an grads a nd marked excepted or shown
not to be done on said plans, prc►riles and specifications.
6. Said Council does hereby adopt and establish as the official
grades for said work the gra deto rind elevations to be shown upon said
nlan s, profiles a nd specifications. All such gra des and eleva tions ar e
to be 1i' feet a nd decimals thereof with r eference to the datum plan e
of the City of Palo Alto.

'7. Notice is hereby given of the fact, that in many eases, said
wo rk a nd improvement will bring,ths finished work to a grade diff erent
f rom that f ormerly existing, and that to said extent s aid gr ades are
hereby changed and that said work will be do ne to said changed grades.
8. The descriptions of the acquisitio ns and improvements and
the termini of :she wo rk oontainn.d in this Resolution are general in
nature. All items of work do not necessa rily exte nd for the f ull
len gth of the descriptio n thereof . The plans and profiles of the wo rk
an d the maps and descriptions of the acquisitions, as oontained in the
Engineer's report, shall be controlling as to the correct and detailed
description thereof.
9. Said contempla ted aoqu .sit ,ns and improvements, in the
opin ion of this Coun cil, ar e of !more than local or ordina ry public .
benefit, and said Council does hereby make the costs and expenses
thereof chargeable upo n an assessmen t district, which district said
Council declares to be they district benefited by said acquisitions and
improvements, and the ex terior bo undaries of which are described and
w
shown on the map identified as 'University Av enue District Parking
an d Beautification Pr ojects", dated Februar y 11, 1963, and on file in
the office of the City Clerk, r efe ren ce to w hich is hereby made for
fur ther particulars,
10. Said Council further declares that all public streets,. high-
wa ys, lanes and alleys a nd other pu blioly-own ed pro perty within said
assessment district, sha ll be omitted from the an nua l assessmen t here-
a fter to be made to pay principal and interest on the bonds to be
issued to cov er the costs a nd expen ses of said a cquisitions a nd impro ve-
ments, an d to pay the costa and expenses of the maintenance and opera-
tion thereof.
11. No tice is here by given tha t ser ial bon ds to bear inter est
at the rate of not to ex ceed six per cent (6%) per annum, will be
issued hereun der in the man ner provided in Bond Plan E, Article:6,

Chapter 6, of Ordinance No. 1928, The Palo Alto Improv ement Procedure

Code, adoi;;ed by said Council on April 11, 1960, the last installment
of which bonds shall mature not to exoeed twe nty-fou r (24) years from
the seco nd day of July next succeeding ten mo nths f rom their date.
12. Except as herein otherwise provided for the iss uance of
bonds, all of aid work shall be done as pr ovid ed in A rticles
and 5 of Chapter 5 of said Code,; and Section 17 of Artiole XIII of
the Constitutio n of the State of Califor nia.
13. Said acquisitions and improvements are he reby referred to
the City Engine er of s aid City, as the officer having charge and con-
tr ol of the acquisition and co nstructio n of p ublic improveme nts in a nd
for said City of the kind described herein, bei ng a compete nt person
employed by 'laid City for that purpose; and said City Engineer is
he reby dire cted to ma ke and file with the City Clerk of said City a
report in t.'riting, presenting the following:
(a) Maps and description s of the lands, e aseme nts and
rights to be acquired;
(b) Plane and specifications of the proposed improvements
to be made pursu an t to this Resolution;
(c) Engineer's estimate of the total costs ani expenses
of said a cquisition s and improvements and of the incide nt al
expenses in connection thex;ew ith.
14. If any excess shall be, realized from the sale of said b onds,
it shall be spent for the maintenance of ssid acquisitions and improve-
men ts, unless the Cou ncil shall hereafter determ ine that said amount,
or any par t thereof, shall be deposited in the bond interest a nd
redemption fu nd.
