A RESOLUTION OF PRELIKENARY DETERMINATION AND OP INTENTION UNIVERSITY AVENUE DISTRICT OFF-STREET PARKIN() PROJECT NO. 64-3 RESOLVED, by the Council of the City of Palo Alto, California, as follows: 1. That it does hereby preliminarily determine that the publio interest, convenience and necessity require, and that it intends to order the following work to be done, acquisitions and improvements to be made, to -wits a) The acquiring of the following parcels of property and the improving thereof by grading and the removal of existing structures, and the oonstruoti,on therein of paving, curbs, drains, lights, fenoes, striping, and any buildings or structurea woes - eery for the proper operation thereof, and the making of all acquisitions and the oonetruoting of all improvements and the per- formanoe of all work auxiliary thereto and neoesaary to oomplete the name as off-etreet motor vehicle parking facilities: i. Parcel One. Beginning at the point of interseotion of the southeasterly line of Lytton Avenue (74 feet wide) with the southwesterly line of Kipling Street (50 feet wide); thence south- easterly, along said southwesterly line 43.00 feet to the point of intersection thereof with the oom!son dividing line between Lots 29 and 30 of Wade's Subdivision of Blook 30, University Park, a map of which was recorded April 20, 1893, in Book "0" of !laps at page 65, Records of Santa Clare County, California; thence southwesterly, along said dividing line, parallel with said southeasterly line 56.25 feet; thence at right angles northwesterly, 43.00 feet to a point on said southeasterly line; thence northeasterly, along said southeasterly line 56.25 feet to the point of beginning, being a portion of Lots 30 and 31 of said subdivision. ii. Paroel Two. Beginning at the moat southerly oorner of Lot 30, Wade/s Subdivision of Block 30, University Park, a map of which was recorded April 20, 1893, in Book "0" of Maps at page 65, Records of Santa Clara County, California; thence northwesterly along the oommon dividing line between Lots 19 and 30 of said sub- division and its northwesterly prolongation 43.00 feet to the point of intersection thereof with the southeasterly line of Lytton Avenue (74 feet wide); thence northeasterly along said southeast- erly line 56.25 feet; thence southeasterly, at right angles, 43.00 feet to a point on the dividing line between Lots 29 and 30 of said subdivision; thence oouthwesterly, along said dividing line between Lets 29 and 30, 56.25 feet to the point of beginning, being por- tions of Lots 30 and 3.1 of said Block 30. 131. Parcel Three. All of Lots 28 and 29, Wadee.s Sub- division of Block 30, Uni^fereityy Park, a map of which was recorded Aprii 20, 1893, in Book "0" of Naps at page 65, Records of Santa Clara County, California. iv. Paroel VOW. All of Lots 25, 26 and 27, Wade's Subdivision of Bleak30, university Park, a map of which was re- corded April 20, 1893, in Book "G" of Maps at page 65, Records of Santa Clara County, California. v. Pare ?eve. Beginning at the most eaaterly corner of Lot 14, Wade1s Subdivision of Block 30, University Park, a map of which was reoorded April 20, 189e in Book "Q" oe Maps at page 65, Records of Santa Clara County, California; thence south- weeterly, along the dividing line between Lots 13 and 14 of said subdivision 105.50 feet to the point of intersection thereof with the northeasterly line of waverley Street (74 feet wide); thence northwesterly, along said northeasterly line 37.50 feet; thence northeasterly, parallel with said dividing line between Lotc 13 and 14, 105.50 feat to a point on the dividing line between Lots 415 and 26 of said subdivision; thence southeasterly along said common dividing line between Lots 15 and 26 and its southeasterly prolongation, 37.50 feet to the point of beginning, being portions of Lots 14 and 15 of said subdivision. vi. Parcel Six. Beginning at the most northerly corner of Lot 16, Wade's Subdivision of Block 30, University Park, a map of which was reoorded April 20, 1893, in Book "Q" of Maps at page 65, Records of Santa Clara County, California thence southeasterly along the common dividing line between Lots 16 and 27 of said sub- division and its southeasterly prolongation 37.50 feet; thence southwesterly, at right angles 105.50 feet to a point on the north- easterly line of Waverley Street (74 feet wide); thence northwest- erly, along said northeasterly line 37.50 feet to the point of intersection thereof with the dividing line between Lots 16 and 17 of said eubdivieion; thence northeasterly along said dividing line between Lots 16 and 17 105.50 feet to the point of beginning, being portions of Lots 15 and 16 of said subdivision. b) The conetruotion of an off-street parking garage structure on the existing City parking lot bounded by Ramona Street, Hamilton Avenue, Forest Avenue and Bryant Street. o) The acquisition of all lands, easements and rights auxiliary to any of the above and the construction of all work necessary to oomplete the same. 2. All of the blocks, streets and alleys herein mentioned are shown on maps of record in the office of the County Recorder of Santa Clara County, State of California, and shall be shown on the plans here- in referred to and to be filed with the City Clerk of said City. 3. Whenever any public way is herein referred to as running between two public ways, or from or to any public way, the intersections of the public ways referred to are inoluded to the extent that work shall be shown on the plans to be done herein. 4. All of said work and improvements are to be constructed at the places and in the particular looations, of the forms, eizes, dimen- oions and materials, and at the lines, grades and elevations as shown -and delineated upon the plans, profiles and specifioatione to be made therefor, as hereinafter provided. • 0 5. There is to be excepted from this work above described any of such ;cork already done to line and grade and marked excepted or shown not to be done or, said plans, profiles and specifications. 6. Said Counoil does hereby adopt and establish as the official grades for said work the grades and elevations to be shown upon said plans, profiles and specifications. All such grades and elevations are to be in feet and decimals thereof with reference to the datum plane of the City of Palo Alto. 7. Notice is hereby given of the fact that in many oases said work and improvement will bring the finished work to a grade different from that formerly existing, and that to said extent said grades are hereby changed and that said work will be done to said changed grades. 8. The descriptions of the acquisitions and improvements and the termini of the work contained in this resolution are general in nature. All items of work do not necessarily extend for the full length of the description thereof. The plane and profiles of the work and the map and descriptions of the aoquisieione, as contained in the Engineerts report, shall be controlling as to the correct and detailed description thereof. 9. Said contemplated acquisitions and improvements, in the opinion of this Council, are of more than local or ordinary public benefit, and said Council does hereby make the costs and expenses there- of chargeable upon an assessment district, which district said Council declares to be the district benefited by said acquisitions and improve- ments, and the exterior boundaries of which are described and shown on the map identified as "University Avenue District Off -Street Parking Project No. 64-3", on file in the office of the City Clerk, which indi- cates by e. boundary line the extent of the territory included within the assessment district and which shall govern for all details as to the extent of said proposed district. 10. Said Council further declares that all .public streets, high- ways, lanes and alleys within said assessment district shall be omitted • from any. specific' lien special aaseasments hereafter to be made, and that all public streets, highways, lanes and alleys and other publicly - owned property within said assessment district shall be omitted from the annual benefit or ad valorem assessments hereafter to be made to cover the ()oats and expenses of said acquisition or to pay principal and interest or bonds, respectively. 11. Notice is hereby given that thirty-five per cent (35%) of the total cost of the project will be spread against properties bene- fited within the assessment dietriot in the form of specific lien assess- ments pursuant to Articles 4 and 5 of Chapter 5 of the Palo Alto Improvement Procedure Code, and that serial bonds to represent unpaid assessments and bear interest at the rate of not to exceed six per cent (6%) per annum, will be issued hereunder in the manner provided in Bond Plan B, Article 3 of Chapter 6 of said Code, the last installment of which bonds shall mature not to exceed nine (9) years from the 2nd day of July next succeeding ten months from their date. Notice is further given that serial bonds to represent that portion of the total coat of the project which is not financed by specific lien assessments shall be issued pursuant to Bond Plan G, Article 8 of Chapter 6 of said Code, the last installment of which bonds shall mature not to exceed twenty-four (24) years from the 2nd day of July next auoceeding ten months from their date. 12. Except as herein otherwise provided for the issuance of bonds, all of said work shall be done as provided in Articles 1, 4 and 5 of Chapter.• 5 of said Code, and Section 17 of Article XIII of the Constitution of the State of California. 13. Said acquisitions and improvements are hereby referred to the City Engineer of said City, as the officer having oharge and con- trol of the acquisition and construction of public improvements in and for said City of the kind described herein, being a competent person employed by said City for that purpose, and said Engineer is hereby directed to make and file with the City Clerk of said City a report in writing, presenting the following: 4 • a) Maps and descriptions of lands, easements and rights to be acquired; b) Plans and specifications of the proposed improvements to be made pursuant to this Resolution; o) Engineer's estimate of the total costs and expenses of said acquisitions and improvements and of the incidental expenses in connection therewith; d) Diagram showing the assessment district above referred to, and•also the boundaries and dimensions of the respective sub- divisions of land within said district as the same existed at the time of the passage of this Resolution, each of which subdivisions shall be given a separate number upon said diagram; and e) A proposed assessment of the costa and expenses of the proposed acquisitions and improvements upon the several subdivi- sions of land within said district in proportion to the estimated benefits to be received by such subdivisions, respectively, from said acquisitions and improvements, and of the expenses incidental thereto. 14. If any surplus shall be realized from the specific lien assessment or from the proceeds of aale of bonds issued under Bond Plan B, it shall be spent for the maintenance of said acquisitions and improvements; and any surplus remaining from the proceeds of sale of the bonds to be issued under Bond Plan G shall be deposited in the bond interest and redemption fund for said bonds. r a F * r w 1 • I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the Council of the City of Palo Alto, California, at a meeting thereon' held on the fifth day of October 196 4 , by the following vote of the members thereof: AYES, and in favor thereof, Councilmen: Arnold, Beaters, Comstock, Cooley, Cresap, Dias, Flint, Rodgers, Rohr's, Rus, Woodward NOES, Councilmen: Byxbee, Debt ABSENT, Councilmen: Porter, Zweng 4:11;x1 City Clerk ot` he4.Olty f Alto • geleler
