HomeMy WebLinkAboutRESO 3777A RESOLUTION OF PRELIMINARY DETERMINATION AND OF INTENTION OLD TRACE ROAD, ET AL. PROJECT NO. 64-4 • RESOLVED, by the Counoil of the City of Palo Alto, California, as follows: 1. That it does hereby preliminarily determine, that the public interest, convenience and necessity require, and that it intends to order the following work to be done, acquisitions and improvements to be made, to -wit: a) The improving of that portion of Manuela Avenue within the City limits of the City of Palo Alto, from the Southern Pacific Railroad right-of-way to the southerly City limits of said City, Oak Hill Avenue from Arastradero Road to Mesa Avenue, Old Trace Road from Arastradero Road to its southerly terminus, Mesa Avenue from Manuela Avenue to its southerly terminus, Manuela Court from Manuela Avenue to Old Trace Road, Robb. Road from Manuela Avenue westerly for its entire length, and an unnamed street running east - went from the southerly terminus of Old Trace Road, by the acqui- sition of easements necessary to achieve standard street widths and turnaround areas, and by the construction therein of grading, base pavement and wearing surfaoe, Portland cement concrete curbs and gutters, with sidewalk on Manuela Avenue, sanitary sewer mains, wye branches, laterals, manholes and appurtenances, storm drain pipe, catoh basins, manholes and appurtenances, domestic water mains, valves, hydrants, services and appurtenances, any street lighting facilities. b) The opening of Ditz Road from Old Trace Road northerly about 250 feet, and the opening of an unnamed street from Manuela Avenue westerly about 650 feet, and the opening of a series of streets within the area bounded generally by Manuela Avenue, the proposed Expreasway, the easterly extension of Manuela Court, and the improving thereof by grading and the oonstruotion therein of base pavement and wearing surfaoe, Portland cement concrete curbs and gutters, sanitary sewer mains, wye branches, laterals and appurtenances, storm drain pipe, catch basins, manholes and appurtenanoes, domestia water mains, valves, hydrants, aervioes and appurtenanoes, and street lighting facilities. c) .The acquisition of all lands and easements and the con- struction of all work auxiliary to any of the above and neoessary to complete the same. 2. All of the blocks, streets and alleys herein mentioned are shown on maps of record in the office of the County Recorder of Santa Clara County, State of California, and shall be shown on the plans here- in referred to and to be filed with the City Clerk of said City. • • • 3. Whenever any publio way is herein referred to as running between two public ways, or from or to any public ways, the intersec- tions of the public ways referred to are inoluded to the extent that work shall be shown on the plane to be done herein. 4. All of said work and improvements are to be constructed at the places and in the particular locations, of the forma, sizes, dimen- sions and materials, and at the lines, grades and elevations as shown and delineated upon the plans, profiles and specifications to be made therefor, as hereinafter provided. 5. There is to be excepted from the work above described any of such work already done. to line and grade and marked excepted or shown not to be done on said plans, profiles and specifications. 6. Said Council does hereby adopt and establish as the official grades for said work the grades and elevations to be shown upon said plans, profiles and specifications. All euoh grades and elevations are to be in feet and decimals thereof with reference to the datum plane of the City of Palo Alto. 7. Notice is hereby given of the fact that in many oases said work and improvement will bring the finished work to a grade different from that formerly existing, and that to said extent acid grades are hereby ohanged and that said work will be done to said changed grades. 8. The descriptions of the acquisitions and improvements and the termini of the work oontained in this Resolution are general in nature. All items of work do not necessarily extend for the full length of the desoription thereof. The plans and profiles of the work and the maps and descriptions of the acquisitions, as contained in the Engineer's report, shall be controlling as to the correct and detailed descrip- tion thereof. 9. Said contemplated acquisition and improvements, in the opinion of this Council, are of more than local or ordinary public benefit, and said Counoil does hereby melee the posts and expenses thereof ohargaabla upon an assessment district; whioh district said • • Council declares to be the district benefited by said acquisitions and improvements, and the exterior boundaries of which are described as the area bounded northerly by Arastradero Road, easterly by the Southern Paoiflo Railroad right-of-way, the proposed Expressway and the easterly city limits of the City of Palo Alto, southerly by the southerly City limits, and westerly by the westerly City limits, exclusive of the moat southerly parcel within the above boundaries, all as more particularly shown on a map thereof on file in the office of the City Clerk, which indicates by a boundary line the extent of the territory lnoluded within the assessment district and which shall govern for all details as to the extent of said proposed district. 10. Said Council further deolaree that all public streets, high- ways, lanes and alleys within said assessment distriot in use in the performanoo of a publio function as suoh, shall be omitted from the assessment hereafter to be made to cover the oasts and expenses of said acquisitions and improvements. 11. Notioe is hereby given that serial bonds to represent unpaid assessments and bear interest at the rate of not to exoeed six per oent (6%) per annum, will be issued hereunder in the manner provided in Bond Plan B, Article 3 of Chapter 6 of the Palo Alto Improvement Pro- cedure Code, the last installment of which bonds shall mature not to exceed nine (9) years from the second day of July next\suooeeding ten months from their date. 12. .Exoept as herein otherwise provided for the issuance of bonds, all of said work shall be done as provided in Articles 1 and 4 of Chapter 5 of said Code, and Section 17 of Article XIII of the Con- stitution of the State of California. 13. Said acquisitions and improvements are hereby referred to the City Engineer of said City, as the officer having charge and control of the acquisition and construction of public improvements in and for said City of the kind described herein, being a competent person employed by said City for that purpose, and said Engineer is hereby 3 0 directed to make and file with the City Clerk of said City a report in writing, presenting the following: a) Plane and epeoifioations of the proposed improvements to be made pursuant to this Resolution; b) Engineer's estimate of the total coats and expenses of said acquisitions and improvements and of the incidental expenses in connection therewith; o) Diagram showing the assessment distriot above referred to, and also the boundaries and dimensions of the respective subdivisions of land within said district as the same existed at the time of the passage of this Resolution, eaoh of which subdivisions shall be given a separate number upon said diagram; d) A propoaod assessment of the costs and expenses of the proposed acquisitions and improvements upon the several subdivision of land within said district in proportion to the estimated benefits to be received by suoh subdivisions, respectively, from said acquiaitiona and improvements, and of the expenses incidental thereto; and e) Maps and descriptions of the lands and easements to be acquired. 14. 11' any excess shall be realized from the assessment it shall be spent for the maintenance of said acquisitions and improvements, unless the Counoil shall hereafter determine that said amount, or any part thereof, shall be applied as a credit to each assessment herein. 4 1 I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the Council of the City of Palo Alto, California, at a meeting thereof held on the 5th day of October 195 4 , by the following vote of the members thereof: AYES, and in favor thereof, Councilmen: Arnold., Beehrs, Byxbee.
