RESOLUTION NO. 3128
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
RESCINDING RESOLUTION NO. 3185 PERTAINING TO PERSONNEL
MATTERS
WHEREAS, in 1960 the City of Palo Alto was involved in
litigation resulting from a railroad crossing accident at Palo
Alto Avenue, ·the litigation being entitled Aketa v. City of P!lO
~;and
WHEREAS, also named as defendant was a casual employee by
the name of Goodwin; and
WHEREAS, the City of Palo Alto adopted Res,olution No. 3185
providing for the defense of City employees cha,rged with negligence
in the performance of their duties; and
WHEREAS, the duties and obligations of the: City with respect
to the defense o£ City employees against any claim or actton against
them arising out of an act or omission occurring within the scope
of their employment are now covered by State law adopted by the
1963 Legislature.
NOW• THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. · That Resolution No. 3185 passed by the City Council
January 11, 1960 be and the same hereby is rescinded and is no
longer of any force or effect.
