RESOLUTION FIXING TDf.E: FOR REARING UPON PRO'POSED
ISSO'AtlCE OF BONDS TO OB!'AIN r.w..:ED!ATE POSSESSICN
WHEREAS, in a resol1lt1on adopted by the Council
of ·the City of Palo Alto on the 14th day of April, 1930,
in the matter of Aequ1s1t1on Flnd Icprovem")nt District
NO& l of the City of Palo Alto, thu acquisition or lands
for the ~1den1ng of California Avenue, a public atreot
in said City, as proposed in the .Resolution or Intention
in the above entitled matter adopted on March 1?, 19~0,
was ordered, reference t<.1 which resolutions are hereby
made for fUrther particulsrs, and the City Attorney of
the City of Palo Alto was oraored to bring an action for
the condemnation of the pro~rtt nocessary therefor and
to report ~o this City Council the amounts of money
r~~uired for the purpose of obtaining ~mmediate possesa1on
and use of the property so so'1ght to 'bf3 acquired; and
WHEREAS, the said. City Attorney has reportad to
this City Council that an action in eminent domain has
b·~en filed in the Superior Court, said action being
entitled "City of Palo Alto vs Harry B. Allen, Inc., et a.l",
being Superior Court Case No. 39257, Mld that proof was
presented to sa!i court of the amounts .. o! money required
to secure i~~ediate possession of the lands sought to be
condemned., a.nd that the eaid Court made an order directing
the depos1 t of lUOney to secure ?ttyrnent of con1ponsation
to dl:lfende.nts in said n.ction, e.nd that the total amount
required for ddposi t in cou.rt 1n order to obtain immediate
possession of said r)roperty as set forth in said Order
of Court is tlie s.um of Seventy Thousand and No/100
Dollars ($70,000.00); and
WHEREAS, 1t ia the intention of this City
Council to order that 'bonds of satd Distrlct be issued
and sold .for the purpose <)f obta1n:1n.g the necessary
mo'nev tc deposit in court in order to secure SAid
immetiate poa.se~sion and Ul!!e of said property:
NOVo', THEREFORE 1, BE IT RESOlVED by the Council
ot tho City of Palo ~to, as follows, to-wit:
1. 'Ihat Mortday, the 9th day of ·June, 1930,
at the honr of 8 o'clock 'P. rr.., is the t 1:;:e, and the
chambers of the City Council of the City of Palo Alto
ir. the City Hall 1n t.he City of Pa.lo Alto is the place,
hereby fixed fer a hearing upon t'l:la issuance of 'bonds
against the lands in the assessm~nt district in
Acquisition and Improvement District No. l of the City
of Palo Alto i'or the purpose of obtaining the amounts
required by the Court, to-w1t, amounts totaling the sum
of Seventy Thousand and No/100 Dollars ($?0,000.00), in
o:r·der that immediate possession and use of the public ways

sou.ght to be acquired undor the proceed1nga in the
abOve entitled matter may be had .• and for th~ purpose
of furnishing an opportunl ty to all persona owning
lands within the sa~d assessment district, or otherwise
interested, and feeling aggrieved by any act or determina-
tion done or made in the said proceeding or claiming
that any of the previous acts, determinations or
proceedings Bl'e irregular, defective, erroneous or faulty,
or having any objections to offer or any rf:iason to
edvttnce why bonds should not be issued. in t:t1e amount
above set forth fo1· the purposes abo•re r.set forth, to
appear before this City Councj.l and be heard upon any
or the above mentioned matters. Said bonds, so
proposed to be issued 1n the sum of Seventy Thousend
and No/100 Dollar·& (;"!o.ooo.OO), will be i3sued under
and in purauance or the provisions of the "Acquisition
and Improvement Act ot 1925", and shall bear inter·est
at the rate of six per cent per annum, payable semi-
annually, and the aggregate principal of all bonds 18sued
shall be paid and. discharged wi thir.~. twenty-·~hreo years
nfter the date of issuance, s.pprox1::.ately one-twentieth
part of such aggregate principal to 'be payable annually,
all in gold ooin.. {The first payment on the aggx·ogate
principal of the bonds will 'be made appro.ximately three
years aftei tr .. e issuAnce thereof.) A speciul fund.
for tl'.te payment of ss.id bonds will be con!Jti tuted by
the lovy of spacial assessment taxes upon the lands
within the assessment district, accordj,ng to the assessed
value of said lands {exclusive of the improvements
thereon) and in acaorda.nca with the resolution as
!'inally determined by this C1ty Council upon the 14th
day of April. 19~0, and as more fully set forth in the
Resolution of Intention in the above entitled matter
adopted by said City Council on March 17, 1930.
2. The ~ Clark of this City Council shaJl
prepare and sign a notioe of the above mentioned hearing
a.nd shall cause the same to be published by at least
two insertions in th., newspaper designated 1n said
Resolution of Intention, and B. copy of said not1ee to
be po.sted and kept posted for at lea.at two days on or
nea.r the chamber door of this City Council.
I hereby certify 'that the foregoing resolution
was adopted by the Council of the City of Palo Altc
at a special meeting h~ld on tho 20th day of May, 1930,
