R:'ESOLU'TION OY.' TilE COUNCIL OF 'J'HE CITY OF' PA!.tJ ALTO F.ELATIN·~
TO AS:If:MBLY BILL NO • 718:
WHEREAS, a bill, No. 718, has been introduced in
the A9 aembly of the State of C811forn1a, entitled:
"An act concerning public accounting and reporting
tmd supervision thereof:~ and providing penalties
for tha violation of this act" • and
WHEREAS, said &.ct in addition to pr-oviding for
systematic and uniform accounting by the officers of the
State and 1 ts political subdivisions 1 provides .for tho
creet1on of a 3tate fr~rcau at S9 cramento composed of ~
dir~ctor of finance And two deouties and orovided for the up~o1.ntm(mt of ''f1el.:l deputies''. ·
J~ong the duties of the fiold deputies is to examine
into the f1na.nc1o.l eondi.t1on and resources of each
mun1c1ps.J.ity, such examination to be made without notice.
The dt.lputies are given OOWt.)r to enter into the public
offices coi' a city, examine books, pepers, a.ocuments and
ac~ount.s, have access to the cesh drawers and cash, issue
subpoene.r. and examine witnesses. If such examlnation
disc loses rr:a lfeooance, misfeass.nce or nonfeasenc~ of an
officer to report to th{:l governor who s:tall transm1 t tho
same to the ntLo~n~y gen~ral for prosecution or civil
ection, !:>roviding for tho keeping of tha r1ccounts of the
mur.ic~pal.ity, the segregation of and the use or funds in
&ccord.,no::a therew1 th Bnd finally making it a misdemeanor for
municipal officers to fail or refuse to comply with the
provisions of the Act or such rules and re~lat1ons in
conn~c t1c·n ilherewi th as may be laid down by the board,
and further providing that all services shall be paid for
by the municipality.
Now, therefore, BE IT RESOI . .VhD by the Council of
the City of Palo Alto:
-:!'HAT an act providing for systematic and uniform
accounting tarthe State and its political subdivisions
a.nd prescribing forms therefor is well considel"ed
legislation, ·but when the act goe3 further and provides
for the ~~xamination, control, supervision of municipal
accounts and funds of the ci.ty, and control and .supervision
over the officials of a c1 ty, that said act then becomes
an unjust and uncalled for 1r<terference with a c1 ty and
its government in what is strictly a mun1~1pal affair and
not state, that 1t is obnoxious to and inconsistent with
local self-p;overnment guarantued to the cities by the
constitution and the Charters of the Cities:
NOW, therefore, this Council advises that it 1s
not for the b~st interests o! the City or of the State
that tAis act should be oassed.
