Rr~SOLUTION OF THE COUNCIL OF THE CITY OF PAil) AL'ro RELATING
TO PROPOSED ASSEMBLY COllSTITUTIONAL AMENDMENT NO. 2.
WHEREAS, Assembly Constitutional Amendment No. 2,
entitled "A. resolution to propose to the people of the
State of California an amendment to the Const1 tution
of the State of California, addlng to article XIII thereof
a ne"' section, to be numbered 17, relating to the ta.xation
of the properties of certain classes of ·util1.t1es cwn9d,
operated, managed, or controlled by public agencies of
government and relating to the t~at1on of the 1ncome3
and roce1pts of such clas8es of' utilities, whether publicly
or privately owned, operated, managed, or controlled,
upo:r. the sale and delivery of their eO'Mlod.itiea or service
to ;..ny other utility for resale or distribution", iL'l now
pending before the Legislature of the ~tate of California,
and
WHEREAS, Section 1 of Art. XIII provides '•property
-----such as may belong to the United States, this State
or to any County, 01ty and County or Municipal corporation
within this State shall be exempt from taxnt1onn, and
such has been the policy of the State since its admission
to the Union, and
WHEREAS, '''l'ax.at1on 11 is the power to impose ta.xt~s upon
the property of the citizen for the support of the govern-
ment and a municipal owned utility is public property
exempt from taxation, and.
'jVHEREAS, a municipalitt js a !)Olitical subdivision
instrumentality $.nd Bf"ency of the State government and
as such an integral part of the State itself, organized
a.nd existing for the protection of its citizens and
property and the orderly cot .. duct of social life of its
ir~ab1tants and. thus an in~parable part of the government
of the State coordinating with the State in the discharge
of governmental functions for the welfare of the people,
and
WHEREAS, the ownership of municipally owned public
utilities, such as water, light, end gas and the sale
of these aez•tricea to the people at a low rate is for the
w~lfare and benefit of the people, the city and the State
and 1n this respect is not to be regarded as"private
interest" for profit of 11 pr:lvate inter·est" and tnxable as
~ch,~d ·
~VHEREAS, sue h proposed ts.xat1on is so inimical to
the purpose and object of government both State and
municipal end is the taxation by the State government of
an arm and in!ltrumentallty of its govoernment.
NOW. THEREFCRE, be it resolved by the council of
tho City of Palo Alto:
THAT, The City of Palo Alto by its legislative bOdy
is opposed to the passag~ of Assembly Constitutional
Amendment No. 2, and respectfully advises the Legislature
of the State that in the intert:lst and welfare of the
people of the Stste the proposed ~nendment should not be
passed.
