PACIFIC RIGHT OP WAY AT PAI.O AL'ro AVENUE:
The Council of the City ot Palo Alto IX> RESOLVE
lUI to llows:
WHEREAS, the Railroad Comm1as1on of the State of
Cal1forn1a, under application No. 3708, rendered a
decision to the effect that a temporary grade crossing
over the traeka end right ot way or the Southern
P.ae1t1c Company be maintaiued at or near Palo Alto
Avenue in the City o'! Palo Alto~ and that .f'u.rther &nd
additional time be given on the order ot the
Commission for a separation of grades at this point; and
WHEREAS, at a hoaring on June 25, 1928, 1n
applications 3708 and 14323, it was suggested that the
City ot Palo Alto file a stipulation with the Commission
to the effect that if and when a grade ae~~on waa
const~cted at a point in San Mateo ~ounty approximately
1000 feet north or ::lanr'rancisqu1to creek, trom the
cross1n~ of Palo Alto Avenue with the Southern
Pacific s tracks, the City Would then oonaent to the
closing o1' the Palo Alto crossing:
IDW THEREFORE, the Council of the City o! Palo
Alto herewith f1lea its consent to the closing or the
Palo .Alto crossing upon and when a grade separation
has been constructed at that point in San Mateo County,
opproxi~ately 1000 feet north of San Franc1squito Creek
from the crossing or Palo Altc· Avenue with the
Southern Pacific right or way and tracks provided
said grade eepar.at1o~ snd a bridge over the Sen Frano1s-
,lui to Crselr oonnee t1ng Alma Stre.et with said grade
crossing or underpass are so constructed as to obviate
the necessity of a grade crossing at Palo Alto Avenue;
ana provided further, that an order is made by the
Railroad Coll'lll11ss1on o! · th.a .,tate of CalU'ornia continuing
tb.e present grade crossing at Pale Alto Avenue until
L!luch ti:r.e as the bridge and underpass are conetrueted.
The &bove and foregoing resolution was duly
passed by the Council of th~ City of Palo Alto at a
met)t1ng held on the 29th day or Aug1.1st, 1928, by the
