RJSOLVI •• follow•:
WHEREAS, thia Council tindo and determines
tbat the aa~u1a1t1on of certain marah lands are ot
pa'bl1o interest and neceaa1ty, and whereas, a
tentative agreement has been made wi~h the A1•1•o
~alt Company tor tho exchange of certain marsh
limdo ot the Cit7 far oerta1n marsh lands of the
Alviso Salt Compan7;
NOW 'l'lmREFORE,, tb1a Council authorizes the
exeeut1on ot a dead to the Al•1•o 8alt Company
tor 70.67 acres along Charleston Slough, part ot
tbe A~ .. • .. Standish purchase to the Alviso Salt
Company, and the payment of f26l.a3 to the aa1d
company in exchange for a deed trom the aa1d
salt compan7 veating title in the Cit76 free and
clear ot encumbrances, 1n the •o-callod 11 Island"
comprising 41.08 acres and 1n the Point, including
the overlap area easterly of Charleston Slough at
tho junction with Kaytield Slough, comprising
33.077 acre•, or a total or 7•.157 acre1. The
ditterence between the two total acreages, being
3.481 acrea, 1• to be paid tor by the City at
'7! .. 00 an aore by agreement w-ith the salt oompanJ',
the total being aa aet forth above, f261.53.
ln carrying out the exchange ot lands it is
w'lderstood that the Calitorn1a Pacific Title &
Trust ~ompany has aaaumed the l1ab1l1ty tor the
overlap area in the amount of the purchase price
from the Morgan Oyster Company; namely $50.00 an
acre, and will pay the City of Palo Alto upon
oonaummat1on ot the •bo.7{,e .t;i:e.nMaction f893.S5.
' ~ayment is to be made to the Morgan Oy3ter
Company for the land between ~ & O Survey IJ.39
and center of Charleston ~loush at the price fixed
per acre in the agreement between tho City ot Palo
Alto and the Korsen Oyster Company.
The Mayor and C1t1 Clerk are hereby authorized
to carry out the purpoaea e.t this resolution am
execute the necessary ~ .. ante and deeds therefor in
the name or the Cit1 of Palo Alto.
