RESOLVED, by the Co uncil of the City of Palo Alto,
California, that
WHEREAS, the tot al estim ated cost of the acquisitions and
impr ovements and the anse,ssment orde red p ursu ant, to Resol ution
of In ten tion No. 2944, a .dopteciby said Council on Ja nuary 13,
1953, was $497,560. 46;
WHEREAS, after the completio n of all of said acquisitio ns
and impr ovements and the payment of all expe nses incidental
thereto, there rema ins a surplus in the co nstruction f und fo r
sa id pr o f ee t in the total..amount of $25, 817.67; and
WHEREAS, the City Engin eer has determined and recomme nded
that said surplus be applied as a cr edit to the assessme nts .in
said pr oject;

NOW, THEREFORE, IT IS ORDERED, as follows:
1. That there is a su rplus in the construction fund for
said project, after the completion of all acquisition s and
improvemen ts a nd the paymen t of all expen sea in ciden ta l thereto,
in the tota l amount of $25,817,,67,
2. That the amou nt of said, surplu s be appor tioned pr c r ata
among the pr oper ties assessed for same, in the pr oportion that
each of said assessmen ts bear s to the total assessmen t.
3. That where the assessmen t has been paid in ca sh in fall,
the por tion of the sur plu s applicable ther eto sha ll be retur ned
in cash to the owner of the lan d u pon which the assessment was
lev ied, as su ch owner appears from the last equalized assessmen t
r oll at the time the refu nd is made. Where the assessmen t or any
installmen t thereof is unpaid, the por tion of the su rplu s

applic able thereto shall be applied upon the earliest unp aid
installment of p ri ncipal and inte rest.
4. That the City Cont roller and City Treasu rer are
authorized and directed to make whateve r payments and fund
transfers a re necessa ry to carry o ut the terms o .f this Resol ution.

Council of the City of Palo Alto, California, at a meeting thereof
